A. Level 3: Offenses “Requiring Serious” Administrative Action {TEC § 37.002 & 37.006}
A student shall be removed from class and placed in the appropriate Socorro ISD Disciplinary alternative education program
{TEC §37.002} for the following offenses which occur on or within 300 feet of school property or while attending a school
sponsored or school related activity on or off of school property: {District Policy FOAB}
There is no provision for appeals of DAEP placement resulting from offenses for which the state requires placement of the
student in a Disciplinary Alternative Education Program. {TEC §37.006(a)(4)}

Engaging in conduct punishable as a felony {TEC §37.006(a)(1)}
Engaging in conduct that contains the offense of assault under Penal Code § 22.01(a)(1). {TEC §37.006(a)(2)}.

§37.006(a)(3)}
a. Marijuana or a controlled substance as defined by Chapter 481, Health and Safety Code or by 21 USC §n 801
et.seq. or
b. A dangerous drug as defined by Chapter 483, Health and Safety Code
4. Selling, giving, in possession of, using, or delivering to another person an alcoholic beverage as defined by §1.04, Alcoholic
Beverage Code or committing a serious act or offense while under the influence of alcohol, or possesses, uses or is under the
influence of alcoholic beverage {TEC §37.006(a)(4)}
5. Engaging in conduct that contains the element of an offense relating to abusable glue or aerosol paint under Sections 485.031
through 485.035, Health and Safety Code or relating to volatile chemicals as defined under Chapter 484, Health and Safety
Code. {TEC §37.006(a)(5)}
6. Engaging in conduct that contains the elements of the offense of retaliation against any school employee regardless of time or
place under Section 36.06, Penal Code except as defined under Level IV (3) of the Student Code of Conduct {TEC
§37.006(b)}
7. Engaging in Conduct that contains the elements of public lewdness under Section 21.07, Penal Code, or indecent exposure
under Section 21.08, Penal Code {TEC §37.006(a)(6)}
8. Engaging in conduct that contains the elements of the offense of terrorist threat under Penal Code §22.07 {TEC
§37.006(a)(2)}
9. A student must be placed in DAEP for off-campus behavior (even outside the 300 foot boundary) if: {TEC §37.006)}
a. The student receives deferred prosecution for felony offense;
b. A court or jury finds that the student has engaged in delinquent conduct that constitutes a felony offense
c. The superintended or his designee has a “reasonable belief that the student has engaged in a conduct defined as a
felony offense in Title 5 of the Penal Code
10. A Student under the age of ten engages in expellable conduct. {TEC §37.007(c)(2)}

This letter is to inform you that I am recommending your child be placed in the district Disciplinary Alternative
Education Program (DAEP) because _______________________________________________ engaged in one of
the Major Offenses listed below. Also, be advised that your child may not attend any school activities.
A student may be removed from class and placed in the appropriate Socorro ISD Disciplinary Alternative Education
Program (TEC Sec.37008) for the following offenses which occur on or within 300 feet of school property or while
attending a school sponsored or school related activity on or off of school property:
1. Persistent Misbehavior (Six or more Level I or II violations excluding tardies and truancies to the Student
Code of Conduct during a nine week period).
2. Repeated interference with teacher’s ability to teach {TEC §37.002(b)(2)}
3. Behavior so unruly, disruptive, or abusive that it interferes with the teacher’s ability to teach {TEC §37.002(b)(2)}\
4. Displaying or distributing materials not approved by school officials
5. Forgery or any tampering with notes or school related documents
6. Insubordination (failing to comply with the lawful directives of school personnel)
7. Inciting a fight, or fighting
8. Involved in gang activity, including participating as a member or pledge, or soliciting another person to become a pledge or

Disruption of lawful transportation of students to or from school or school sponsored activities
Sexual harassment
Verbal abuse including name calling/slander/taunting/bullying
Racial Discrimination i.e., taunting, gesturing, racial or ethnic slurs
Profane, vulgar, obscene/written/oral language and /or gestures toward a district employee
Extortion, coercion, blackmail
Tagging and/or possession of graffiti paraphernalia at school or school activity
Deadly conduct or terrorist threats
Hazing as defined by TEC Sec.37.151 through TEC Sec. 37.15.29
Engaging in any comparable offense that disrupts the school environment or educational process that requires administrative
action

Gambling i.e., dice, cards, etc. (when anything of monetary value is exchanged based on the activity)
Misuse of Portable Telecommunication Devices on school property or at a school function which disrupts the

phones, pagers, iPods, radios, camcorders, cameras, etc….
25. Possession of a knife that does not require a mandatory expulsion. Possession of an object that has been
modified for the intended purpose of being used as a weapon.
26. Activating a fire alarm. Tampering with any fire suppression equipment: fire hose, or fire extinguisher.
27. Making or disseminating a hit list.

28. Be under the influence of prescription or over-the-counter drugs that cause impairment of the physical or
mental faculties.
29. Attempt to access or circumvent passwords or other security related information of the district, students, or
employees or upload or create computer viruses, including off school property if the conduct causes a
substantial disruption to the educational environment.
30. Attempt to alter, destroy, or disable district computer equipment, district data of others, or other networks
connected to the district’s system, including off school property if the conduct causes a substantial disruption
to the educational environment.
31. Use the Internet or other electronic communication(s) to threaten district students, employees or volunteers
including off school property if the conduct causes a substantial disruption to the educational environment.
32. Send or post electronic messages that are abusive, obscene, sexually oriented, threatening, harassing,
damaging to another’s reputation, or illegal, including off school property if the conduct causes a substantial
disruption to the educational environment.
33. Use e-mail or Web sites at school to encourage illegal behavior or threaten school safety.
34. Possess published or electronic material that is designed to promote or encourage illegal behavior that could
threaten school safety.
35. Engage in conduct that constitutes dating violence, including the intentional use of physical, sexual, verbal or
emotional abuse to harm, threaten, intimidate, or control another person with whom the student has or has
not had a dating relationship.
36. Record the voice or image of another without the prior consent of the individuals being recorded or in any
way that disrupts the educational environment or invades the privacy of others.
37. Possession of drug paraphernalia. Possess, use, give, or sell paraphernalia related to any prohibited
substance. (See Appendix F “paraphernalia”)
38. School fire not considered a felony.
39. Bullying to include cyber bullying as defined in Appendix F of this Code.
40. Possession or use of :
a. Fireworks of any kind, smoke or stink bombs, or any other pyrotechnic device;
b. A “look alike” weapon;
c. An air gun or BB gun;
d. Ammunition;
e. A stun gun;
f. Mace or pepper spray;
g. Pornographic material;
h. A laser pointer for other than an approved use; or
i. Any articles not generally considered to be weapons, including school supplies, when the principal or
designee determines that a danger exists. (For weapons and firearms see DAEP Placement and
Expulsion.)

ELEMENTARY DISCIPLINARY ALTERNATIVE EDUCATION PROGRAM CONTRACT
The Elementary Disciplinary Alternative Education Program is a long-term, in-house suspension program that
allows a student to stay in school and continue schoolwork while using concepts, strategies and methods of the Girls
and Boys Town Education Model to teach social and life skills.
_____ Attendance
Regular attendance is required. The school hours are Monday through Friday, 7:00a.m. – 2:30p.m. Students
will be bused to/from the elementary disciplinary alternative educational program campus on a daily basis.
Parents are required to sign students in at the bus stop or at the campus.
_____ School Bus Rules
The parent or another responsible adult 18 years of age or older is required to remain with each student at the
bus stop each morning and for after school dismissal. When the bus arrives, the parent or responsible adult
must sign the student onto/off of the bus. Students may be periodically searched upon entering the bus.
1) Students must be within dress code guidelines when they enter the bus
2) Students must abide by the rules of the Student Code of Conduct
3) The bus must be kept clean of trash and graffiti. Tagging of school property is a felony offense.
4) Cooperate with the bus driver, bus monitor, and security guard
5) Respect other riders. Abstain from using gang hand signs and profanity.
6) Smoking or use of any illegal substance is prohibited.
7) Stay in your seat. Keep all parts of your body inside the bus.
8) No open food or drink is allowed on the bus.
The bus driver is authorized to assign seats and may do so at his/her discretion. Violation of any of the
above rules may result in loss of bus privileges and/or referral to law enforcement agencies.
_____ Parent Transportation
When parents bring their child to school, the parents are required to meet KEYS Instructional Specialist at
entrance gate by 7:00 a.m. and must be picked up at 2:30 p.m.
_____ Student Dress/Attire
The Alternative school classroom dress code is established to teach hygiene, instill discipline, prevent
disruption and avoid safety hazards.
1) Student’s hair shall be clean and neat in appearance. Bandanas, sweatbands, “medias,” ball caps, or any
other head coverings are NOT permitted. Nothing that is gang-related in appearance or dress is allowed.
2) NO jewelry allowed. This includes earrings, nose rings, tongue “pegs,” watches, and /or other body
piercing. Necklaces, rosary beads, bracelets, and makeup are not permitted. Any inappropriate items
worn or brought in will be taken and will NOT be returned to student. Parents may come pick the items
up. The school district is not responsible for lost items.
3) No frayed or tattered clothing is acceptable and shirts must be tucked in at all times. Pants must fit
snugly at the waist without a belt. Sagging or baggy pants or oversized clothing will NOT be tolerated.
Shirts must fit property.
4) Footwear is required at ALL times. Tennis shoes are recommended. No steel toed or pointed boots are
allowed.
5) Students who are improperly dressed or groomed in any way during the school day will be required to be
in timeout and remain until dress and/or grooming requirements are met.
_____ Student Behavior
Students are expected to follow the district and campus rules for conduct. An environment conducive to
learning in the classroom and on campus grounds is expected at all times. Parents are responsible for
transportation, if student is kept after school.
_____ Parent Involvement
Parents are REQUIRED to attend Parenting Sessions, which reinforce the campus objectives. Parents and
students will actively participate in counseling sessions.

_____ Curriculum
The students must successfully complete the following basic elements before being considered for return to
their regular campus:
1) T.E.K.S. (Texas Essential Knowledge and Skills)
a. Pass all academic work
b. Work successfully on STAAR related material
c. Turn in all class work and homework on time (Only quality work accepted)
2) BEHAVIOR
a. Display a positive self-image on a daily basis
b. Demonstrate proper classroom behavior on a daily basis
c. On time Attendance on a regular basis
d. Be respectful of others and their property
3) COUNSELING
a. An important component to the Elementary Disciplinary Alternative Education Program placement
that your child will be participating in includes your participation in parent trainings offered at KEYS
Academy.
b. Your child will receive counseling offered by Escontrias Elementary and/or Socorro Independent
School District counselor(s).
c. Confidentiality will be maintained at all times.
d. Only information that pertains to academic progress will be shared with those working directly with
the student. However, when a situation arises where there is clear and imminent danger to the
student, immediate action will be taken and the proper authorities and parents will be notified.
4) PHYSICAL EDUCATION
Physical Education is an academic component of KEYS Elementary DAEP academic structure.
I understand and acknowledge that the requirements, regulations, and policies of the Elementary Disciplinary
Alternative Education Program have been read and explained to me. I also understand that failure to comply with
them will result in additional time spent in the alternative education program.
