Ignorance of law can be costly

Sometimes, a false arrest consists of unlawful restraint of a person’s freedom without proper investigation. The burden is on the individual, the person complaining he or she has been accused and falsely arrested, to persuade a court or jury that the officer acted without legal authority. On the other hand, this can be quite difficult to prove considering that the officer may have a strong evidence to convict. The ignorance of law has been happening several times in various cases and situations. Officially, it can be harmful for the person who is not guilty. I got a story to tell about my experience witnessing one boy who was dragged by the police officer in an uncouth way.

There is a boy who was African American got falsely arrested because he was the only black who was seen in a store. This could be costly incident to him considering that he was blamed for committing a crime and has a hard time to take the long process to prove that he is innocent. Indeed, he was accused of breaking and stealing some goods placed near the shop window.

First of all, my friend and I went shopping to the mall in Queens. We entered one store which sold any kind of Chinese merchandise. Coincidentally, we were both having a same race, so were the rest of customers who were looking around and shopping there.

This one black kid showed up and was just hanging and touching some stuff. The cashier was keeping an eye of him since he entered the store. I thought that she suspected this little kid because in most cases black people are likely to trespass the store bravely to

grab money out of the cash register. This common assumption made the sales girl acting in the weird way by calling the security and giving an erroneous hunch. I, in this matter, saw the kid personally doing no mistake at all. He tried to defend himself but nobody believed his word. After several question of investigation by two police officers, this boy is scared so he could not explain clearly because of some pressures that should not be happened. Actually, he was very young to face this problem.

This is a common incident of a false arrest situation where the officer may arrest that black kid who was accused of shoplifting with no real suspicion that the kid did something wrong, just because he may have been the only person who has a different skin color. Besides brutality, it was connected with a racial matter. Minority has been treated unequally and falsely arrested without further investigation.

Malicious things which burst out in society sometimes cannot be tolerated.

Assumption power is more dominating the case that will hurt people in many ways.

Malfunction of assumption and law is still arbitrarily used in judgment which will lose people’s faith in law.
