Both parts and all sections of the application form should be filled in for the application to be processed. The first part, i.e. the Web-based survey is used to collect information for statistical purposes such as personal data (i.e. name, gender, nationality), contact details, mandate/s applying for and nominating entity. The webbased survey should only be completed once, i.e. multiple selection allowed to indicate if the candidate is applying for more than one mandates. This is the second part, i.e. of the application form in Word which can be downloaded, completed and saved in word format and then submitted as an attachment by email. Information provided in this form, includes a motivation letter of maximum 600 words, will be used as received to prepare the public list of candidates who applied for each vacancy and will be made available to concerned parties, including through the OHCHR Internet. Once completed the application form in Word should be submitted by email to hrcspecialprocedures@ohchr.org If the candidate is applying for more than one mandates, an application form needs to be completed and sent for each mandate. In 2008 he was awarded a Ph.D. in public health from the University of Gent. He has a unique blend of academic qualifications in law and public health. Ooms was the head of mission for Médecins Sans Frontières (MSF) in Burundi in 1999 and in Mozambique from 2000 until 2002. He was the Executive Director of MSF Belgium from 2004 until 2008. Since 2008 he has been a Researcher at the Institute of Tropical Medicine (ITM) in Antwerp. He has affiliations with the law faculties of Antwerp and Georgetown Universities. He is the coordinator of the Go4Health research project (www.go4health.eu). Ooms included several civil society organizations in this academic project. Proven work experience in the field of human rights. (Please state years of experience. As a scholar, Gorik Ooms has written extensively on the right to health, mostly in English but also in French. Working for MSF he used both English and French. He can read and understand German and Portuguese. Gorik Ooms can rightfully call himself a human rights (and right to health) practitioner: his leadership role with MSF was a constant effort to realize the right to health in the poorest parts of the world. In this capacity, he worked with governments and ministries of health of developing countries, and with governments and ministries of countries providing international assistance. While working with MSF, Ooms completed his Ph.D. thesis on “the right to health and the sustainability of healthcare: why a new global health aid paradigm is needed”. His supervisor, Paul Hunt, was the Special Rapporteur on the right of everyone to the enjoyment of the highest attainable standard of physical and mental health. Ooms was one of the experts of the group that elaborated the Maastricht Principles on Extraterritorial Obligations of States in the Area of Economic, Social and Cultural Rights. He took a leadership role on the issue of international assistance. Ooms is a member of the UNAIDS Reference Group on HIV and Human Rights, and the Civil Society Consultative Group of the International Health Partnership. ESTABLISHED COMPETENCE (200 words) Nationally, regionally or internationally recognized competence related to human rights. (Please explain how such competence was acquired). Gorik Ooms is competence in the field is acknowledged by civil society and academics. For example, he recently gave the keynote speech at the Action for Global Health Civil Society Conference on Universal Health Coverage in Dakar in February 2014. In October 2013, he was one of the three speakers at the Global Health Lab of The Lancet and the London School of Hygiene and Tropical Medicine on “What is the contribution of human rights to global health?” Ooms was a Commissioner of the University of Oslo and The Lancet Commission on Global Governance for Health. The Report of this Commission highlights the importance of the role of human rights in global governance for health and of the role of the Special Rapporteur. (Indicate whether candidate can dedicate an estimated total of approx. three months per year to the work of a mandate) Gorik Ooms’ present work as a researcher at the ITM is related to the Go4Health project, which proposes the ‘Realization of the Right to Health for Everyone’ as the overarching health goal for the post-2015 development agenda. The work of the mandate of Special Rapporteur is entirely compatible with that project. He can easily dedicate three months per year or more to the work of that mandate. Ooms is a frequent traveler, giving lectures in universities and institutes all over the world. We have no doubt that he will be able to participate in all Human Rights Council sessions in Geneva and New York. The successful application for competitive research funding of the Go4Health research project demonstrates Ooms’ ability to bring together an international team and to mobilize the necessary financial resources. Gorik Ooms is also the executive director of the Hélène De Beir Foundation (see www.hdbf.org). Motivation Letter (600 word limit) We are delighted to nominate Gorik for the mandate of Special Rapporteur for many reasons – here we highlight the four essential qualities we are looking for in the next Special Rapporteur. First, it is essential to us that the Special Rapporteur combines a rigorous knowledge of international human rights law with a strong civil society commitment. According to Martin Dixon (Textbook on International Law, 7th edition), "it is important for the international lawyer concerned with human rights to draw a clear distinction between substantive rules of law and rules of morality, no matter how much the latter might be thought desirable or necessary. As with other areas of international law, no amount of pure rhetoric can ensure that a state will observe an international human rights obligation, but there is considerably more chance if that obligation can be shown to flow from a recognised ‘source of law’." While we agree with that statement in principle, we think that drawing this distinction too often leads to statecentered interpretations of international human rights law. This is captured in the notion of progressive realization in accordance with maximum available resources, and too often overlooks the international or extraterritorial responsibilities enshrined in international human rights law. Civil society organizations are the frontrunners of more cosmopolitan interpretations of international human rights law. We believe the Special Rapporteur should have a good understanding of the mainstream state-centered interpretations, while taking a clear position in support of the cosmopolitan interpretations that are advanced by civil society. Second, the Special Rapporteur would ideally have an expertise in the theory and in the practice of the right to health. There is a growing number of academic experts in the right to health, but not many of them have lived and worked in the countries where the realization of the right to health is most difficult and most urgent. Gorik has. Third, the coming years are crucial for international cooperation to reduce global inequities – we believe it really is about addressing inequities, not just reducing extreme poverty.
