ANNEX
The International Migration Law Unit of IOM recommends the Committee to
advise States Parties of the Convention on the Rights of the Child to take the
following actions in respect of children and migration:

Ensure that national legislation is in accordance with international and
regional human rights standards and that relevant legislation specifically
sets out provisions on the rights of migrant children. Note that is strongly
recommended that the actual implementation of those provisions are
monitored and reported.

Make explicit reference in the national legislation to the equal access to
social rights and basic services for all children, irrespective of their
migration status and remove any barriers to the attainment of these
rights.

Introduce the principle of non-detention of children in legislation and
policy and formalize policies on alternatives to detention which are in
accordance which human rights standards.

Make explicit recognition of the right to birth registration of children
born to irregular migrants and implement policies which raise awareness
of this right, both for state officials and at the community level. Devote
resources to develop movable registration facilities to increase access to
birth registration in rural areas and for children born outside of
hospitals.

In accordance with the provisions of article 45(a) of the Convention on
the Rights of the Child, the Committee should invite the Special
Rapporteur on the Human Rights of Migrants and the Special
Rapporteur on the Sale of Children, Child Prostitution and Child
Pornography to jointly conduct a Global Study on the transnational
cooperation measures necessary to ensure the protection of children on
the move and to guarantee their rights independently of their
immigration status. Such a study should be guided by the Convention on
the Rights of the Child and other relevant international standards and
take full account of the recommendations adopted by the Committee at its
September 2012 Day of General Discussion on The Rights of All Children
in the Context of International Migration.
