AGREEMENT FOR A NON-DEGREE
GRADUATE STUDENT EXCHANGE PROGRAM
BETWEEN
CENTRAL WASHINGTON UNIVERSITY
AND
[NAME OF PARTNER INSTITUTION]
Central Washington University (hereinafter referred to as “CWU”), located in Ellensburg,
Washington, United States of America, and [NAME OF PARTNER INSTITUTION],
(hereinafter referred to as [“…”], located in [CITY, PROVINCE/STATE, COUNTRY] hereby
agree upon the below terms and conditions for the establishment and governance of a
Graduate Student Exchange Program between CWU and [NAME OF PARTNER
INSTITUTION]. CWU and [NAME OF PARTNER INSTITUTION] will be collectively
referred to hereinafter as “the institutions”.
Purpose
1.
The purpose of this agreement is to provide expanded curricular offerings and
intercultural opportunities for students in the [PROGRAM NAME] of CWU’s
[ACADEMIC UNIT] and the [PROGRAM NAME] of [NAME OF PARTNER
INSTITUTION]’s [ACADEMIC UNIT].
Administration
2.
At CWU, exchanges will be coordinated through the Office of International Studies
and Programs, and at [NAME OF PARTNER INSTITUTION], programs will be
coordinated through the [NAME OF RESPONSIBLE OFFICE].
3.
The sponsoring academic department at each institution will name a liaison to
collaborate and communicate with the respective coordinating office of the other
institution under this agreement.
Admission
4.
Each institution, when acting as the home institution, shall conform to the identified
admission requirements of the host institution and shall assume full responsibility
for the assessment and nomination of qualified candidates from the home
institution. Nominated candidates must be admitted to graduate study at the home
institution at the time of their nomination. The home institution shall notify the
host institution of the nominations made. The host institution shall then make the
final selection of the participants and notify the home institution of such selection.
The host institution’s selection process shall consist of a detailed evaluation of each
nominated candidate’s previous academic record, motivation, and overall potential
to succeed in an international academic environment. Nominated candidates from
either institution must hold at least a 3.0 GPA or equivalent, and must demonstrate
minimum proficiency in the applicable language of the host institution, as
determined by the host institution. The institutions will work together to establish
a schedule containing deadlines for completion of each of the responsibilities
delineated in this paragraph 4, and each institution will be bound by the deadlines
contained in such schedule.
5.
Each institution shall accept the equivalent of up to [e.g. two (2)] full-time
student(s) of the other institution in its graduate program for one full academic year
as non-degree visiting students. The institutions may agree in writing at any time
to amend the number of exchange students accepted annually under this agreement.
a. The institutions will attempt to achieve the goal of a balanced exchange over
the term of this agreement. Balanced exchange exists when some multiple of
one (1) semester at [NAME OF PARTNER INSTITUTION] is exchanged for
an equivalent multiple of 1½ quarters at CWU. For example, a balanced
exchange exists with the exchange of one (1) semester at [NAME OF
PARTNER INSTITUTION] and 1½ quarters at CWU; two (2) semesters at
[NAME OF PARTNER INSTITUTION] and 3 quarters at CWU; and so on.
b. If a student withdraws or is withdrawn before the end of an ongoing exchange,
the remainder of the semester or quarter underway shall count as completed for
purposes of calculating a balanced exchange.
c. If at the end of any academic year an imbalance exists in the number of students
exchanged by the institutions, the imbalance shall be corrected by adjusting the
total number of students to be exchanged in the following year and in
succeeding years as may be required to restore the balance.
Tuition
6.
The payment of tuition and other fees shall be as follows:
a. When studying as an exchange student under this agreement at [NAME OF
PARTNER INSTITUTION], each CWU student shall pay tuition and other
required fees to CWU and will be exempted from payment of tuition and other
required fees to [NAME OF PARTNER INSTITUTION], excluding [ADD
NAMES OF ADDITIONAL FEES].
b. When studying as an exchange student under this agreement at CWU, each
[NAME OF PARTNER INSTITUTION] student shall pay tuition and other
required fees to [NAME OF PARTNER INSTITUTION] and will be exempted
from payment of tuition and other required fees to CWU, including the NonMatriculated Student and International Student Fees, but excluding coursespecific fees.
Student Standards, Responsibilities & Privileges
7.
All exchange students shall be subject to the same academic and disciplinary
regulations and policies as pertain to regularly enrolled students at the host
institution.
8.
Exchange students who are accepted for a full academic year must be in good
standing (3.0 GPA) upon the completion of each term at the host institution, in
accordance with the host institution’s academic requirements for its regularly
enrolled students. If an exchange students fails to meet the requirements of this
paragraph, the host institution, the home institution or both may require said student
to return to his/her home institution.
9.
Exchange students shall have the same access, on the same basis and at the same
cost, to all privileges and activities including academic, athletics, library, computer,
counseling and other resources of the host institution as regularly enrolled graduate
degree candidates of the host institution.
10.
The host institution shall assist each exchange student in locating housing. All
travel, living and academic expenses other than tuition shall be borne by each
student. These expenses include, but are not limited to: the student’s living
expenses while school is in session (room and board), the student’s living expenses
during extended academic recess (i.e. holidays, winter and spring break periods,
etc.), living expenses for spouse and dependents, passport expenses, excess
baggage shipment and storage, repatriation, international and domestic travel, and
such personal expenses as telephone charges, books, etc.
11.
Hospital and other medical expenses are the sole responsibility of each exchange
student. Each exchange student must purchase health, accident, emergency
medical evacuation and repatriation of remains insurance for himself/herself and
his/her spouse and dependents at least comparable to that made available by the
host institution to cover medical and emergency contingencies while in the host
country, and provide proof of health and emergency insurance coverage to the host
institution prior to the start of the exchange term.
12.
Violation of local laws committed in the host country may, at the option of either
the home institution or host institution, subject the exchange student to immediate
withdrawal of his/her academic sponsorship and to immediate expulsion from the
host institution.
13.
The home institution shall be responsible for the visa and passport arrangements of
its students necessary for their participation in the exchange.
Responsibilities of the Institutions
14.
The host institution shall send the official assessment of each exchange student’s
academic performance directly to his/her home institution within 30 days of the
conclusion of the exchange term, provided said student has satisfied all procedures
and obligations necessary to release such documents. However, it shall be the sole
responsibility of the home institution to decide how many credit units the student
may actually receive for courses taken at the host institution.
Notice
15.
Any formal notice to either institution under this agreement must be made in writing
signed by the institution giving it and shall be served either personally or by
Registered or Certified Mail or by overnight or expedited delivery, addressed as
follows:

Independent Capacity; Indemnification
16.
Each institution will be responsible for the acts or omissions of its own employees,
volunteers, officers, or agents in the performance of this agreement. Neither
institution will be considered the agent of the other nor does either institution
assume any responsibility to the other for the consequences of any act or omission
of any person or entity not a party to this agreement.
Force Majeure
17.
Neither CWU nor [NAME OF PARTNER INSTITUTION] shall be liable to the
other or deemed in breach of this agreement if and to the extent such institution’s
performance under this agreement is prevented by reason of circumstances beyond
its control, such as strike or other labor disputes, civil disorders, severe weather,
natural disasters, government issued travel warnings or alerts, war, or national
emergencies.
Compliance
18.
Each institution agrees that it will abide by all applicable laws and governmental
regulations when performing its obligations under this agreement.
Jeopardy of Accreditation or Non-Profit Status
19.
Neither institution shall engage in any action or inaction that would jeopardize the
other institution’s accreditation by applicable accrediting bodies; the institution’s
tax status; or the eligibility of the institution’s students for financial aid.
Notwithstanding the other provisions of this agreement, if either institution
breaches its obligations under this paragraph, the non-breaching institution will
have the right to immediately terminate this agreement by written notice to the
breaching institution.
Miscellaneous
20.
This agreement shall be subject to all applicable laws, treaties, regulations, orders,
and decrees of the institutions’ respective countries, and any delay in, or
termination of performance due to such laws, treaties, regulations, orders, or
decrees shall not be considered a breach of this agreement.
21.
Neither party to this agreement shall have the right to assign any right or obligation
arising hereunder without the written consent of the other party, which consent shall
not be unreasonably withheld.
22.
This agreement shall be governed by the laws of the State of Washington, United
States of America, without regard to the conflicts of law principles thereof. Venue
for any dispute arising hereunder shall be in Kittitas County, Washington.
23.
The exchange of students outlined in this agreement shall be subject to all
applicable immigration laws and regulations of [country of partner institution] and
the United States of America and any limitations and/or restrictions related thereto,
as determined by CWU's Office of International Studies and Programs and the
[relevant office at the partner institution].
24.
This agreement constitutes the entire agreement between the institutions and
supersedes any and all other agreements, understandings, negotiations and
discussions, oral or otherwise, express or implied, including but not limited to any
foreign language translation of this agreement prepared for negotiation and
discussion purposes. Any later change in any term or condition of this agreement
shall be effective only if in writing and signed by both institutions. If any provision
of this agreement is determined to be invalid or unenforceable by a court of
competent jurisdiction, it shall be ineffective only to the extent of such
determination and the validity and enforceability of all the remaining provisions
shall not be affected.
Nondiscrimination
25.
In performing this agreement, the institutions agree not to discriminate based on
race, color, religion, national origin, ancestry, sex, age, marital status, familial
status, sexual orientation, gender identity and expression, genetic information, or
veteran status. To the extent practicable and required by applicable law, the partner
institutions also agree to reasonably accommodate individuals with disabilities.
Duration of Agreement
26.
This agreement shall be in force and be binding upon the parties hereto for a period
of [e.g. five (5) years] from the latest date of signature shown below, and is
renewable for additional periods of time as agreed in a written amendment signed
by the parties. Except as otherwise provided herein, either party may terminate this
agreement at any time with six months’ advance written notice to the other party.
In the event that this agreement is terminated, exchange students then enrolled
under this agreement will be permitted to complete the exchange program in
accordance with the terms of this agreement.
