Eric L. Martin
Experience
Eric Martin's practice focuses on natural resource development with an emphasis on
property issues and transactions in the oil and gas (upstream and midstream) and
mining industries. He helps clients buy, lease and sell natural resources; obtain
financing; permit projects on the local, state and federal levels; and resolve
associated development issues. Eric's experience also includes representing clients
before local governing bodies, state adjudicatory bodies and Oregon and Washington
courts.
Prior to law school, Eric taught English as a Peace Corps volunteer in Targu Ocna,
Romania (2003-2005) and worked at Historic Boston Incorporated, a historic
preservation revolving fund and advocacy organization (2002-2003).

Assisted clients with development and operational issues for underground gas storage facilities in Alaska, California, Illinois,
Oregon and Utah.

Kansas, North Dakota, Pennsylvania, Utah and Wyoming.

Authored numerous drilling title opinions, division order title options and gas storage title opinions on both public and pri vate
lands.

Advised clients on all manner of oil and gas agreements, including joint operating agreements, farmout agreements, gathering
agreements, processing agreements, master service agreements, pipeline easements and franchise agreements, and surface use
agreements.

Assisted clients with mining issues in Alaska, California, Illinois, Minnesota, New Mexico, Oregon and Wisconsin.
Permitting

Represented client in the successful land use permitting of a surface mine and commercial composting facility, including
successful resolution of appeals before the Oregon Land Use Board of Appeals and the Oregon Court of Appeals.

Represented developer of the Whistling Ridge Energy Project, including issuance of a site certificate from the Washington
Energy Facility Site Evaluation Council, obtaining unanimous Washington Supreme Court decision upholding the site certificate,
and successfully resolving litigation brought under the Columbia River Gorge National Scenic Area Act.

Advised clients on National Environmental Policy Act (NEPA), State Environmental Policy Act (SEPA), and Endangered Species Act
compliance in connection with a variety of development projects, including multiple wind energy facilities and mine sites.

Obtained land use permits for $250 million transportation infrastructure project crossing protected environmental areas.

Assisted client in navigating local historic resource regulations and state historic resource review process in connection with the
successful permitting of a $20 million project.

Negotiated revisions to restrictive city environmental zoning regulations that allowed clients' businesses to remain in operation.

Obtained reversal of Oregon Department of Land Conservation and Development's denial of Measure 49 claim.

Conducted permitting due diligence and drafted permitting opinion in connection with $12.4 million refina ncing for an assisted
living facility.
