SALFORD CITY COUNCIL - RECORD OF DECISION
I , Councillor Keith Mann, Lead Member for Education,
in exercise of the powers conferred on me by Paragraph D 4 (a) (xii)
of the Scheme of Delegation of the Council do hereby authorise and approve
a new Instrument of Government for New Croft High Community Special School to reflect the
reconstitution of the governing body, as requested by the governing body in accordance with
the Education Act 2002 and under the School Governance (Constitution) (England)
Regulations 2003.
The reasons are:
1. On 1st September 2003 the School Governance (Constitution) (England) Regulations
2003 came into force. These regulations require all governing bodies to review their
composition and reconstitute with a new Instrument of Government in place by 31st
August 2006. Governing bodies decide when is the best time for them to do this and
still comply with this requirement.
2. On the 29th March 2004 the Governing Body of New Croft High Community Special
School approved a draft Instrument of Government to comply with the School
Governance (Constitution) (England) Regulations 2003.
3. The Governing Body also included in the draft instrument a change of name for the
school. They wish to change the name of the school to Chatsworth High School.
4. A competition was held in the school to choose the name. The parents, pupils and
staff of the school have been consulted on the name change are in favour of it.
5. Elected members at one of their lead member briefings also discussed the new name
informally and it was supported with no objections being raised.
6. Any school involved in a Private Finance Initiative (PFI) building project must inform
the contractor in writing that the school name is to be changed. The school will write
to Jarvis, the contractor for the new school building, to inform them that the name of
the school is to be changed as soon as this Record of Decision has been signed.
The LEA PFI team have been consulted and kept informed.
7. The Clerk to the Governing Body (Governor Services, Salford Education and Leisure)
has checked the draft Instrument of Government to ensure it complies with The
School Governance (Constitution) (England) Regulations 2003. The Clerk has also
followed guidance given by Philip Heyes in the Salford City Council Law and
Administration team
8. The legal process for a new Instrument of Government to be made is by Order of
Salford Local Education Authority, in accordance with School Governance
(Constitution) (England) Regulations 2003.
9. The draft instrument is attached.
10. Once approved, the new Instrument of Government will come into effect from the
date it is made.
Options considered and rejected were:
None - as once the draft Instrument of Government has been approved by the governing
body a new Instrument of Government is required under School Governance (Constitution)
(England) Regulations 2003.

The name of the school is Chatsworth High School.
2.
The school is a community special school.
3.
The name of the governing body is “The Governing Body of Chatsworth High School”
4.
The governing body shall consist of:
a)
five parent governors;
b)
three LEA governors;
c)
three staff governors;
d)
four community governors,
5.
Total number of governors 15.
6.
This instrument comes into effect on 1st May 2004.
7.
A copy of this instrument must be supplied to every member of the governing body
(and the head teacher if not a governor).
