TITLE : TERMINATION OF CONTRACT WITH MORRISON’S SUPERMARKETS PLC .

RECOMMENDATIONS : That the contents of this report be noted.

EXECUTIVE SUMMARY : Salford City Council entered into an agreement in 2001 with William

Morrison’s Supermarkets PLC to enforce parking regulations on their Eccles car park.

Morrisons have now informed the Council of their decision to terminate the agreement with effect from the 31 st July, 2005.

1. Backgound

1.1 Following construction of the Eccles Morrison’s Store in October, 2001, a Traffic Regulation

Order (TRO) entitled THE CITY OF SALFORD, ECCLES SUPERSTORE (OFF-STREET

PARKING PLACES AND CAR PARKS WITH DISABLED PARKING SPACES) ORDER

2001 was imple mented at the company’s request to control use of the car park.

1.2 The Council were requested to enforce the Order under the provisions of the Road Traffic

Act 1991 using Parking Attendants pursuant to the Act following the introduction of

Decriminalised Parking Enforcement.

1.3 Control of the car park was achieved by way of a Pay and Display regime, all machinery and signing being provided by Morrisons. Motorists were reimbursed their car parking fee on presentation of a ticket in the store following the purchase of goods.

1.4 The Council agreed to provide a patrol to enforce the regulations for four hours each day that the car park was in operation subject to a monthly management fee. Morrisons retained all monies deposited in the ticket machines whilst fees resulting from the issue of Penalty

Charge Notices for breaches of the TRO were retained by the Council.

1.5 A Contract relating to the management of the car park was signed by both parties.

2. Current Position

2.1 Clause 6.3 of the contract allows fo r either party to give one month’s notice to terminate this agreement.

2.2 A letter dated the 20 th June, 2005, was recently received in which it was stated that

Morrisons wished to terminate the agreement on the 31 st July, 2005. No explanation was offered, neither was any detail provided of any future alternative arrangements to control the car park.

3. Recommendation.

3.1 As all parties have complied with the conditions of the contract, including those in relation to termination, this report is for information only.

3.2 An acknowledgement of the notice to determine the agreement has been forwarded to

Morrisons. This points out that under the provisions of the Road Traffic Act, 1991, the existing TRO may only be enforced by Parking Attendants employed by or on behalf of the

Local Authority.
