APPENDIX 5 AMENDMENT TO COUNCIL CONSTITUTION “DIRECTOR OF SOCIAL SERVICES” AND “CHIEF EDUCATION OFFICER” 1. The present statutory position is that the Council are required to appoint : - A Director of Social Services (Section 6 of the Local Authority Social Services Act 1970) - A Chief Education Officer (Section 532 of the Education Act 1996). 2. The Officers appointed in accordance with paragraph 1 above do not have to have the precise wording listed as their job titles, but have to be identified as the persons carrying out the duties appropriate to those posts. Hence, the former Director of Education and Leisure is the “Chief Education Officer”, and the former Director of Community and Social Services is the “Director of Social Services”. 3. Pending enactment of the Children Bill, the existing holders of the posts of “Director of Social Services” and “Chief Education Officer” will be required to continue to fulfil the statutory duties relevant to those posts. However, the newly appointed Strategic Director of Community, Health and Social Care and Strategic Director of Children’s Services, will be able to work towards their new roles in anticipation of the Children Bill becoming law. 4.
