Offences against the Person: Guidance note This note refers to the most common assault-type convictions that come before the Licensing Regulatory Panel. They are shown in order of seriousness, beginning with the most minor. All of these offences carry the full range of sentencing powers, including imprisonment. Legislation s39 Criminal Justice Act 1988 Offence Common Assault Offender intends, or is reckless as to whether, victim put in fear of immediate unlawful force. No actual harm necessary. Court of trial Only at Magistrates’ Court s47 Offences against the Person Act 1861 Assault occasioning actual bodily harm. Usually minor, non-permanent injury and no weapon involved. Can be tried at Magistrates’ or Crown Court s20 Offences against the Person Act 1861 Grievous bodily harm or wounding. Very serious if premeditated or weapon involved. Can be tried at Magistrates’ or Crown Court s18 Offences against the Person Act 1861 Grievous bodily harm or wounding with intent to cause serious injury. Only at Crown Court TRB Nov 2008
