MĀNOA FACULTY SENATE Completed by Nicole Deville, Senate Research Assistant, on November 12, 2013 Tobacco-Free Campus Policies at Peer and Benchmark Institutions Tobacco-Free Policies at UHM Peer Institutions: Colorado State University—Fort Collins Colorado State University currently does not have a tobacco-free campus policy, and information on its current tobacco-free initiatives can be found here. Mississippi State University—Starkville Mississippi State University’s tobacco-free campus policy went into effect January 1, 2013. The policy prohibits the use of any tobacco products, including e-cigarettes, in university buildings, including parking areas, sidewalks, walkways and university-owned buildings. In its policy, MSU incorporated a period of transition, from January 1, 2013, to August 1, 2013, in which the University will limit the designated tobacco use areas outside university buildings to one location per building. MSU also plans to utilize the transition period to communicate its new policy and expectations to the entire campus. MSU expects that people will voluntarily comply with the policy, and they do not indicate any explicit disciplinary actions that will be taken. Oregon State University—Corvallis Oregon State University’s President’s Office tobacco-free campus policy went into effect on September 1, 2012. The smoke-free policy at OSU is an Oregon state law enforceable by the Department of Public Safety. The policy prohibits the use of any tobacco products on the Corvallis Campus, as well as, other University-owned property within Benton County that is marked with signage indicating a no-smoking environment. Students will be held accountable under the student conduct code, and OSU employees will be held accountable under OSU employment policies. Contractors, vendors, event attendees and other visitors to OSU will be subject to exclusion from campus if in violation of the policy. University of Arizona—Tuscon University of Arizona’s tobacco-free campus policy went into effect August 1, 2013, and prohibits all forms of tobacco on university property, facilities, grounds, parking structures, university-owned vehicles and structures owned or leased by the university. ASU relies primarily on community enforcement to educate individuals about the tobacco-free policy and ask that individuals extinguish the tobacco materials. University of Illinois—Chicago Implementation of the Tobacco-Free Campus Policy at University of Illinois at Chicago occurred on July 1, 2013. The use of all tobacco products is prohibited on all campus grounds and buildings, in all university-owned vehicles, and in private vehicles on campus. The policy notes that complaints should be brought to the attention of the person in charge of the facility or the supervisor of a work area. University of Kentucky—Lexington University of Kentucky’s Tobacco-Free Policy went into effect November 19, 2009. The policy prohibits smoking and use of other tobacco products on all property that is owned, operated, leased, occupied or controlled by the University. Authority for enforcement of the policy is vested with the Provost, or the appropriate executive vice president or vice president, in conjunction with the Associate Vice President for Human Resources or the Dean of Students, or their designee. Violation of the policy may result in corrective action under the Student Code of Conduct, Human Resources Policies and Procedures, or other applicable University Regulations or Policies; visitors that refuse to comply may asked to leave the campus. University of New Mexico—Albuquerque The University of New Mexico’s Tobacco-Free Policy, effective as of August 1, 2009, prohibits smoking and other tobacco use on all University property with the exception of a small number of designated outdoor areas authorized by the University President. The thirteen designated areas are provided to create a positive transition for UNM tobacco users; UNM plans to reduce the number of designated smoking areas within a five-year period. Repeated or serious violations by students and visitors are referred to the Dean of Students for review and action under the Student and Visitor Codes of Conduct, and violations by faculty and staff are referred to the dean, director or department head. However, the USF Health Campus and USF St. Petersburg Campus do have tobacco-free policies that can be found here. University of Utah—Salt Lake City The University of Utah’s Tobacco-Free Campus Policy prohibits smoking and any tobacco use in all campus buildings and outside in areas of the campus where non-smokers cannot avoid exposure to smoke. Complaints or disputes should be referred to the attention of the University employee who has immediate responsibility for the workplace, event, or residence, or to his/her supervisor; if a satisfactory resolution is not reached, the Director of Environmental Health and Safety should be consulted. Tobacco-Free Policies at UHM Benchmark Institutions: University of California—Davis UC Davis’ Smoke and Tobacco-Free Campus Policy goes into effect January 1, 2014. The policy prohibits smoking and use of tobacco products on University-owned or Universityleased property and in University vehicles. Vice chancellors, deans and department heads are responsible for ensuring the policy is communicated to everyone within their areas of responsibility and monitoring and resolving complaints and problems arising in their areas of jurisdiction. University of California—Irvine Effective January 1, 2014, UC Irvine’s Tobacco-Free Campus Policy prohibits smoking and the use of tobacco products anywhere on campus and in any vehicles on the campus or owned, leased or occupied by UC Irvine. Any conflicts resulting from implementation of the policy should be brought to the attention of the appropriate supervisory personnel and, if necessary, referred to the appropriate vice chancellor, dean or director for a disciplinary action decision. University of California—San Diego Effective September 1, 2013, UC San Diego’s Tobacco-Free Campus Policy prohibits smoking, the use of smokeless tobacco products and the use of unregulated nicotine products at all UC San Diego locations. University of Colorado—Boulder As of August 19, 2013, the University of Colorado at Boulder became a tobacco-free campus prohibiting smoking and the use of tobacco products, with the exception of eighteen designated outdoor smoking areas. By December 2013, UC Boulder will evaluate the success of the program in order to evaluate the ongoing necessity of the designated smoking areas. Students in violation of the policy are referred to the appropriate student conduct office and disciplined according to the Student Code of Conduct. Employees are referred to their supervisor or appointing authority for appropriate action, and contractors are referred to their employers for appropriate action. University of Iowa—Iowa City The University of Iowa’s Tobacco-Free Campus Policy went into effect on July 1, 2008, prohibiting smoking and the use of tobacco products on campus. Students, faculty and staff who violate the policy are subject to disciplinary procedures in accordance with University policies. Any individuals smoking on University grounds are also subject to a $50 fine in accordance with Iowa law, and University Police may issue a citation if the individual fails to comply with the policy. University of North Carolina—Chapel Hill Effective May 4, 2011, the University of North Carolina at Chapel Hill became a tobacco-free campus, with its policy prohibiting smoking and the use of tobacco products on its campus. Student who do not comply with the policy are referred to the Dean of Students’ office, and employees in violation are referred to their supervisors for disciplinary action. Furthermore, the Department of Safety has the authority to issue citations to individuals in violation of the policy, resulting in a $25 fine and approximately $143 in court costs.
