The market participant,
(the “Participant”) hereby requests to receive dispatch variance
notification (“DVN”) messages regarding energy market dispatch levels (the “Information”) from
the Alberta Electric System Operator’s (“AESO”) automated dispatch and messaging system
(“ADaMS”) and its dispatch tool (the “Software”). In support of this request the market
participant provides the following information:

The configuration information in the table below pertains specifically to the DVN functionality for
issuing warnings when asset generation levels appear to be moving away from the current
dispatch level (“dispatch variance warnings”). If these types of warnings are not desired, leave
the configuration below unspecified or set the value for ‘Dispatch Variance Detection’ to ‘Off’.

the asset is outside of its dispatch level by the specified
MW Tolerance for the specified time tolerance.
Level Time Tolerance:

Sets the Software to issue an ADaMS message when
the asset is generating above/below its dispatch level
by more than the specified MW Tolerance for a period
longer than the specified Level Time Tolerance (and
the unit is not expected to be ramping).
Ramping Time Tolerance:

Sets the Software to issue an ADaMS message when
the asset is ramping more slowly than expected to a
new dispatch level. If the generation is more than MW
Tolerance above/below the expected level for a period
exceeding Ramping Time Tolerance, a message is
issued.

The configuration information in the table below pertains to the DVN functionality for generating
warning messages when an Advance Dispatch has become effective. If these types of warnings
are not desired then leave this configuration unspecified or set the value for ‘Advance Dispatch
Notification’ to ‘Off’.

Warning messages will be sent when the advance
dispatch is sent at least this many minutes prior to the
effective time. Permitted values are whole numbers
between 1 and 10 where a setting of ‘10 minutes’ would
mean that a warning would be issued at the effective
time of the dispatch ONLY when the advance dispatch
was sent 10 minutes or more prior to the effective time.
A value of ‘1 minute’ would cause a warrning to be
generated for all advance dispatches.
Acknowledgement
The Participant and agent, if applicable, hereby acknowledge and agree that:
a) the Information is being provided for the benefit of the Participant and is being made
available solely for use by the Participant and agent for aid in monitoring the generation level
of an asset relative to its dispatch level and for no other purpose whatsoever;
b) the Information is being provided to the Participant and agent for informational purposes, on
an “as is” and “as available” basis with “all faults” and without any warranties of any kind,
and that any use of the Information whatsoever shall be at the Participant’s and agent’s sole
risk;
c) the Participant and agent are not required to use the Information, and that any use, inability
to use or failure to use the Information shall not alter the obligation of the Participant and
agent to comply with the ISO rules;
d) the AESO does not make, nor shall it be deemed to make any representation, warranty,
guarantee or covenant, express or implied (including, without limitation any implied
warranties of fitness for a particular purpose, warranties as to any results to be obtained
from the use of the Information or derived from such Information, or as to the usefulness,
accuracy, reliability or completeness of the Information or any portion thereof), at law, in
equity, by statute, customs or otherwise (hereinafter referred to collectively as a
“Representation”), in respect of the Information or any portion thereof;
e) to the fullest extent permitted by law, the AESO disclaims any and all Representations,
express or implied, in connection with the Information or any portion thereof;
f)
any failure of the Information or the Software shall not be considered a mitigating factor as
contemplated in the ISO rules; and shall not be considered a basis for the Participant to
otherwise contravene an ISO rule; and
g) the AESO is not liable for, and the Participant and agent agree to defend, indemnify and
hold harmless the AESO from and against any and all claims, damages (including, without
limitation direct, indirect, special, incidental, consequential, punitive or exemplary damages,
any loss of revenue, loss of profit, cost of capital, loss of contract, loss of goodwill, or loss of
use), obligations, losses, liabilities, costs, debts and expenses (including but not limited to
legal fees on a solicitor and his own client basis) howsoever and whensoever caused,
arising from the Participant’s or agent’s use, in any manner whatsoever, of the Information
or any portion thereof, whether arising in contract, negligence or other tort liability or
-4otherwise, whether or not any such damages are foreseeable, and whether or not the
Participant or agent are advised of the possibility of same.
