UCSC ___ CENIC 00-115 AGREEMENT between THE REGENTS OF THE UNIVERSITY OF CALIFORNIA and THE CORPORATION FOR EDUCATION NETWORK INITIATIVES IN CALIFORNIA for STATISTICAL ANALYSIS SERVICES FOR CENIC’S ISP SERVICES PROGRAM This agreement is made between the Regents of the University of California (UC Santa Cruz), hereinafter referred to as “Regents” and Corporation for Education Network Initiatives in California, hereinafter referred to as “CENIC”. The Regents and CENIC mutually agree that UC Santa Cruz shall provide statistical analysis services for CENIC’s ISP Services Program, in accordance with the following terms and conditions: 1. SCOPE OF SERVICE. UC Santa Cruz staff will provide the following: • Calculations of 95th percentile of 15 minute average of Inbound commercial ISP traffic rates to each member ASN over each week aggregated over four ISP connections. • Calculations of 95th percentile of 15 minute average of Outbound commercial ISP traffic rates from each member ASN over each week aggregated over four ISP connections. • The same Inbound and Outbound calculations described above performed over each calendar month. • Web based access to the aggregation of the 15-minute samples that lie under the calculations for the most current week and month data. • Graphical plots accessible on the web of the 15-minute data, showing data rate (Mb/s) on the ordinate with days and time on the abscissa. Note that graphs will be produced and updated on the web at the end of each time interval. This is not a "live data" presentation. • 7/2/16 Page 1 of 3 Live graphs of physical interface statistics at connection points to ISP transit providers, TEANet interfaces, the North-South and to the extent possible, peering points. These graphs are MRTG or RRD accumulations. UCSC ___ CENIC 00-115 2. TERM. The term of this Agreement shall begin July 1, 2001. This Agreement may be terminated by either party with a sixty (60) day notice. 3. PAYMENT. CENIC will pay the Regents (UC Santa Cruz) $8,000, one-time, for equipment. CENIC will pay the Regents (UC Santa Cruz) $600 per month, per ISP connection for the first five connections, or $36,000 per year. CENIC will pay the Regents (UC Santa Cruz) $425 per month for per additional ISP Connection. 4. INVOICING. Regents shall submit quarterly invoices to: CENIC 4665 Lampson Avenue Los Alamitos, CA 90720 CENIC agrees to pay invoices within thirty (30) days of receipt, specifying the Agreement number of the form of payment. 5. Lessee shall not assign any obligation, promise or requirement provided under this Agreement, either in whole or in part, without the prior written approval of Regents. 7. AMENDMENTS TO THIS AGREEMENT. No alteration or variation of the terms of this Agreement shall be valid unless made in writing and signed by both parties hereto, and no oral understanding or agreement not incorporated, herein, shall be binding on any of the parties hereto. This Agreement may be amended, modified or terminated by mutual, written agreement of both parties. 8. ENFORCEMENT. In addition to any or all other remedies provided by law, either party may terminate this Agreement if the other party fails to perform the covenants herein contained at the time and in the manner herein provided.
