§ 5502.42 Civil defense certificate of necessity.
Application for a civil defense certificate of necessity shall be filed at such time, in such
manner, and in such office as may be prescribed by rule adopted pursuant to section
5502.51 of the Revised Code, but no later than the expiration of six months after the
beginning of construction, reconstruction, erection, or installation of the structure or the
acquisition of the equipment. The application shall be in such form as may be prescribed
by that rule and shall contain plans and specifications of the structure or structures,
including all materials incorporated or to be incorporated therein, and a descriptive list of
all equipment acquired or to be acquired. If the certifying authority finds that the facility
or proposed facility is necessary in the interest of civil defense, is designed exclusively as
a civil defense facility, and is suitable and reasonably adequate for the intended purpose,
it shall issue a certificate to that effect. No structure or equipment shall be considered
suitable and adequate unless it is constructed to provide reasonable protection against
modern methods of warfare including nuclear, biological, and chemical warfare in
accordance with any standards of adequacy furnished by the federal emergency
management agency.
