In most cases, copyright belongs to the artist during their lifetime and 70 years after their
death, when it is usually managed by the Artist’s estate or foundation, or a society such as
DACS, or a combination of both.
IN COPYRIGHT
In the event that the work is still in copyright, please supply written confirmation from the copyright
holder as images cannot be released until this has been received.
It is the responsibility of the requester to research and secure copyright permission.
You will be provided with the appropriate image caption and credit line which must be included in
the relevant sections of the publication, or accompany the image online or at the end of a
presentation etc.

IMAGE REQUEST FORM & LICENCE AGREEMENT
All orders require departmental and conservation evaluation prior to order approval. The Trinity
College Dublin Art Collections reserves the right to decline any image or reproduction request.
LICENCE AGREEMENT FOR REPRODUCTION OF IMAGES
The terms “Licensee”, “Purpose”, “Image”, Medium”, “Print-run”. “Term”, “Period of Hire”, “Territory”
“Product” and “Fee” shall have the meanings attributed thereto in the Schedule hereto.
Licence
Upon payment of the Fee by the Licensee and execution of this Licence Agreement by both parties,
The University of Dublin, Trinity College hereby grants a non-exclusive licence to the Licensee to
reproduce and publish the Image STRICTLY so as to:
produce the Product; in the Medium; for the Purpose; in the Territory; during the Term; and in a
number of copies not exceeding the Print-run. Any reproduction or dissemination of the Image which
exceeds these parameters is not authorised by this Licence and shall be actionable at law.
Digital Images supplied either on disk or via email
Digital images ; formatted specifically for the purpose outlined on the application form ; will be
provided on receipt of payment and are only licensed for the specified use and no other.
On expiry of the Term, all copies or records of the Images, made under this licence shall be erased
from the Licencee’s database. It is strictly prohibited to make copies of Trinity College Dublin Art
Collection Images.
Copyright
The Licensee undertakes to refrain from any breach or infringement of copyright in the Image,
including the moral rights of the artist, and shall indemnify the University of Dublin, Trinity College
against any such breach or infringement.
Copyright in the photography of the Image is vested in the University of Dublin, Trinity College, unless
otherwise stated. All reproduction of the Image by the Licensee must include the acknowledgement
“Photograph courtesy of the Board of The University of Dublin, Trinity College, Ireland”, along with the
name and dates of the creator and the title of the work reproduced in the Image, as supplied by the
The University of Dublin, Trinity College. The reproduction and dissemination of unpublished images,
and of images created by artists who are living, or dead less than 70 years, requires the consent of
the copyright holder in addition to the licence of the University of Dublin, Trinity College. Such
consent must be obtained by the Licensee.
The Licensee acknowledges that no rights whatever in the Image (other than as Licensee under the
terms of the agreement), shall accrue to the Licensee by virtue of any use thereof by the Licensee. In
the event that any such rights should be acquired by the Licensee (including, but without prejudice to
the generality of the foregoing, a right in previously unpublished material arising in consequence of S.
34 of the Copyright and Related Rights Act 2000), the Licensee unequivocally assigns the same to the
University of Dublin, Trinity College, and if required, shall execute any further assignment which may
be required by the University of Dublin, Trinity College.
Use of the Image
The Licensee must reproduce the Image faithfully, and may not manipulate, mask out, cut down,
superimpose with other material, or in any way distort or alter the Image, or any part thereof.
Application to reproduce a detail may be considered only upon receipt of a sketch showing the area to
be reproduced. Reproductions of details must be captioned “DETAIL”. All reproductions of the Image
produced by the Licensee shall be of good quality and shall be published in a manner and context
which is not prejudicial to the interests or reputation of either the University of Dublin, Trinity College
or the artist.
The Licensee shall use the Image in a lawful manner and for lawful purposes only, and shall indemnify
the University of Dublin, Trinity College against all claims, damages, loss or expenses arising from any
third party action concerning the use of the Image by the Licensee. The University of Dublin, Trinity
College shall not be liable for any loss or damage suffered by the Licensee in connection with the use
of the Image by the Licensee.
A complete copy of the Product must be made available to the University of Dublin, Trinity College
within one month of production.
Payment
All invoices will be settled in full within 30 days of the invoice date in EURO. Payment must cover the
full sum invoiced plus all bank charges and local taxes. Payment may be made by cheque made out

to ‘Trinity College Dublin No.1 Account’ (drawn only on an Irish bank) or EFT (Electronic Funds
Transfer) details of which will be supplied upon request.
Termination of the Licence
The Licence herein contained shall be immediately revoked, and this agreement terminated by the
University of Dublin, Trinity College in the event of breach of any of the terms herein contained by the
Licensee. Termination shall be without prejudice to any antecedent claim on the part of the University
of Dublin, Trinity College.
Applicable Law
This Licence is governed by the laws of Ireland, whose courts shall have jurisdiction in the event of
any disputes.

manner set out above and accept the terms of the licence agreement as hereby set out.

The licence will be governed by the terms contained in the licence agreement, which may
not be altered in any particular without the written consent of the University. The
University reserves the right to refuse any application for permission to reproduce works in
its Collection at its sole discretion.
