Exemptions Candidates who obtain 40% in each of three or more subjects at any given sitting may be exempted in those subjects. Candidates may carry any exemption obtained in an academic year into the following academic year. Two Year Rule A candidate in First or Second BCL must have passed, or have been awarded compensation in, each examination by the Autumn sitting of the academic year following the year he/she first attended lectures in the prescribed subjects. Progress Candidates must successfully complete First BCL before progressing to Second BCL and Second BCL before progressing to Final BCL. Eligibility for Honours To be eligible for Honours, a candidate shall normally be required to have passed the First or Second BCL or the BCL Degree Examination at the first sitting of each in Summer. Compensation Compensation will be awarded in one subject provided that the candidate: a. does not fall below 35% in that subject; b. has passed four other subjects; c. has excess marks in other subjects, whether taken in the Summer or in the Autumn in that year, equivalent to double the deficiency. Course Work In the First, Second and BCL Degree Examination, a maximum of 30% of the total marks available in any subject may be allotted to course work except that, where the teaching of a subject is equally shared, each examiner may allot a maximum of 20%. HONOURS AT FIRST, SECOND AND BACHELOR OF CIVIL LAW DEGREE EXAMINATIONS First Class: At least 340 marks with a preponderance of marks of 70% and no mark below 50%. Second Class, Grade I: At least 300 marks with either: a. b. Second Class, Grade II: At least 250 marks with either: a. b. a preponderance of marks of 60% or above and no mark below 40%, or at least one mark of 70% or above, one mark of 60% or above and no mark below 50%. a preponderance of marks of 50% or above and not more than one mark below 40%, or at least one mark of 60% or above, one mark of 50% and no mark below 40%. Third Class: At least 225 marks with either: a. b. a preponderance of marks of 45% or above, or at least one mark of 50% or above, one mark of 45% or above, and no mark below 40%. "Preponderance" shall mean a majority of a given grade or above. Distinction: will be awarded where a candidate is assessed at 65% or above in three full subjects, and no subject falls below 60%. For this purpose two half subjects can be combined and regarded as being equivalent to a full subject when marks are aggregated. Distinction will normally be awarded only when all examinations have been passed at the first sitting. Exemptions: Where a student fails one full subject or one or two half subjects exemptions will be awarded in respect of all subjects passed in that examination sitting. The failed subject(s) must be repeated at the next sitting. Part-time students who fail one subject only at the first examination sitting may proceed into the second year carrying that failed subject. A student who fails more than one subject or more than two half subjects will be deemed to have failed all subjects, and must apply to the Faculty of Law for permission to re-sit all subjects at the next examination sitting. Such a candidate shall not be eligible for the award of a distinction. A student who fails to pass all examinations over two sittings cannot be awarded the LL.M. Examinations are held in the Autumn only.
