Outcomes and evidence requirements Outcome 1 Describe patterns of New Zealand land settlement. Evidence requirements 1.1 The description outlines the pattern resulting from the acquisition and alienation of land under Crown Colony government. 1.2 The description outlines the pattern resulting from provincial government land policies up to 1876. 1.3 The description outlines the patterns resulting from land reform policies after the Land Act 1892. Range includes but is not limited to – development of closer settlement policies. Outcome 2 Describe influences of land settlement and legislation on land title. Evidence requirements 2.1 The description outlines the relationship between the closer settlement policies of the 19th century and modern legislation. 2.2 The description outlines the role of the Commissioner of Crown Land in accordance with the Land Act 1948. 2.3 The description outlines the classification and alienation of Crown Land in accordance with the Land Act 1948. 2.4 The description outlines the requirements for Crown Land subdivision and alienation under the Resource Management Act. Evidence requirements 3.1 The outline explains features of the New Zealand parliamentary system in terms of their relation to New Zealand land law. Range 3.2 features – cabinet decisions, advisory committees, drafting of legislation, passage of legislation. The outline identifies land legislation and laws relating to land development and explains their influence on the New Zealand survey and title system. Outcome 4 Identify and describe New Zealand land registration systems with reference to survey practice. Range principle of leasehold, freehold, rights and land tenure, guaranteed titles, limited titles, deeds land, cross leases. Evidence requirements 4.1 The Torrens system of registration of titles is identified in terms of the three principles. Range principles – mirror, curtain, insurance. 4.2 The state guarantee of title system and the roles of the Surveyor-General and the Registrar-General of Lands in relation to it are described in accordance with the Cadastral Survey Act. 4.3 The land registry system and its procedures are identified and described in accordance the Cadastral Survey Act. 4.4 Crown land and Māori land ownership are described in accordance with New Zealand land law. 4.5 Estates in land and title to land are described in accordance with New Zealand land law. Range description includes definitions for – deeds title, limited title, unit title, cross-lease title, leasehold title, fee simple title, composite title; may include – fee simple strata title. Outcome 5 Outline the Cadastral Survey Act and legislation with reference to land titles. Outcome 6 Describe procedures for establishing the status and title of land. Evidence requirements 6.1 The description outlines the process for locating and searching documentary evidence of the status of land in accordance with Landonline procedures. 6.2 The description outlines the process for searching Crown Grants in accordance with Landonline procedures. 6.3 The description outlines the process for searching leases and licences in accordance with Landonline procedures. 6.4 The description outlines the process for title searching in accordance with Landonline procedures. Outcome 7 Describe land ownership. Evidence requirements 7.1 The description identifies and outlines the requirements for Certificates of Title in accordance with the Land Transfer Act. 7.2 The description identifies and outlines the requirements for memorials in accordance with the Land Transfer Act, the Public Works Act, and the Resource Management Act. Range 7.3 memorials – mortgages, easements, proclamations, compensation certificates covenants, gazette notices, consent notices. The description explains land ownership in terms of deeds titles before the Land Transfer Act. Outcome 8 Demonstrate knowledge of statutory taking or acquisition of land for public purposes.
