Purpose
This unit standard is intended for people undertaking compliance related
prosecutions in the road transport industry for the New Zealand Transport
Agency (NZTA).
People credited with this unit standard are able to prepare for conducting,
and conduct, a prosecution of a road transport compliance offence.

Performance of the elements of this unit standard must be in accordance with
legislation including but not limited to:
 Evidence Act 2006
 Summary Proceedings Act 1957
 District Court Rules 1992.
Road transport legislation may include but is not limited to:
 Land Transport Act 1998
 Transport (Vehicle and Driver Registration and Licensing) Act 1986
 Road User Charges Act 1977
 Land Transport Rules (available at www.nzta.govt.nz).
Any legislation or other requirement superseding any of the above will apply for the
purpose of assessment.

Definition
Organisational requirements refer to instructions to staff on policy and procedures
which are documented, available in the workplace, and consistent with applicable
legislation and any other applicable compliance requirements.
Elements and performance criteria
Element 1
Prepare for conducting a prosecution of a road transport compliance offence for the NZTA.
Performance criteria
1.1
Briefs of evidence are reviewed, and clarified with the case officer where
necessary prior to court proceedings, in accordance with District Court Rules
1992 and organisational requirements.
1.2
Relevant precedents are identified in accordance with organisational
requirements.
1.3
Prepared questions for witness or witnesses and defendant or defendants
address the facts of the brief of evidence.
1.4
Prosecution personnel involved are fully briefed in accordance with
organisational requirements.
1.5
Parameters for negotiating out of court are agreed prior to prosecution in
accordance with organisational requirements.

Element 2
Conduct a prosecution of a road transport compliance offence for the NZTA.
Performance criteria
2.1
Evidentiary procedures are followed and prosecution is conducted, in
accordance with District Court Rules 2009.
2.2
Personal presentation is in accordance with organisational requirements.
2.3
The conduct and outcome of the prosecution is reviewed to provide input and/or
recommendations for handling future cases, in accordance with organisational
requirements.

Providers must be accredited by NZQA, or an inter-institutional body with delegated
authority for quality assurance, before they can report credits from assessment against
unit standards or deliver courses of study leading to that assessment.
Industry Training Organisations must be accredited by NZQA before they can register
credits from assessment against unit standards.
Accredited providers and Industry Training Organisations assessing against unit standards
must engage with the moderation system that applies to those standards.
