Explanatory notes 1 Legislation, policies and procedures relevant to this unit standard include: State Sector Act 1988; Customs and Excise Act 1996; Customs and Excise Regulations 1996; The NZ Customs Service Policies and Procedures – Delegations (restricted to NZ Customs); The State Services Code of Conduct, Standards of Integrity and Conduct (available from www.ssc.govt.nz); New Zealand Customs Service Code of Conduct (available from NZ Customs Service, PO Box 2218, Wellington 6140, www.customs.govt.nz). 2 Definitions Delegation refers to the assignment of a power vested in the Chief Executive to a person as determined by the Chief Executive. Delegation holder means a person to whom a power or authority is delegated to. Organisational requirements refer to instructions to staff on policies, procedures, and methodologies which are documented and are available in the workplace. They must be consistent with applicable legislation and any other applicable compliance requirements. 3 Officer or officers include a Customs officer or a group of Customs officers, as per the situation. Evidence requirements 1.1 The power of the Chief Executive to delegate their functions or powers to Customs officer or officers is explained. 1.2 Description includes the reasons for which a delegated authority is made and the criteria used to make a delegation. Range business need, assessment of competence, instrument of delegation, database. 1.3 The issue, re-issue, and revocation of delegations are explained in accordance with organisational requirements. 1.4 Description includes the procedure for delegating the Chief Executive’s functions or powers to Customs officer or officers. Outcome 2 Explain the use of, and principles applying to, Customs officer delegations. Evidence requirements 2.1 Responsibility of the delegation holder and principles for using delegated authority are described. 2.2 Internal controls on delegations are explained in accordance with organisational requirements.
