Memorandum of Understanding (MOU)
An MOU has been established between MITO and SkillsDMC (the Australian
National Industry Skills Council for the Resources and Infrastructure sectors). The
MOU outlines moderation in New Zealand, the granting of consent to assess against
standards to providers in New Zealand and the provision for participation of the New

Performance of the outcomes of this unit standard must comply with the following.

guidelines, or authority requirements or conditions affecting this unit standard will
take precedence for assessment purposes, pending review of this unit standard.
- approved codes of practice issued pursuant to the HSE Act;
- documented workplace health, safety and environmental procedures (where these
exceed the code) for personal, product, workplace health, safety, and
environmental matters;
- obligations required under current law including:
- Health and Safety in Employment (HSE) Act 1992;
- HSE Regulations 1995;
- HSE (Mining Operations and Quarrying Operations) Regulations 2013;
- Resource Management Act 1991;
- Conservation Act 1987;
- Environment Act 1986;
- Hazardous Substances and New Organisms (HSNO) Act 1996;
- HSNO (Personnel Qualifications) Regulations 2001.

Definitions
Codes of Practice refer to any issued code of practice approved by the Minister of
Labour under Section 20 of the HSE Act 1992 and any work carried out in
accordance with that code.
Harm means illness, injury, or both, and includes physical or mental harm caused by
work-related stress.
Hazards refer to those occurrences, processes, substances or situations that are
determined as being an actual or potential cause or source of harm.
Standards refer to any New Zealand or Australian Standards that provide technical
guidance and specifications. Standards may also be specified in regulations.

Providers must be granted consent to assess against standards (accredited) by NZQA,
before they can report credits from assessment against unit standards or deliver courses
of study leading to that assessment.
Industry Training Organisations must be granted consent to assess against standards by
NZQA before they can register credits from assessment against unit standards.
Providers and Industry Training Organisations, which have been granted consent and
which are assessing against unit standards must engage with the moderation system that
applies to those standards.
Requirements for consent to assess and an outline of the moderation system that applies
to this standard are outlined in the Consent and Moderation Requirements (CMR). The
CMR also includes useful information about special requirements for organisations wishing
to develop education and training programmes, such as minimum qualifications for tutors
and assessors, and special resource requirements.
