Administrative Procedure 4400 Community Service Courses

AP 4400

The Colleges may solicit input on Community Service course offerings from various college constituencies, community groups, organizations, and advisory committees.

New or revised Community Service course outlines are presented to the College Curriculum Committee for review and forwarded to the Council on Instruction, Planning, and Development (CIPD) as an informational item.

Community Service classes are published.

The following information was provided in the policy/procedure of July 1997.

A. Establishment and Selection of Community Services Classes and Other Community Services

Activities

All classes and activities will be organized with educational, cultural, recreational, or community services objectives. Additionally, they will be consistent with the mission statements, goals, and objectives of the

Peralta Colleges. The program will:

Encompass several formats, i.e., short-term and regular semester-length community services classes, lectures, workshops, conferences, seminars, performing groups, etc.

Be appropriate to postsecondary education institutions.

Have a broad community appeal or fulfill a specific and significant community educational or service need.

Offer continuing education units as appropriate.

Be supported by participant fees.

Emphasize personal development and enrichment supplementary to the regular college educational program

Provide opportunities for the study of subjects not otherwise offered by the District.

Attempt to appeal to citizens not ordinarily involved in other District programs.

Present cross-disciplinary applications wherever possible.

Not denigrate/advocate a religious philosophy or doctrine.

14. If conducted in cooperation with and at the request of community organizations, groups, or agencies, the primary educational and administrative responsibility for the planning and conduct of the program must be deemed to fall properly within the function and province of the Peralta Colleges.

B. Participant Fees for Community Services Classes and Activities

Fees will be determined on the basis of the direct cost of instruction, supplies/materials, other services and a reasonable percentage to cover staff support, facilities, utilities, publicity, printing of tickets, and other incidentals .

I. STATUTORY REQUIREMENTS

Section 55002(d) of Title 5 establishes the following provisions for community services classes:

A community services class is a class that meets the following minimum requirements:

Is designed for the physical, mental, moral, economic, or civic development of persons enrolled therein.

Provides subject matter content, resource materials, and teaching methods which the district governing board deems appropriate for the enrolled students.

Is open to all members of the community.

May not be claimed for apportionment purposes.

Further, Section 55005 of Title 5 requires that all community colleges make available to students through college publications a listing of community services class offerings.

II. GENERAL INFORMATION

Community services (fee-based) classes are paid for by the students. Fees cover the direct costs of instruction (instructor, supplies, field trips, other class requirements) and indirect administrative costs (e.g., staff support, facility, custodial, heating, etc.). All community services (fee-based) classes carry zero (0) units and are offered outside the regular college credit and non-credit programs. Fee-based classes do IlQ1 generate FTES.

All community services (fee-based) classes/activities to be offered will be reviewed and evaluated by the

College Curriculum Committee. Any proposed permanent community services (fee-based) classes will then be submitted to the Council on Instruction, Planning, and Development (CIPD) for approval. It will be CIPD's responsibility to ensure a balanced and diversified offering for the residents of the district without unnecessary duplication of educational efforts and services.

III. SELECTION OF INSTRUCTORS ANDOTHER PROVIDERS

1. Instructors and other providers selected for classes/activities will have demonstrable and recognizable expertise in their areas of instruction and fields.

2. Community services (fee-based) instructors are not required to meet minimum qualifications in accordance with Education Code Sections 87001, 87002, 87003, 87356, and 87359. Therefore, FSA's

(Faculty Service Areas) do not apply to community services (fee-based) classes and instructors. (Also refer to implementing sections of Title 5, Sections 53400-53430, concerning minimum qualifications for community college faculty and administrators).

3. The selection of instructors for community services (fee-based) classes shall be approved by the College President or his/her designee.

4. The selection of community services providers (workshop leaders, lecturers! speakers, moderators, consultants, performers, etc.) and the determination of fees for services shall follow

District policy and procedures and shall be approved by the College President or his/her designee.

5. The following guidelines shall apply in the selection of instructors, lecturers, etc., and other providers of community services classes/activities: a. Recognized competence relating to the activity. b. c.

Sensitivity to the principles of academic freedom which ensure consideration of a variety of viewpoints on any issue.

Sensitivity to the diversity of the audience.

(I) To ensure broad representation for a variety of viewpoints on important issues.

(2) To present authoritative information and informed opinions on the selected issues, topics, or subjects.

The selection process will reflect the cultural diversity of the community.

FEES TO BE CHARGED

Students will be charged a fee that represents the costs that a minimum of 10 students would have to pay to cover the costs of the community services class/activity. This amount is determined by dividing the direct costs for the class by 10. Minimally, all direct costs will be covered by the number of students enrolled. The instructor/provider will be notified when the enrollment will not support the class/activity. All fees collected will be used to defray the direct and indirect costs of instruction in the community services program.

V. REFUND POLICY FOR FEES

The following guidelines have been established for refunds:

COMPENSATION OF INSTRUCTORS/PROVIDERS

Compensation for community services classes/activities will be negotiated between the instructor/provider and the college. (See Appendix A and B for contract forms to use.)

1. Community Services Activities: All community services providers (workshop leaders, lecturers/speakers, moderators, panel members, consultants, performers, etc.) will be compensated on the basis of professional reputation, potential drawing power, anticipated fee collection, travel requirements, and expenses pertaining to the service. The compensation must be preapproved by the President or his/her designee and approved by the Board of Trustees.

Joint sponsorship between the Peralta Colleges is encouraged for those community services activities that utilize recognized performers, lecturers/speakers, etc., that demand high fees.

2. Community Services Classes: Community services (fee-based) instructors will be compensated on an individual assignment basis (i.e., paid by assignment) approved by the Board of Trustees.

3. Consultants independent contractors providing services to the community services program will be processed according to District policy and procedures established for consultants independent contractors.

Compensation will be negotiated between the consultant independent contractor and the college.

4. Lecturers in community services (fee-based) classes will be compensated on a flat-fee basis, the fee to be negotiated. The number of lectures by any given lecturer will be limited to four during any single term, not to exceed eight in any academic year. The lecturer is not the instructor of the community services class, and any lecture is to be o limited duration during the scheduled class time.

VII. PAYMENT SCHEDULE FOR INSTRUCTORS/PROVIDERS

Community services instructors/providers will be paid as follows:

I. Instructors/providers of community services (fee-based) classes/activities will be paid by time sheet on a monthly basis. The pay period is from the 16th of one month through the 15th of the following month.

The college initiates the payments via time sheet in a timely fashion to ensure that the community services instructor/provider is paid in accordance with the signed contract.

2. Consultants independent contractors providing services to the community services program will be paid according to District policy and procedures established for consultants/independent contractors (via requisition through Accounts Payable).

3. Lecturers in community services (fee-based) classes will be paid a flat fee, via requisition through Accounts Payable.

VIII. REGISTRATION OF STUDENTS

A staff person(s) will be assigned by the Deans of Instruction to process students for enrollment in community services classes/activities. Registration can be in person or by mail (see Appendix E for sample of registration form for community services classes). Any funds collected by the Office of Instruction will be forwarded to the Bursar's/Cashier's Office which will be responsible for recording the payment of all fees.

IX. FISCAL SERVICES

All fees for community services classes/activities will be paid or processed through the Bursar's/Cashier's

Office and this office will be responsible for recording the payment of all fees for students or participants.

Fees will be collected and processed at the college level and forwarded to the District Office, at which point the appropriate, authorized fund budget (Fund 3) will be set up for the college. All costs will be charged to and reflected by this budget.

ASSIGNMENT OR SUBCONTRACTING: The Community Services Instructor may not assign or transfer this

Agreement or any interest therein or claim thereunder, nor subcontract any portion of the work thereunder, without written approval of the Peralta Community College District.

TERMINATION: The District shall have the right in its sole discretion to terminate this Agreement and the individual's temporary employment without cause by giving seven (7) days written notice to the Community

Services Instructor. If, for any cause, the Community Services Instructor fails to fulfill in a timely and/or proper manner his/her obligations under this Agreement, or if the Community Services Instructor violates any of the covenants, agreements, or stipulations of this Agreement, the District shall thereupon have the right to terminate this Agreement by giving written notice to the Community Services Instructor of such termination and specifying the effective date of such termination.

INSURANCE: The District is not obligated, for this temporary part-time assignment for the Community Services

Instructor, to provide insurance coverage for medical or dental benefits, life insurance or long-term disability, nor to contribute to PERS or STRS. The Community Services Instructor, however, will be covered under the District's

Unemployment and Workers' Compensation funds. Also, the District will make contributions to OASDI and

Medicare for wages earned by the Community Services Instructor.

REPORTING: The Community Services Instructor providing services under this Agreement shall report to the executing office of this Agreement following its completion to ascertain that all requirements have been met.

CONFLICT OF INTEREST: The Community Services Instructor affirms that to the best of his/her knowledge, there exists no actual or potential conflict between the Community Services Instructor's business, or financial interests, and his/her services under this Agreement, and in the event of change in either his/her private interests or service under this Agreement, he/she will raise with the Vice President of Instruction any question regarding possible conflict of interest which may arise as a result of such change.

Original BOARD POLLICY 6.65, COMMUNITY SERVICES (FEE-BASED) PROGRAM

The Peralta Board of Trustees recognizes that a comprehensive program of community services is a major purpose of community colleges. In order to achieve this, a balanced program of community services classes and activities supported by participant fees will be offered within the Peralta

Community College District.

The program of community services classes and activities will be adapted to the educational needs, interests, and desires of all segments served by the District and will draw upon the various academic and other resources within the Peralta Colleges and community. Close liaison and cooperation will be maintained with interested students, community groups, and business and industry in the planning, organization, and implementation of the program.

Community Services classes and activities are those instructional and enrichment offerings, not supported by state apportionment, that are designed for the physical, mental, moral, economic, or civic development of persons in attendance. These activities which exist in various formats extend the regular and traditional educational services of the District for broader community and individual benefits.

Within the policies and procedures established by the Board of Trustees, the planning, organization, and implementation of the program is the responsibility of the College President. Community services (beebased) classes and activities will be implemented in accordance with established policies and procedures of the Board of Trustees.

A.

Establishment and Selection of Community Services Classes and Other Community Services

Activities

All classes and activities will be organized with educational, cultural, recreational, or community services objectives. Additionally, they will be consistent with the mission statements, goals, and objectives of the Peralta Colleges. The program will:

Encompass several formats, i.e., short-term and regular semester-length community services classes, lectures, workshops, conferences, seminars, performing groups, etc.

Be appropriate to postsecondary education institutions.

Have a broad community appeal or fulfill a specific and significant community educational or service need.

Offer continuing education units as appropriate.

Be supported by participant fees.

Emphasize personal development and enrichment supplementary to the regular college educational programs.

Provide opportunities for the study of subjects not otherwise offered by the District.

Attempt to appeal to citizens not ordinarily involved in other District programs.

Present cross-disciplinary applications wherever possible.

Not denigrate/advocate a religious philosophy or doctrine.

If conducted in cooperation with and at the request of community organizations, groups, or agencies, the primary educational and administrative responsibility for the planning and conduct of the program must be deemed to fall properly within the function and province of the Peralta Colleges.

B.

Participant Fees for Community Services Classes and Activities

Fees will be determined on the basis of the direct cost of instruction, supplies/materials, other services and a reasonable percentage to cover staff support, facilities, utilities, publicity, printing of tickets, and other incidentals.

Administrative guidelines for implementation of this policy are to be found in the Procedures section of this Manual.
