Definition
A given fact situation refers to a situation giving rise to no more than three legal
issues, where the facts, either hypothetical or actual, are provided in the form of case
studies for assessment purposes.

Assessment
Candidate must demonstrate the ability to determine the facts of each fact situation,
identify the legal issues, and identify and apply the law.

Sale of Goods (United Nations Convention) Act 1994
Land Transfer Act 1952
Personal Property Securities Act 1999
Property Law Act 2007.

Outcome 1
Define property and property rights.
Evidence requirements
1.1
The definition describes the concepts of ownership and possession as they
apply to property.
1.2
The definition describes the differences between real and personal property as
they apply to ownership and transfer.

Outcome 2

Evidence requirements
2.1
The description outlines the land transfer system in New Zealand.
2.2
The description outlines the effect of registration in terms of its indefeasibility.
Outcome 3
Apply the law relating to ownership and transfer of goods.
Evidence requirements
3.1
The law relating to the time at which ownership and risk passes, from a seller to
a buyer, in a contract for the sale of goods is applied to a given fact situation.
3.2
The nemo dat principle and the exceptions to it are applied to a given fact
situation.

Describe the use of property as security.

The description outlines the law as it relates to the use of property as security.

Please note
Providers must be granted consent to assess against standards (accredited) by NZQA,
before they can report credits from assessment against unit standards or deliver courses
of study leading to that assessment.
Industry Training Organisations must be granted consent to assess against standards by
NZQA before they can register credits from assessment against unit standards.
Providers and Industry Training Organisations, which have been granted consent and
which are assessing against unit standards must engage with the moderation system that
applies to those standards.
Requirements for consent to assess and an outline of the moderation system that applies
to this standard are outlined in the Consent and Moderation Requirements (CMR). The
CMR also includes useful information about special requirements for organisations wishing
to develop education and training programmes, such as minimum qualifications for tutors
and assessors, and special resource requirements.
