Criteria for Excellence The description demonstrates insightful understanding of litigation and dispute resolution processes by comparing civil and criminal processes, with reference to specific cases. Explanatory notes 1 Range Participants include – Judge; and may include – witness, registrar, lawyer, prosecutor, plaintiff, defendant, jurors, police, probation officer. 2 Definition Possible outcomes refer to outcomes such as imprisonment, home detention, and fines in criminal law cases; and compensation and injunction in civil cases. 3 For the purposes of this unit standard, it is recognised that the distinction between litigation and dispute resolution processes may vary depending on the legal systems chosen. 4 This unit standard can be awarded with an Achieved, Merit, or Excellence grade. For the Achieved grade to be awarded, all outcomes must be achieved as specified in the outcome statement(s). For Merit or Excellence grades to be awarded, the candidate must meet the Merit or Excellence criteria specified above. Outcomes and evidence requirements Outcome 1 Demonstrate understanding of litigation and dispute resolution processes in New Zealand. Evidence requirements 1.1 Litigation and dispute resolution processes are identified and described in relation to criminal and civil cases in the New Zealand court and tribunal system. New Zealand court system includes – District Court, High Court, Court of Appeal, Supreme Court; and one of – Youth Court, Family Court, Employment Court; tribunal may include but is not limited to one of – Waitangi Tribunal, Tenancy Tribunal, Disputes Tribunal, Human Rights Review Tribunal; litigation and dispute resolution processes include – New Zealand courts and tribunals in terms of their jurisdiction; the key features of roles of four participants across the main courts including the Judge; civil and criminal law in terms of subject matter, burden and standard of proof.
