Classification Social Science Studies > Legal Studies Available grade Achieved, Merit, and Excellence Criteria for Merit The description of foundational concepts demonstrates detailed understanding by including relevant supporting detail such as: particular facts and/or events; particular legislation; case law, media reports. Criteria for Excellence The description demonstrates insightful understanding of the foundational concepts of justice by making links between each concept and its specific example. Explanatory notes 1 Range Specific examples within foundational concepts may include: for the foundational concept of coercive power: the death penalty; contempt of court. for the foundational concept of balancing competing claims: name suppression; law of defamation. for the foundational concept of impartiality: judge and jury system; inadmissibility of evidence of prior convictions. for the foundational concept of equity: judicial discretion at sentencing; relationship property division. 2 This unit standard can be awarded with an Achieved, Merit, or Excellence grade. For the Achieved grade to be awarded, all outcomes must be achieved as specified in the outcome statement(s). For Merit or Excellence grades to be awarded, the candidate must meet the Merit or Excellence criteria specified above. Evidence requirements 1.1 Foundational concepts of justice are described, with supporting detail, in relation to their application. foundational concepts include two of – coercive power, balancing competing claims, impartiality, equity; supporting detail includes – identifying specific examples of real or fictionalised events from New Zealand or overseas, past or present.
