Commissioner of Elementary and Secondary Education COORDINATED PROGRAM REVIEW MID-CYCLE REPORT SE Criterion # 7 - Transfer of parental rights at age of majority and student participation and consent at the age of majority Rating: Implemented Basis for Findings: Review of student records, documents and interviews indicated that one year prior to the student reaching age 18, the district informs the student and the parent/guardian of the rights that will transfer from the parent/guardian to the student upon the student's 18th birthday. The notification provided to both the student and the parent/guardian explicitly states that all rights accorded to parents under special education law will transfer to the 18 year old student. Review of student records also confirmed that upon reaching the age of 18, the school district implements procedures to obtain consent from the student to continue his or her special education program; students are signing their IEPs at the age of majority. SE Criterion # 8 - IEP Team composition and attendance Rating: Implemented Basis for Findings: A review of student records and interviews indicated that members of the Team attend IEP Team meetings unless the district and the parent agree, in writing, that the attendance of the Team member is not necessary because the member´s area of the curriculum or related services is not being modified or discussed. Furthermore, if the district and the parent agree, in writing, to excuse a required Team member´s participation, the excused member provides written input into the development of the IEP to the parent and the IEP Team prior to the meeting. SE Criterion # 18A - IEP development and content Rating: Implemented Basis for Findings: A review of student records and interviews confirmed that whenever the IEP Team evaluation indicates that a student's disability affects social skills development or a student's disability makes him or her vulnerable to bullying, harassment, or teasing, the IEP addresses the skills and proficiencies needed to avoid and respond to bullying, harassment, or teasing. For students identified with a disability on the autism spectrum, the IEP Team considers and specifically addresses the skills and proficiencies needed to avoid and respond to bullying, harassment, or teasing. Department Order of Corrective Action: Develop procedures for ensuring the provision of two copies of the proposed IEP and placement to parents; provide Team chairpersons with training on these procedures. Develop an internal oversight and tracking system for ensuring that two copies of the proposed IEP and placement are provided to the parent. The oversight and tracking system should include periodic reviews by the Special Education Director to ensure ongoing compliance. Develop a report of the results of an internal review of records, in which there has been a Team meeting held since implementation of all of the district's corrective actions, for evidence of compliance with provision of two copies of the proposed IEP and placement to parents. *Please note when conducting internal monitoring the district must maintain the following documentation and make it available to the Department upon request: a) List of the student names and grade levels for the records reviewed; b) Date of the review; c) Name of person(s) who conducted the review, their role(s), and signature(s). Required Elements of Progress Reports: Submit the training information, including the procedures, agenda and sign-in sheet, by October 11, 2013. Submit a description of the internal oversight and tracking system with periodic reviews, along with the name and role of the designated person by October 11, 2013. Submit the results of a review of student records and include the following: 1. The number of records reviewed; 2. The number of records in compliance; 3. For any records not in compliance, determine the root cause; and 4. The specific corrective actions taken to remedy the non-compliance. Submit the above information by January 24, 2014. If a student is removed from the general education setting at any time, the Team adequately describes in the Non-Participation Justification Statement why the removal is considered critical to the student's program and the basis for the Team's conclusion that the student's education in a less restrictive environment, with the use of supplementary aids and services, could not be achieved satisfactorily. The procedures should indicate that if the parent revokes consent, in writing, to a student’s special education services, the district will act promptly to provide written notice to the parent of the district's proposal to discontinue services based on the written revocation of consent and will also provide information on how the parent can obtain a copy of his/her right to procedural safeguards. The notice should be provided a reasonable time before the district intends to discontinue services. Department Order of Corrective Action: Develop procedures regarding the revocation of consent to a student's special education services.
