SE 25 Parental Consent PI Student Records & Interviews The review of student records at the high school indicated when parental consent was required for re-evaluations and the parent failed or refused to participate, the district attempted to secure consent by only sending new consent forms to parents, it did not initiate other methods to obtain consent. Further, school personnel did not consider whether the parent’s refusal or inaction would result in the denial of a free appropriate public education (FAPE) to the student, after such consideration, whether the district should proceed to seek resolution of the matter through the Bureau of Special Education Appeals (BSEA) per the state regulatory requirements under 603 CMR 28.08. The district must develop procedures at the high school that ensure key personnel document attempts to secure parent consent and the methods used to obtain consent ( for example: by letter, telephone call, email, etc).
