Basis for Status Decision:
The district stated that it has already corrected the non-compliance, but the CAP must
describe the specific activities taken to inform staff of the new procedures and to ensure
that compliance is monitored.
Department Order of Corrective Action:
The district must inform all appropriate staff that it is required to send parents/guardians
two (2) copies of the proposed IEP and placement, along with the required notice (N1)
following the development of the IEP, and to monitor the action to ensure continued
compliance.
Required Elements of Progress Report(s):
Submit evidence (meeting agenda, sign-in sheet, any materials used) that appropriate
staff was informed of the requirement to send two (2) copies of the IEP and placement to
parents/guardians following the development of the IEP, by November 25, 2013.
Submit a description of the monitoring process the district will use to ensure continued
compliance and the name and position of the staff responsible, by November 25, 2013.
Submit a report of the results of an administrative review of IEPs developed since
corrective action to determine if the district is sending two (2) proposed IEPs and
placement forms, along with the required notice (N1), to parents/guardians immediately
after the development of the IEP, and include the number of records reviewed, the
number in compliance, the root cause of any non-compliance and the corrective actions
the district will take to remedy any non-compliance, by March 31, 2014.

The district must develop a comprehensive strategy to create a PAC, since past efforts
have not been successful.
Department Order of Corrective Action:
Conduct a survey of all parents/guardians of children with special needs to gather
information, including what issues are most important to them, what is their interest in
forming a PAC, if a PAC were formed what are some of the things it would want to see it
do, what are potential barriers to participation in a PAC, what is their interest in forming a
joint PAC with other local districts. Analyze the results and develop a strategy to establish
a PAC, or seek a waiver from the Department.
Required Elements of Progress Report(s):
Submit the agenda, sign-in sheets, minutes and materials used to publicize the
September 24, 2013, PAC meeting, and include a list of newly elected officers and a
future meeting schedule, if any, by November 25, 2013.
Submit the results of the parent survey, with an analysis and a recommendation for how
the district will move forward to establish a district PAC, if not currently established, or
seek a waiver from the Department, by March 31, 2014.

student is "substantially likely" to injure him/herself or others; nor do the procedures
address when the behavior is a manifestation of the disability that the student will return
