StalkingdoesnothavetobesexualinnaturetoconsMtutesexualviolence. 18 FormsofSexualViolence- DaMng/InMmatePartner/DomesMcViolence • DaMng/IP/DomesMcviolenceisapaXernofcoercive behaviorthatcanincludephysical,psychological,sexual, economicandemoMonalabuse. • ItcanconsistofacMonsorthreatsofacMonsthat inMmidate,humiliate,isolate,frighten,coerce,threaten, blameorhurtsomeone. • Itcanalsoconsistofasingleincidentofsexualassault. • Rapeoranysexualoffense,whetheronadateornot,orby someoneyouknowordonotknow,isthesamecriminal offense. • Between80and90percentofallpeoplewhohavebeen rapedknowtheirperpetrator(s). • Oncollegecampuses,alcoholisoqeninvolvedindaterape. 19 CUNY’sPoliciesAndProcedures AgainstSexualMisconduct Reportallincidentsofsexualharassment/gender-based harassment/sexualviolencetoyourTitleIXCoordinator, DirectorofPublicSafety,or ChiefStudentAffairsOfficer(forstudents)orDirectorof HumanResources(foremployees) 20 SexualHarassmentIsProhibited OnOurCampus • TitleIXoftheEducaMonAmendmentsof1972isafederallaw thatprohibitssexdiscriminaMononcollegecampuses.Itstates: – “NopersonintheUnitedStatesshall,onthebasisofsex,be excludedfromparMcipaMonin,bedeniedthebenefitsof,or besubjectedtodiscriminaMonunderanyeducaMonprogram oracMvityreceivingFederalFinancialAssistance.” • Sexualharassment,inalltheformsjustdiscussed,isakind ofsexdiscriminaMon. • CUNY’spoliciesandproceduresrelaMngtosexual misconductalsocovertherequirementsofthe ReauthorizaMonoftheViolenceAgainstWomenActand NewYorkState’sCampusSafetyActandEnoughIsEnough legislaMon. 21 SexualHarassmentIsProhibited OnOurCampus TitleIXappliesregardlessofwheretheincident occurred if a CUNY student or employee is involved. 22 CUNY’sPolicies • PolicyonSexualMisconduct – TitleIXProtocol • PolicyonDomesMcViolenceandtheWorkplace RelatedPolicies • PolicyonEqualOpportunityand NondiscriminaMon • PolicyonWorkplaceViolence 23 POLICYONSEXUALMISCONDUCT • “EverymemberoftheCUNYcommunity, includingstudents,employeesandvisitors, deservestheopportunitytolive,learnandwork freefromsexualharassment,gender-based harassmentandsexualviolence.” • TheUniversityhasprofessionalsandlaw enforcementofficerswhoaretrainedtoassist studentvicMmsinobtaininghelp,including immediatemedicalcare,counselingandother essenMalservices,aswellasreporMngtolaw enforcement. 24 POLICYONSEXUALMISCONDUCT Student-EmployeeRelaWonships Facultymembersandotheremployeesare prohibitedfromengaginginconsensualinMmate relaMonshipswithstudentsforwhomtheyhave aprofessionalresponsibility.Forexample: • anathleMccoachmaynotengageinan inMmaterelaMonshipwithastudentonhis/ herteam. • AprofessormaynotengageinaninMmate relaMonshipwithastudentinhis/hercourse. 25 POLICYONSEXUALMISCONDUCT • Supervisorsarestronglydiscouragedfrom engaginginconsensualinMmaterelaMonships withnon-studentemployeestheysupervise. • Supervisorsarerequiredtoreportanysuch relaMonshipstotheirsupervisors. 26 PolicyOnDomesMcViolenceandtheWorkplace • DomesMcviolencecanspilloverintothe workplace,compromisingthesafetyofboth vicMmsandco-workersandresultinlost producMvity,increasedhealthcarecosts, increasedabsenteesim,andincreasedemployee turnover. • CUNYiscommiXedto – fullcompliancewithallapplicablelawsgoverning domesMcviolenceintheworkplace – promoMngthehealthandsafetyofallitsemployees – parMcipaMnginthefighttoenddomesMcviolence 27 PolicyOnDomesMcViolenceandtheWorkplace • • • • • • CUNYdoesnotdiscriminateagainstvicMmsofdomesMcviolence. • Wheneverpossible,theinvesMgaMonis completedin60calendardays.Ifitisnot possibletocompletetheinvesMgaMoninthat Mme,bothparMesarenoMfiedofthestatus. 39 HowArePenalMesImposed? • Whenitisdeterminedthatastudentor employeeengagedinsexualmisconduct,the Collegewilltakeallnecessarystepstopursue disciplineinaccordancewiththeapplicable proceduresinCUNY’sBylawsandinits employmentcontracts. • Therearedifferentprocessesforstudents, staffandfacultymembers. 40 StudentDiscipline • TheCollegeisrequiredtofollowtheproceduresinArMcleXVof CUNY’sBylawsbeforediscipliningastudent. • If,aqerinvesMgaMon,itisdeterminedthatastudentengagedin sexualharassment,gender-basedharassmentand/orsexual violence,disciplinarychargeswillbebroughtbytheCollege. • Ifdisciplinarychargesarebrought,andtheaccusedstudent conteststhechargesortherequestedpenalty,ahearingwillbe heldbeforetheFaculty-StudentDisciplinaryCommiXee. – Eachschoolwillhaveaspecialdisciplinarypaneldesignatedforsexual violencecases. – Themembersofthatpanelwillreceivespecialtraining. • Incertaincircumstance,anemergencysuspensionmaybe imposed. – Inthesecases,thedisciplinaryhearingmusttakeplacewithin10 businessdays. 41 HowDoesTheStudent DisciplinaryHearingWork?
