19.8 Adoption & Pricing of Instructional Materials Including

Classroom and Supplemental Texts Authored by UNT

Policy Statement . The University of North Texas permits the use of instructional materials including classroom texts and supplemental texts authored by faculty or staff members, whenever such texts enhance the educational experience of students. The following policy is intended to safeguard the interests of students as well as faculty or staff in the use of such materials, and to insure uniformity of practice across the university.

Procedures and Responsibilities .

In accordance with the Conflict of Interest Policy ( #4.0.5

), UNT Policy Manual, Vol. II), faculty and staff members utilizing their own intellectual property in courses or programs will not agree to nor accept royalty distribution from the sale of the intellectual property to UNT students in classes or programs taught or otherwise offered by the faculty or staff member unless such intellectual property is currently sold at comparable prices to and utilized by students in classrooms or programs at other institutions of higher education This paragraph does not apply to the use of electronically distributed materials. Royalties for such materials are covered by the Distributed Learning Policy (UNT Policy Manual, Vol. III, # 16.1.1

and #16.1.2

).

In situations where the department has produced or owns copyright in intellectual property such as lab manuals and course packets, the royalty assigned to the department from the sale of instructional materials to UNT students shall not exceed 15% of the total price of the instructional materials, except as authorized by the Provost and the Vice President for

Academic Affairs. Faculty and staff are responsible for adhering to copyright laws.

Supplemental texts and materials such as lab manuals and course packets should be priced so that the cost to students is not more than the cost of comparable materials sold in the open market. In order to minimize the price to the student and in accord with university policy #6.2

(UNT Policy Manual, Vol. II), "Departments must direct all requests for printing and copying to

Printing Services and Copy Centers. Estimated printing orders in excess of $500.00 may be bid to capable printers upon request of the customer department."

Any contract for the production and sale of instructional materials that commits the university or an individual department to specific sales targets within a specific period of time, or to the purchase of unsold texts, must be signed by the department chair, the appropriate dean, and the Provost and Vice President for Academic Affairs, before being submitted to the Office of the

Vice Chancellor and General Counsel for review.

This policy does not apply to any currently effective contract between a faculty member and a publisher entered into before the policy went into effect. However, contract renewals or extensions must comply with this policy. This policy also does not apply to a currently effective contract between a department and a publisher entered into before the policy went into effect so long as the contracts mentioned above have been reviewed in accordance with the

Contracts and Agreements policy #10.4

(UNT Policy Manual, Vol. II) by the Office of the Vice

Chancellor and General Counsel and approved by the Vice President for Finance and Business

Affairs. All renewals or extensions must comply with this policy.
