GENERAL TERMS AND CONDITIONS
1.0
The rates should be quoted separately for each item, stating the specific brand
/make/model/cat. No. etc., with relevant taxes. The bidder must quote for the
equipment in accordance with the specifications mentioned in the tender
document, which is forming a part of the contract.

The bidders nevertheless may submit the offer for similar equipment/instrument
under the head “Option” and quote separately for such similar
equipment/instruments. The price may also be quoted in foreign currency i.e.
Dollar/Pound by authorized representative of imported equipment/instrument or
equivalent to Indian Rupees. The price should be on “FOR Nagpur” including
insurance change basis.
2.0
The rates should be inclusive of all taxes for destination at the institute and should
be quoted in the following format.

Please provide us prices at concessional rate for all the models as you have been
giving to other institutions. This we request you in view of limited availability of
funds from the University.
2.9.
A letter from original manufacturer that price quoted by Executive Distributor/

2.10. The total price for each item as mentioned in 2.7 above should be quoted in Bill
of Material.
3.0
The purchaser being an educational institute, the concession applicable in rates/
taxes under state/Central Government Notification should be considered, while
quoting. The Institution can issue C&D From/Certificates, which may please be
noted. Institution can, however, issue a certificate that the equipment being
procured would be used exclusively for Teaching/research purposes.

4.0
Conditional tender shall not be accepted.
In case of the authorized dealers quoting on behalf of manufacture, a
copy of certificates stating that the equipment is being quoted by the party is on
behalf of the concerned manufacturer and manufacturer undertake the
responsibility to provide the after sales and maintenance services for the
equipment.
5.0
The supplier should clearly state the delivery period and time period required
for installation and commissioning of the equipment, from the date of receipt
of firm order. But it should be 12 weeks from the date of opening of the LC
(14 weeks from the date of the purchase order for Indian suppliers). In case, if
supplier anticipates delay in delivery of any item due to the reasons beyond
his control, the supplier shall apply for suitable extension stating the reasons
for the same and state his firm date of delivery. The purchaser, if feels
suitable may extend the delivery date or reject the request.
In case of delay of delivery of the equipment beyond the stipulated period, a
penalty of 5.0% (five) percent of the total value of the ordered equipment will be
levied for each week of delay or part thereof. The maximum penalty however
shall not exceed 25 % of the ordered value.

The supplier or the Indian representative should install the system and bring it to
complete operation, in Department of Electronics & Computer Science,
Rashtrasant Tukadoji Maharaj Nagpur University, University Campus, Amravati
Road, Nagpur-440 033 (M.S.), India, at a location of the purchaser’s choice and to
satisfaction, without any charge.
8.0
The supplier or the Indian representative should give performance guarantee/
warranty for (i) the complete system for one year from the date of the completion
of the satisfactory installation and commissioning (ii) list of critical and noncritical spares (iii) and service back up including commitment for the availability
of the spares, of the system for a period of minimum 10 years from the date of
installation. Also in case of equipment going out of the production at least two
years advance notice should be given to enable, one time procurement of the
spares.
9.0
The supplier shall arrange for repair/replace the defective/worn out components,
of the equipment at our place during the guarantee period at purchaser’s first
instruction within 30 (Thirty) days. This will be carried out at the cost of supplier
and no charges whatsoever will be paid including the T.A. and D.A. of the service
engineer for the same.
10.0
In the event of material supplied are not being in accordance to the specifications
of items ordered, the supplier will at his cost and risk, arrange to replace the same
without any claims whatsoever for the same.

11.0
The tender, as quoted once shall be considered final. No change, alteration and
modification
shall be permitted at a later stage. Incomplete tenders will be
rejected without assigning reason thereof.
12.0
The supplier shall provide user’s list and the certificates of satisfactory
operation of the equipment from at least five organizations to which the
similar equipment has been supplied during past three years.
13.0
The validity of the tender may be kept open for a minimum period of 180 days
after the receipt of the quotation.
14.0
The earnest money: The tender copy duly filed must accompany a crossed
Demand Draft of 35,000/- or 5% of the total cost of equipment(s))in favour of
Head, Department of Electronics & Computer Science, Rashtrasant Tukadoji
Maharaj Nagpur University, University Campus, Amravati Road, Nagpur-440
033 (M.S.), India, payable at Nagpur.
However, following categories are exempted from payment of E.M.D:(i) Factories located in Maharashtra State quoting the items registered with
D.G.S & D.
(ii)
Government and Semi Government Undertaking.
(iii) S.S.I. Unit registered with Director of Industries, (Maharashtra State only) for
the items quoted and manufactured by them with valid registration.
(iv) S.S.I. Unit registered with N.S.I.C Small Service Institute (Government of
India) for the items manufactured by them, irrespective of location manufacturing
unit.
(v) Suppliers registered with C.S.P.O (Maharashtra State only) for the items
mentioned in certificate (relevant copy of the valid certificate to be attached with
the tender).
This money shall be refunded to the unsuccessful dealer/bidder, within 30
days from the date of the opening of the tenders. No interest shall be paid on
earnest money deposited. In case of successful dealer the EMD shall be refunded
after the official order & successful installation at Department of Electronics &
Computer Science, Rashtrasant Tukadoji Maharaj Nagpur University, University
Campus, Amravati Road, Nagpur- 440 033 (M.S.), India, any offer received
without the EMD shall stand wholly rejected. Nevertheless, Head’s decision on
such matters shall remain final and binding.
15.0
The Supplier shall provide both technical/on site demonstration/service manual
and operation/installation manual along with the dust cover for the equipment free
of cost.

16.0
Payment:
i) Advance payment will not be made.
ii) Payment through L/C for overseas Dealer, & inland L/C for Indian dealer.
17.0
The supplier will be required to get instrument serviced twice in a year for its
satisfactory operation during the guarantee period of 12 months. The supplier will
do necessary calibration of the instrument as and when required. No separate rates
are acceptable within guarantee period for the calibration.
18.0 The Head, Department of Electronics & Computer Science, Rashtrasant Tukadoji
Maharaj Nagpur University, Nagpur reserves the right to reject lowest of any
tender, and to increase or decrease the quantity of or split of the items of the
tender at any time while finalization of the award.
19.0
The Head, Department of Electronics & Computer Science, Rashtrasant Tukadoji
Maharaj Nagpur University, Nagpur – 440 033 reserves the right to reject any or
all of the tenders without assigning any reasons thereof.
20.0
In case of any dispute the Jurisdiction shall be NAGPUR only.
21.0
The tender for equipments must be sent in sealed envelope with the superscription
“Tender for ____________ for Department of Electronics & Computer Science”
and addressed to Head, Department of Electronics & Computer Science,
Rashtrasant Tukadoji Maharaj Nagpur University, University Campus, Amravati
Road, Nagpur- 440 033 (M.S.), India.
22.0
Tenders received late shall not be accepted. All tenders shall be opened in
presence of the bidders, if present, in the office of Head, Department of
Electronics & Computer Science, Rashtrasant Tukadoji Maharaj Nagpur
University, University Campus, Amravati Road, Nagpur- 440 033 (M.S.), India in
accordance with the date & time specified in the tender notice.
23.0
Additional information as per Appendix – I & II should be provided along with
the tender.
24.0
Any special discount for educational/research Institution should be specified.
25.0
The manufacturers printed leaflet, technical literature of specification of every
item quoted should be accompanied with the quotation.
26.0
Pre-installation requirement such as power requirement (Single Phase or three
phase Power Load) Cooling water supply, air compressor, air condition machine,
dehumidifier, stabilizer, UPS, if any should be given and specified.

27.0
A performance guarantee of the instrument/equipment is to be given with validity
for 12 months or more from the date of installation.
28.0
No correspondence queries or reminders or personal visits regarding quotation
position or ordering action will be entertained or replied. Orders when finalized
will be intimated to the parties concerned ONLY.
29.0
Agents / Distributors should submit Agency Certificate of Current date / year.
30.0
In case of proprietary item, if any, a valid Certificate of “Proprietary sole
manufacturing/items be enclosed with the tender offer.”
30.0
Security Deposit: An amount equal to 10% of the ordered value bill be deducted
from the bill payable and be retained towards Performance Guarantee till the
guarantee period of 12 months is over. On satisfactory completion of the
guarantee period, this amount will be returned to the supplier.
NOTE: (i) The tender may be accompanied with an undertaking from the party/
supplier that the terms and conditions of the tender are acceptable and
binding on the party/supplier.
(ii)
Please return this

(iii)
The goods must be dispatched on CIF Nagpur basis ONLY.
