WHEREAS it is expedient to provide the procedure for
the Election of Six
Heads of the department in colleges on Board of Studies,
the
Senate is hereby
pleased to make the following Statule :_
I.
The Statute may be cailed,

This Statute shali come into force with effect from the date of Chanceilor,s

In this statute, unless the context other wise requires :(i) 'Head of the Department' means a teacher including principal, who is
principaily responsible for instruction, training arrd reseaich in

subject; designated by the principal / Dean/Dire"ctor

The Vice Chanceilor, on hearing the concerned parties (if they so desire
to be heard in person) or their duly authorized Agent, and after making
such enquiry as he may consider proper and necessary shall decide the
Appeal. The ruling so given by the Vice Chancellor shall be
communicated to the appellant within 10 days from the date of receipt
of the same under his signature. Such a ruling shall be final and
binding.
(d)
The Registrar shall then publish and display "Final Electoral Rolls"
corresponding to individual Board of Studies on the notice board in tJle
University main office and send the copy of the same to
Principal/Dean/Director of the colleges for their display. The Registrar
shall make the copies available to the seeker at an appropriate cost.
B.
Six heads of the departments of Colleges, including Principal/Dean/Director
as the case may be, having not less than Ten Years teaching experience shall
be elected by the "Final Electoral College" comprising of Heads of the
Departments, as constituted in the aforesaid ma-nner and in accordance with
the notified "Programme of Election."
9.
Upon the promulgation of this Statute, Direction No. 4 of 2005, shall stand
repealed.
STATEMENT OF OBJECTS & REASONS
The Maharashtra Universities Act, 1994 provides for Election of Six Heads of
the Departments in Colleges on Boards of Studies as prescribed by the Statute.
This was so far provided for by the Direction No. 4 of 2005. However, the matter
needs to be governed by the Statute, hence this Statute.

WHEREAS vide amendment No. 35 tl:e section 42 of the principal Act
has been substituted and according to the new provisions under section 42,

1st September and shall be of 5 years from the said date and the process of
election and nomination shall commence 3 monttrs before the date on which
actual vacancy occurs and shall be completed not later than 30ft November in
that year,

obsolete as a result of the amended provisions of the Act necessitating an
urgent revision sc as to be in consonance with the Matrarashtra Universities
Act, 1994 as amended by Maharashtra Ordinance No. IX of 2000,

authority or body of the University shall be held by ballot in accordance with
the sy"iem of proportional representation by means of the single transferable
vote and other details relating to the election not specified in the Act shall be
as prescribed by the Statutes,

Vote,'in terms of the Section 47 of the Act, shall be held, either in a duly
convened meeting of the concerned authority or otherwise held, but not during

Provided firstly, that he/she shall have minimum 3 years
experience as Head of Department.
Provided secondly, that he/she shall possess Ph.D. degree.
Provided thirdly, that helshe shall have worked for at least 5 times
as Chairman/ Paper Setter/Moderator/ Exarn. Co.ordinator at
University level appointed by University.

It is notified for informatiofl of all concemed that in view of
amendment to the provisions of the Maharashtra Universities Act, 1994, the
University has issued Direction No. 9 of 2010 read with Direction Nos. 94 to 9K
of 2010 incorporating the qualification and eligibility norms introduced by the
State of Maharashtra in terms of Notifrcation dated l4th September, 2009. Statute
No. 15 of 2010 to Statute No. 42 of 2010 and other relevant Statutes dealing with
the said eiections would thus be operative to thc extcnt to which they are
consistent with the provision of the Act. Therelbre it is notified that:

The qualifications, eligibility norms as well as the mode of reservation for
conduct of the elections rvould be governed by the provisions of Direction
No. 9 of 2010 read with Directions Nos. 9A to 9K of 2010.
(b)
The provisions of statute No. 15 of 2010 to Statute No. 42 of 2010 and
other relevant Statutes would be operative to the extent of the procedure for
conduct of elections stipulated therein.
