“The Council considered the opinion of Standing Legal Council and approved the provisions of
Ordiance in practices”.

The Council considered the opinion of Standing Legal Council which is in consonance with the
spirit and provisions of the said Ordinance and as per the decision of last Academic Council.
Further, the Council also instructed to execute the decision immediately and inform to all those
concerned students and include these corrections in the said Ordinance by suitable amendment as
soon as possible to achieve more clarity.

On the issue of modified list of Academic Council Members and particularly
the deletion of certain names of Chairmans representing Medicine & Ayurvedic
Medicine Faculty and the representation given from time to time by Dr. Vedprakash
Mishra before the conduct of this Academic Council Meeting through vide letter
dated 13.3.2010,16.3.2010 & 18.3.2010 and subsequently followed by letter of call
attention motions submitted dated 18.3.2010 of which the earlier letters were replied
by the university and the remaining call attention motion unreplied. Dr. Mishra raised
a point of order and said that he was required to raise the point of order with a very
specific reference on the consideration of his letter of call attention motion and
therefore has the right to speak in terms of governing Statute.
Dr. Vedprakash Mishra said that he has a copy of the order of the Hon’ble
High Court with him in which Rashtrasant Tukadoji Maharaj Nagpur University is
listed as 4th Respondent and questioned about above the contour of it? He further
informed that the Hon’ble High Court judgement has categorically ruled at Para 44
and 45. The court order is loud and clear. The Vice-Chancellor also knows this fact
that Section 42 and 43 is not attracted. Vacancy is declared if notification is issued.
The University administration is conspiring calculated conspiracy. Seven times
opinion were changed. He further said that in terms of the vacancies that have been
declared by the University with reference to membership of members continued by
the Maharashtra Govt. circulars from time to time beginning from 1998 including the
last circular dated 25th August 2009 it is clarified that Section 42 and 43 in the context
of Section 94 of MUHS are not applicable. A document in the handwriting of the
Standing Counsel of the University categorically states that in terms of the contents of
judgement that Section 42 and 43 are not attracted. But in spite of this, vacancies
have been notified and Vice-Chancellor has tried to mislead to fool them up under
section 42 & 43. On his request documents were given, 27 pages list is there and 4
pages are still not given. He moved a call attention motion which was rejected. He
would challenge the same. He asked as to whether Vice-Chancellor was aware that
Section 43 was not applicable. If not applicable then how vacancies were declared
and vacancies were filled. How Section 43 was used when the Court order was there?
During transitory period Section 42 and 43 were not applicable. Four Deans made a
Petition under Section 108 of the Hon’ble Chancellor. The Vice-Chancellor has also
sent his opinion. Till today Dr. Taywade and others has not received any decision.
The matter which is pending with the Hon’ble Chancellor under section 108, the
Vice-Chancellor has modified the list of Academic Council before receiving the
decision of the Chancellor. No decision has been received still notification is issued.
The Vice-Chancellor is not above the Hon’ble Chancellor. Let the President of India
know that this administrative propriety of Vice-Chancellor which has committed
against the Hon’ble Chancellor. The Vice-Chancellor should not do the things which
will deteriorate the prestige of the University. He thanked for opportunity given to
him to speak.
On this representation of facts, the Chairman said that he knows that Section
42 and 43 is not applicable. Dr. Mishra asked then, how notification was issued?
How the vacancies were filled? He requested to give him the remaining 4 more
pages along with the modified notification. Since, the call attention motion was
not intertained nor replied and the fact that Section 42 and 43 is not applicable
and hence he has moved call attention motion requesting for the appropriate
ruling to be given.
Dr. Mishra further said that he was of the considered opinion that the ViceChancellor, who is ex-officio chairman, knowing fully well that Section 42 and 43 are
not applicable, knowing fully well that High Court order is there, knowing fully well
that the matter is pending with the Hon’ble Chancellor on whatever advise has
twinkled with the situation has committed a wrong which is demonstrable and has
evidence. He wanted to know whether this will be corrected by him or not.
Insubordination should not take place; due to order
issued yesterday insubordination will take place. In spite of the fact that
Section 42 and 43 are barred from applicability has committed a breach of trust. This
is the point of order.
The Pro-Vice-Chancellor said that Dr. Mishra has raised point of order and
requested the Hon’ble Vice-Chancellor to give his ruling.
The Chairman said that he would verify the matter whether this is because of
the rivalry going on in this University and or is the outcome of misguidance to be
verified.
Dr. Mishra said that time period be fixed. Injustice has done on Hon’ble
Chancellor. He has proved and he raised the issue. He also read the second para of
the letter which he had received with reference to Dr. Jumle, Dean, Faculty of
Ayurvedic Medicine.
The Chairman ruled and said that the letter is in abeyance.
Dr. Mishra asked what is mentioned in Notification of 2006? All five letters
be kept in abeyance. All the letters are inter-related.
Dr. Taori said that the decision be given in four days.
Dr. Mishra asked which letter be kept in abeyance.
The Pro-Vice-Chancellor requested the Vice-Chancellor to adjourn the
meeting. Under such situation meeting cannot be held.
Dr. Mishra said that the Chairman is talking of core issue; he was not talking of
collateral issue.
At this stage the Pro-Vice-Chancellor walked out.
The Chairman said that the letter in reference to Jumle is kept in abeyance.
He would verify in four days. He will take legal opinion.
Dr. Mishra asked till then what will be the position?
At this stage the Chairman adjourned the meeting at 1.22 p.m.
The Chairman restarted the meeting at 1.45 p.m.
Dr. Mishra said that the House should continue. Discussion be held on the basis
of the papers. Date be given to him for hearing. Opportunity be given to him as
Dean of Medicine Faculty to put his say in writing on whatever wrong is committed.
He further said that assurance be given that the chairman would not decide the matter
within four days without giving him opportunity. The letter with reference to Dr.
Jumle is kept in abeyance. He should be given hearing for substantiating his say.
The Chairman said that if an injustice has been done the opportunity should be
given, it is procedure of natural justice and therefore hearing should be given to him
on the next date i.e. on 19th March as he would be out of country for next three days
thereafter. The Chairman said that, he would take opinion of the legal expert in four
days or more time be given. Dr. Mishra said he will be in Nagpur on next date and
after that he would be out of Nagpur or can go and come back to Nagpur after
accomplishing his previous occupancies if any. The Chairman said that Dr. Mishra
can submit his say on the same day i.e. on 18th March. Dr. Mishra said that he has
given call attention motion. The reply is illegal. Official time be given on next date.
Dr. Mishra said that if the Vice-Chancellor would not be there then he can submit
his say to the Pro-Vice-Chancellor on behalf of the Vice-Chancellor.
The Chairman said that Dr. Mishra can left Nagpur and after return the matter can
be taken up.
Dr. Mishra said to give ruling.
The Pro-Vice-Chancellor said that the Chairman is not giving his ruling. He
would leave the House. He requested the Vice-Chancellor to adjourn the meeting
sine die.
The Chairman informed that he would give his ruling.
The Pro-Vice-Chancellor asked whether he prompted anything to the ViceChancellor.
The Chairman said that he is competent to take decision. Till he is not convinced
he will not take decision. The matter is High Court matter. He would verify the
matter at the earliest. The notice of Dr. Jumle is kept in abeyance. This is his ruling.
Dr. D.K. Agarwal said that in ruling the matter of only keeping the notice of
Dr. Jumle in abeyance is mentioned; four days time is not mentioned.
The Chairman said that it will be done in four days.

PROPOSAL OF DR. K. C. DESHMUKH
ITEM NO. :126:
The Council considered the following proposal of Dr. K. C.
Deshmukh accepted by the Faculty in its meeting held 20th November, 2009.
(1) Our university does not pay the Remuneration of the External Paper
Setters, External Examiner, for paper setting and checking the Ph. D. thesis
and viva-voce.
Due to this problem the external paper setters and examiner have not
come to our university for paper setting, checking the Ph. D. thesis. and vivavoce
While considering the above resolution Hon’ble Vice-Chancellor
and Hon’ble Pro Vice-Chancellor has given direction to the concerned
department that the T.A./D.A. of Teachers should be paid immeditely on
the same day otherwise responsibility will be fixed on concerned
departmen. The resolution was approved and referred to the Management
Council & the minutes were confirmed in the meeting only.

ITEM NO. : 127:
The Council considered and approved the recommendation of Board
of Studies in Law in its meeting held on 14.09.2009 & accepted by the Faculty
of Law in its meeting dated 23.11.2009 regarding the subject of Computer
which is prescribed for 5th Semester of 5 years Law course and 1 st Semester of
3 years Law course. The paper will carry 50 marks maximum and practical of
the said subject shall carry 50 marks maximum. Minimum 20 marks in each
(i.e. Theory and Practical) shall be required for passing. However, for the
purpose of exemption in the subject the marks in Theory and Practical be read
together and aggregate marks for exemption shall be 50% for implementation
from the academic session 2009-2010.
ITEM NO. :128:
The Council considered and approved the recommendation of
Board of Studies in Law in its meeting held on 14.09.2009 & accepted by the
Faculty of Law in its meeting dated 23.11.2009 regarding the subject Court
Visit is prescribed for 1st semester of 5 year Law course and 1st semester of 3
years Law course for the evaluation of Court Visit the university shall appoint
an external examiner and Internal examiner, preferably full time teacher.
ITEM NO.: 129:
The Council considered and approved the recommendation of Board
of Studies in Law in its meeting held on 14.09.2009 & accepted by the Faculty
of Law in its meeting dated 23.11.2009 regarding the request of S. P. Law
College. Teachers and decided that the work load for pre-Law subject and
Law subject shall be six periods, per subject per week, and one period of
tutorial to be implemented from the academic session 2010-2011.

changes in the B. Ed. syllabus in the VI Paper (Elective paper) instead of One
Elective of 100 marks, it should be Two Elective subject has to be opted out
of the VI elective subjects by the student, each of paper carries 50 marks to be
implemented from session 2010-2011.

1) No teacher training college shall be run without the Regular Teacher
(Lecturer) as per the UGC Norms.
2) Sessional marks for B.Ed Examination shall not be accepted by the
University without the signature of the Regular / Approved Principal or
Approved Officiating Principal by the University. In no case it will be
signed by the Secretary / President of the society and such cases should
not be accepted by the University authority.

decision of authority.
The same issue again appeared in this Academic
Council on item no. 174 for approval to opinion of Standing Legal
Counsel on his clarification given in terms of situations arising and the
provision of one revision to be given to the students as per the decision of

approved by the Faculty in its meeting held 2.6.2009 to be implemented from the
session 2009-2010.

The Council Considered and approved the action taken by the
Hon’ble Vice-Chancellor on 10.10.2009 under Section 14(7) of the M.U.
Act, 1994 on behalf of Academic Council in accepting the recommendation of
the Chairman, Board of Studies in Law held on 16.09.2009 & Dean, Faculty
of Law held on 31.08.2009 regarding permitting the students of LL. B. (3
years) course.
(The justification as per Chairman & Dean Faculty of Law).
The student is eligible for admission to LL. B. 3 rd semester on the
ground that the has passed B.G.L. Part- I. No doubt B.G.L. course now no
more is in existence but B.G.L. Part – I & LL. B. Part – I is equivalent and
even paper set was common therefore the B.G.L. is to be treated as LL.B.
Part- I and the student can be absorbed in LL. B. Three year course in 3 rd
semester provided that the students should simultaneously appear for
following papers of 1st & 2nd semester as follows.
1) Legal Language & Legal Writing First Semester
2) Human Rights
- Second Semester
3) Contract II

Hon’ble Vice-chancellor on 4/1/2010 under section 14 (7) of the Maharashtra

the old students of B. Pharm. course Revised/Modified Absorption Scheme for
First, Second and Third B. Pharm. (Old course) to First, Second, Third and
Final B. Pharm. (New course). The said scheme as recommended by the Board
of Studies in Pharmaceutical Sciences held on 4.3.2009 and concurred by the
Dean, Faculty of Medicine dated 6.7. 2009 under Section 38(a) of Maharashtra

dated 8th March, 2010 received from Director B.C.U.D. regarding the
report on the meeting chaired by Shri. Rajesh Tope, Hon’ble Minister
for Higher & Technical Education Mantralaya, Mumbai and the
Principal Secretary, J.L. Saharia, Higher & Technical Education
Mumbai on 23.2.2010 & 26.2.2010 respectively for introducing the
choice based credit system for P.G. Coureses to be implemented from

The Council Considered and accepted in principle and further
resolved to refer it to the Management Council.

course students who were pursuing the old course and could not clear the subjects
of M.B.A. semester II of old course need to be absorbed in the new M.B.A. course
introduced from the session 2008-2009 as recommended by the Chairman of the
Board of Studies in Business Management & Business Administration dated 14-12010 and concurred by the Dean, Faculty of Commerce under section 38 (a) dated
15-1-2010 for its implemented from the session 2009-2010.
