NSHE/TMCC Discrimination & Harassment Complaint Procedure Flowchart If complaint is registered with Human Resources (HR), HR will forward the complaint to the Primary Officer within five (5) college working days. If complaint is registered with a supervisory, managerial, administrative, or executive member of the college, they will forward the complaint immediately to the appropriate person. OR If the complaint involves the Primary Officer, it will be registered with the President. The President will Designate another individual to investigate the complaint and make a recommendation. The designated individual will preform the duties of the Primary Officer. OR If the complaint does not involve the Primary Officer, the complaint is registered with the Primary Officer. Initial review of the report or complaint is conducted. If complaint does not allege discrimination, the Primary Officer will meet with the complainant and notify them that no investigation will be conducted. OR If complaint alleges discrimination, the Primary Officer will summarize the information and begin an investigation, which will be completed within 45 days unless extraordinary circumstances require more time. Interview Complainant and notify them of their right to have an advisor present. A letter or e-mail will be sent to the complainant notifying them of this conclusion. Interview the individual alleged to have committee the discrimination and notify them of the right to have an advisor present. Interview witnesses suggested by either party. Consult with General Council, the Chief Human Resources Officer, the Student Conduct Officer, and any other faculty and staff during the investigation. The President may accept or reject the recommendation within ten (10) college working days. The President will notify the complainant and person accused of the outcome of the investigation within five (5) college working days from the acceptance of a recommendation.
