In some cases students are accepted for enrollment on a tuition paying basis, and the School Code allows for collection of those payments calculated as follows: “tuition in an amount not exceeding 110% of the per capita cost of maintaining the schools of the district for the preceding year.” The Annual Financial Report dated June 30, 2011 shows that 110% of the per capita tuition cost is $11,298.00. Analysis: N/A Recommendation: The administration recommends the adoption of the out of district tuition rate of $11,298.00 for the 2012-2013 school year. Motion: To set the Out of District tuition rate at $11,298.00 for the 2012-2013 school year. Agenda Lake Zurich Community Unit School District 95 Report to Board of Education Board Meeting Date: January 26, 2012 From: Vicky Cullinan, Assistant Superintendent for Business and Operations Re: Registration and Participation Fees Policy Reference: 4:140 – Student Fees Background: Board policy states that “the Superintendent will recommend to the Board for adoption a schedule of fees, if any, to be charged students for the use of textbooks, consumable materials, extracurricular activities, and other school student fees. All fees are due in full by the time school begins.” “For this purpose, “fees” means any monetary charge collected by a public school or district from a student or the parents or guardian of a student as a prerequisite for the student’s participation in any curricular or extracurricular program of the school or school district. In addition to the fee structure, there are additional items that may be required to participate in activities/extracurricular activities by the classroom teacher that are outside the existing fee schedule. Students with outstanding fee balances will be excluded from participating in fee based activities.” The determination of fees for the 2012-2013 school year were discussed at the December and January Committee of the Whole Meetings. Recommendation: The administration is recommending no increase in fees for the 2012-2013 school year. Additionally, the administration is recommending that we discontinue the two track payment system and use only one fee. It is our recommendation that the discounted fee be used. This is being put forward because of the following: 1) Most families pay the discounted amount and 2) This would reduce the time consuming practice of refunding checks for the free and reduced families (the free lunch applications are approved after fees are collected causing a reduction in the fees already paid). We would like to institute a late fee instead. After discussions with personnel at the building level we will be exploring the best way to institute this practice for next school year. Motion: To keep the fees at the same rate for the 2012-2013 school year, discontinue the early bird discount and institute a late fee. Previous to the new accounting rules the items were paid directly out of the Education Fund or O & M Fund. Analysis: N/A Recommendation: The administration is asking for authorization to transfer $160,342.00 from the Education Fund to the Debt Service Fund. The purpose of the transfer is to reimburse the Debt Service Fund for the outstanding bonded debt for the construction of a new facility. The administration is asking for authorization to transfer $2,205.36 from the Education Fund to the Debt Service Fund. The following field trip falls into the guidelines requiring Board approval. The Lake Zurich High School Advanced Journalism students will travel to Seattle, Washington to attend the Journalism Education Association National Convention from April 12-15, 2012. The convention highlights the best-of-the-best for high school journalism and provides an opportunity to learn from and share with other student journalists and professionals. Students will fly to the airport closest to the convention site and then travel by group shuttle to the hotel. Fundraisers are planned for this school year to assist with the cost of the trip. Egan, Superintendent of Schools 400 South Old Rand Road - Lake Zurich IL 60047-2459 Phone: (847) 438-2831 website: www.lz95.org FAX: (847) 438-6702 October 2008 2011 5:240 Professional Personnel Suspension 1 Suspension Without Pay 2 The School Board may suspend without pay: (1) a professional employee pending a dismissal hearing, or (2) a teacher as a disciplinary measure for up to 30 employment days for misconduct that is detrimental to the School District. Administrative staff members may not be suspended without pay as a disciplinary measure. Misconduct that is detrimental to the School District includes: • Insubordination, including any failure to follow an oral or written directive from a supervisor; • Violation of Board policy or Administrative Procedure; • Conduct that disrupts or may disrupt the educational program or process; • Conduct that violates any State or federal law that relates to the employee's duties; and • Other sufficient causes. At the request of the professional employee made within 5 calendar days of receipt of a presuspension notification, the Board or Board-appointed hearing examiner will conduct a presuspension hearing. 3 The Board or its designee shall notify the professional employee of the alleged charges and the date and time of the hearing. At the pre-suspension hearing, the professional employee or his/her representative may present evidence. Suspension With Pay The Board or Superintendent or designee may suspend a professional employee with pay: (1) during an investigation into allegations of disobedience or misconduct whenever the employee’s continued The footnotes are not intended to be part of the adopted policy; they should be removed before the policy is adopted. 1 State and federal law control this policy’s content. The School Code provides that, “[i]f, in the opinion of the board, the interests of the school require it, the board may suspend the teacher without pay, pending the hearing, but if the board’s dismissal or removal is not sustained, the teacher shall not suffer the loss of any salary or benefits by reason of the suspension,” 105 ILCS 5/24-12(d)(1), as amended by P.A. 97-8 (emphasis added). This policy contains an item on which collective bargaining may be required. Any policy that impacts upon wages, hours, and terms and conditions of employment, is subject to collective bargaining upon request by the employee representative, even if the policy involves an inherent managerial right. A board policy will be superseded by a collective bargaining agreement that contains provisions exceeding the requirements of the policy; in that case, the policy should state, “Please refer to the current [insert name of professional CBA or use a generic reference, e.g., ‘agreement between the bargaining representative and the School Board’]”. Boards should seek the advice of their attorneys concerning any disciplinary suspension. 2 Under the wage and hours rules, employees who are exempt from overtime requirements become eligible for overtime if they are subject to disciplinary suspensions without pay. Auer v. Robbins, 117 S.Ct. 905 (1997). Teachers are exempt from this rule. Although the U.S. Dept. of Labor modified this rule in 2004, the Illinois legislature rejected these rule changes (820 ILCS 105/4a). Illinois employers must use the federal rules as they existed on March 30, 2003. This sample policy takes a conservative approach: it does not subject non-teaching professional employees to disciplinary suspensions without pay. Some attorneys believe that non-teaching exempt employees (e.g., administrators) will remain exempt from the Fair Labor Standards Act’s overtime requirements as long as suspensions are in increments of a full work week - not dayby-day. Contact the board attorney for an opinion. The 30-day limit may be modified or deleted. 3 Some case law suggests a separate hearing must be held before any suspension without pay is invoked: Cleveland Board of Education v. Loudermill, 105 S.Ct. 1487 (1985); Barszcz v. Community College District No. 504, 400 F.Supp. 675 (N.D. Ill., 1975); Massie v. East St. Louis School District No. 189, 561 N.E.2d 246 (Ill.App.5, 1990); Spinelli v. The Superintendent shall meet with the employee to present the allegations and give the employee an opportunity to refute the charges. The employee will be told the dates and times the suspension will begin and end. 4 Repayment of Compensation and Benefits Any criminal conviction resulting from the investigation or allegations shall require the employee to If a professional employee is suspended with pay, either voluntarily or involuntarily, pending the outcome of a criminal investigation or prosecution, and the employee is later dismissed as a result of his or her criminal conviction, the employee must repay to the District all compensation and the value of all benefits received by the employee him or her during the suspension. 5 The Superintendent will notify the employee of this requirement when the employee is suspended. Some due process is recommended, however, because a suspension might jeopardize a teacher’s good standing in the community and thus infringe the teacher’s liberty interests protected by the Constitution. NEW October 2011 7:305 Students Student Athlete Concussions and Head Injuries 1 The Superintendent or designee shall develop and implement a program to manage concussions and head injuries suffered by student athletes. 2 The program shall: 1. Comply with the concussion protocols, policies, and by-laws of the Illinois High School Association, including its Protocol for NFHS Concussion Playing Rules and its Return to Play Policy. 3 These specifically require that: a. A student athlete who exhibits signs, symptoms, or behaviors consistent with a concussion in a practice or game shall be removed from participation or competition at that time. b. A student athlete who has been removed from an interscholastic contest for a possible concussion or head injury may not return to that contest unless cleared to do so by a physician licensed to practice medicine in all its branches in Illinois or a certified athletic trainer. c. If not cleared to return to that contest, a student athlete may not return to play or practice until the student athlete has provided his or her school with written clearance from a physician licensed to practice medicine in all its branches in Illinois or a certified athletic trainer working in conjunction with a physician licensed to practice medicine in all its branches in Illinois. 2. Inform student athletes and their parents/guardians about this policy in the Agreement to Participate or other written instrument that a student athlete and his or her parent/guardian The footnotes are not intended to be part of the adopted policy; they should be removed before the policy is adopted. 1 Each school board must adopt a policy regarding student athlete concussions and head injuries that is in compliance with the protocols, policies, and by-laws of the Illinois High School Association (IHSA) (105 ILCS 5/10-20.53, added by P.A. 97-204). This requirement applies to elementary school districts even if they have no student athletes. The Center for Disease Control and Prevention explains that a concussion is a type of traumatic brain injury caused by a bump, blow, or jolt to the head that alters the way the brain normally functions. See www.cdc.gov/concussion/. The CDC website contains excellent resources for the recognition, response, and prevention of concussions, including the opportunity to order or download free educational materials on concussions that can be distributed to parents, students, and coaches. 2 The IHSA’s by-laws define a student-athlete as “[a] student who has participated in one or more practices and/or athletic contests in any sport offered by or under the auspices of a high school.” See www.ihsa.org/AbouttheIHSA/ConstitutionBylawsPolicies.aspx. A school board for a high school or unit district may want to add the definition as follows: “A student athlete is a student who has participated in one or more practices and/or athletic contests in any sport offered by or under the auspices of a high school.” A sample program is provided in 7:305-AP, Administrative Procedure - Program for Managing Student Athlete Concussions and Head Injuries. 3 The Protocol for NFHS Concussion Playing Rules contains concussion information and provides instructions when a student athlete sustains an apparent concussion. The Return to Play Policy addresses the requirements for returning a student athlete to play after he or she exhibits signs, symptoms, or behaviors of a concussion.
