Dear Floridian,
For the past five years, the State Fire Marshal’s Office has reported on the status of fire
safety inspections in Florida’s public schools in its annual report. In accordance with
Florida Statutes, each local school district and fire department is required to inspect every
public school within each jurisdiction annually.
This year, the school districts submitted their reports at their highest percentage yet, with
99 percent reporting for the 2006-2007 school year. While 100 percent is ideal, this is a
tremendous improvement that should be commended.
As State Fire Marshall, I work to ensure that the school districts and local fire officials
have the tools necessary to complete these reports accurately and in a timely fashion.
The Summary Inspection feature of the Web-based School Report System (SRS) is
still available and can significantly reduce input time in the SRS. Additionally,
inspection reports can be entered immediately following an inspection, which eliminates
the need to submit hard copies of fire safety reports to the State Fire Marshall.
The Division continues to encourage joint inspections, which are inspections performed
at the same time by both the school district fire safety inspector and the local fire official.
Joint inspections allow cooperation between fire safety professionals; the collaborative
effort improves the quality of inspections, reduces the burden on classroom disruption
and produces uniform and consistent documentation of deficiencies.
The safety of our schoolchildren and communities is contingent upon the efficiency of
the Division of State Fire Marshal. I am encouraged by our recent improvements and
look forward to continuing the good news in the year ahead.

Overview of Law
Overview of the Requirements of Section 1013.12, Florida Statutes
The firesafety inspections referred to in the statute above are applicable
to all buildings owned, leased, or being lease-purchased by the school board,
including all permanent and re-locatable buildings. In addition, they must
begin not sooner than one year after a new building has been occupied.
They must be performed each fiscal year in accordance with any applicable
code or standard, such as NFPA 101, as adopted in Rule 69A-3.012, Florida
Administrative Code, or any other applicable code or standard which has been
adopted in Rule Chapter 69A-58, Florida Administrative Code. Finally, the
subject inspections are not applicable to new construction or new buildings
which are subject to and controlled by Section 1013.38, Florida Statutes.
Each firesafety inspection report and plan of correction must contain,
at a minimum, the name of the school district or community college, the name
of the local fire authority having jurisdiction (that is, the municipality, county,
or special district), the name of the facility inspected, the type of facility
inspected (that
is, K-5, 6-9, 1012, community
colleges, other),
the facility
address, the
number of the
facility as listed
in the Florida
Inventory of
School Houses
(FISH#), the
name, address,
and phone
number of each
inspector and the designation of whether such inspector is a special fire safety
inspector or a municipal fire safety inspector, the date of the inspection, and
each violation or deficiency noted during an inspection.
Reports of the inspections must be filed with the local school board
and the local site administrator. A plan and schedule for correction of any
deficiency in the inspection report must be developed by any fire safety

inspector finding a deficiency in conjunction with the school board and that
plan and schedule then must be adopted and complied with by the school board.
Furthermore, each violation or deficiency report must contain the
Building name or number and, if applicable, the room number of the building
in which the violation was noted; a description of the violation or deficiency
and the number of times this violation or deficiency has been cited. In addition,
the estimated correction date, total number of violations or deficiencies cited
not involving serious life safety hazards and the total number of violations or
deficiencies cited involving serious life safety hazards. Finally, the date of the
scheduled re-inspection, a statement that the district has or has not complied
with 1013.12(1)(c), a statement that the local authority having jurisdiction
has or has not complied with 1013.12(2) c), including verification that the
required fire drills have been completed. The report must include the signature
of the district inspector if the inspection was made by the school district, or the
signature of the local fire official if the local authority having jurisdiction made
the inspection. If joint inspections were performed, both the school district fire
safety inspector and the local fire official must each sign the report.
When the violation or deficiency has been corrected, the school board
must notify the division of such correction. The inspection reports noted above
together with the plan and schedule for correction of any deficiency must be
submitted to the division by June 30, of each year.
New Inspection Reporting Procedure
New Inspection Reporting Procedure Is Available
In an effort to streamline the reporting process of fire safety inspection
reports to our office by school districts and local fire officials, the State Fire
Marshal (SFM) has modified its Public School Reporting System (SRS). The
purpose of this modification is to allow school districts and local fire officials
another reporting option by submitting a simplified general summary report of
fire deficiencies noted for each school and ancillary facility inspected.
When submitting a general summary report, this feature is accessible at
the point when you identify the inspecting authority, and is labeled, “Summary
Inspection.” You may use this option by simply checking its box, in addition to
checking the inspecting authority. Simply not checking the “Summary Inspection” box will allow you to enter detail reports in the SRS as normal. Currently,
any firesafety violation must be coded using form DFS-K3-1674, “Master
Violations Code List.” The simplified summary inspection feature will allow
the inspecting authority to total the number of violations for each category, and
simply type that number into each respective category.
Example: If for a particular facility you have 10 – Means of Egress violations,
and 5 – Fire Alarms violations, then you would simply type 10 into the 200
category, and 5 into the 400 category, leaving the other categories as the default
“0”, and follow the remaining steps.
If you choose not to use the SRS, you may still utilize the summary
inspection procedure by simply providing the SFM with a one page summary
for each facility inspected. The summary page must include the following
information: the inspecting authority, inspection date, facility name and address
being inspected, and the total number of violations in each category. This
serves the purpose of eliminating the need to send full inspection reports,
requires the submission of a one page document per facility, and meets the
submission requirements of Chapter 1013.12, Florida Statutes. Full copies of
inspection reports are not require and should not be sent. Potential School Reporting System Enhancement
The SFM is attempting to increase the school district’s ownership of
the school lists in the SRS for their respective district. The purpose of this is to
allow school districts the ability to manage their data list; specifically, giving
them the ability to indicate through the SRS which facilities are not required

to be inspected, and for what reason. While this is still in the inception phase,
it is our hope to restructure the system to avoid discrepancies, which will
ultimately lead to obtaining a 100% report rating. Moreover, the SFM is also
exploring a reporting option that would reduce the amount of entry time to
one minute or less for each school. For example, if you had 45 schools and
ancillary facilities, the entry would take approximately 45 minutes to complete.
Another advantage is that this entry could be performed by any personnel
designated by the school district.
