To qualify for this category, the position applied for must require at least a Bachelor's Degree as a minimal entrylevel requirement. In WKU's case, this status is generally used for international professors in both temporary and tenure track positions. Current regulations require the filing of a Labor Condition Application with the Department of Labor prior to filing the actual H-1B application. In order to file a Labor Condition Application, a Prevailing Wage Request must first be filed with the Department of Labor. The entire H-1B process can take up to five months to complete; therefore, please allow ample processing time. A basic difference between the H-1B category and other non-immigrant visa categories is that the employer (WKU), not the alien worker, is the applicant. The employer is referred to as the "petitioner" and the alien worker becomes the "beneficiary" of the H-1B petition when it is approved by the Department of Homeland Security (DHS). To process your H1B Hiring Request, please contact the Office of International programs (OPI) to gain information on which forms are needed. OIP will also inform you of the forms required from the employee. Once OIP has received the forms, they will begin the process. WKU Academic Affairs urges all WKU departments and units to FIRST pursue the H-1B status procedure to complete the hiring of new international faculty or staff. Thereafter, the new faculty or staff member must serve for (ONE calendar year for teaching positions FROM Date of Acceptance of Job Offer Letter) and (120 days for non-teaching positions FROM Date of Acceptance of Job Offer Letter) BEFORE WKU will consider sponsoring him/her for a permanent resident status (PR). If a WKU visa applicant’s studies or works involves these certain technologies, an export license from the department of Commerce, State or Treasury may be required in cases where certain exemptions and exceptions do not apply. This worksheet is intended to provide the export control reviewer with enough information to make a determination if such license would be required, or if further information may be necessary to make this determination. Thankfully, most of the work done at WKU falls under the “fundamental research”, “public available”, and “educational” exemptions whereby we would not have to apply for a license to share what would otherwise be export controlled information to a foreign national. Failure to comply with the export control regulations may lead to significant civil and/or criminal penalties up to $250,000 per violation, criminal penalties up to $1,000,000 per violation ; prison up to 20 years; denial of export privileges; and debarment from U.S. government contracts. U.S. Export Controls on release of Controlled Technology or technical Data to Foreign Persons. The Export Administration Regulations (EAR) (15 CFR Parts 770-774) and the International Traffic in Arms Regulations (ITAR) (22 CFR Parts 120-130) require U.S. persons to seek and receive authorization from the U.S. Government before releasing to foreign persons in the U.S. controlled technology or technical data. Under both the EAR and the ITAR, release of controlled technology or technical data to foreign persons in the United States—even by the employer—is deemed to be an export to that person’s country or countries of nationality. One implication of this rule is that the U.S. company must seek and receive a license from the U.S. Government before it releases controlled technology or technical data to its nonimmigrant workers employed as H-1B, L-1 or O-1A beneficiaries. Requirement to Certify Compliance with U.S. Export Control regulations. The U.S. Government requires each company or other entity to certify it has reviewed the EAR and ITAR and determined whether it will require a U.S. Government export license to release controlled technology or technical data to the beneficiary. If an export license is required, then the company or other entity must further certify that it will not release or otherwise provide access provide access to controlled technology or technical data to the beneficiary until it has received from the U.S. Government the required authorization to do so. The license requirements described above will affect only a small percentage of petitioners because most types of technology are not controlled for export or release to foreign persons.
