1.
All unmarried incoming students (age 17-21) not residing with their legal guardian, or whose home address is located
beyond a 35-mile radius from Xavier are required to live on-campus for their first two years at the University. Exceptions
may be granted based upon the needs of the individual and/or the University with written approval from the Senior Director
for Student Affairs. This Housing Agreement is legally binding for the 2015-2016 and 2016-2017 academic years. The
rates listed in Section 23 are only for the 2015-2016 academic year. Rates for the 2016-2017 academic year are subject to
change as may be subsequently established by the Board of Trustees. Payment of all rates are due and must be paid on or
before the time specified in Section 9.

Housing Deposits and Cancellation Fees for incoming first year students only: The Office of Admission requires a
housing deposit of $200. Incoming first year students who are not otherwise required to live on-campus and decide that
they do not want to live in on-campus housing (after applying) must submit a written request that is postmarked by May 1,
2015 to the Office of Admission in order to receive a refund of the deposit. Incoming first year students enrolled at Xavier
who are not otherwise required to live on-campus and who elect not to live in on-campus housing after the first day of
classes in a semester, must nonetheless pay to Xavier the rate specified for each of the academic years which are the subject
of this Housing Agreement.

Cancellation Fee for returning (non-first year students) students only: who have signed a Housing Agreement must
apply in writing to the Office of Residence Life in order to be released from their obligations and in that event, a $1,000
cancellation fee must be paid at the time the student is released.

After acceptance by the University, THIS HOUSING AGREEMENT IS BINDING ON BOTH THE STUDENT AND
THE UNIVERSITY FOR BOTH SEMESTERS OF THE 2015-2016 ACADEMIC YEAR, AS WELL AS BOTH
SEMESTERS OF THE 2016-2017 ACADEMIC YEAR. Students who breach this Housing Agreement must
nonetheless pay to Xavier the rate specified in Section 23 for each of the academic years which are the subject of this
Agreement.

All students living in the residence halls (Fenwick Place, Brockman, Buenger, Husman, or Kuhlman Halls) are required to
select one of the residential meal plan options offered by the Office of Auxiliary Services. If you do not choose a meal plan,
you will be assigned and required to pay for the “Ultimate Muskie plus $100 Dining Dollars” meal plan at the then current
rate.

All room furniture provided by the University is to remain in student rooms unless the Office of Residence Life grants
written permission. Submit requests in writing at least two weeks in advance to the Office of Residence Life.

By accepting this Housing Agreement and entering into residence on University property, each student agrees that the
residence accommodation shall be available for reasonable investigation by authorized persons, including, but not limited to
members of the University’s Police Department. The University recognizes the desire of students for privacy under
ordinary circumstances, and generally, will not search quarters except in instances which the Director of Student Integrity or
the Vice Provost of Student Affairs believes a violation of law, the Code of Student Conduct, or any other University policy
is occurring or has occurred; or, for reasons of health, safety, or maintenance; or, in instances of emergency. See the
Student Handbook for the Code of Student Conduct, and other policies and procedures, including the University Conduct
System which in the event of any inconsistencies shall govern.

This Housing Agreement may be canceled by Xavier: l) by mutual consent of the student concerned and the University's
Senior Director of Student Affairs; 2) for lack of on-campus housing space; 3) for failure of the student to honor any of the
provisions of this Agreement; 4) for any other violation of the Code of Student Conduct or any other University rule or
policy; or, 5) if the student is suspended or expelled from the University for academic and/or disciplinary reasons. Students
who are removed from housing for sub–sections 3,4 or 5 are not entitled to a refund of room fees for the remainder of the
semester in which they are removed.
9.
Room assignments will be held until 5:00 P.M. on the first day of undergraduate classes for both fall and spring semesters.
Students must have the room and board fees paid in full (or have entered into a payment plan with the University) and
"check-in" by this time or their room assignment may be cancelled and any amounts previously paid to the University will
not be refunded, and the student will be liable to pay all applicable amounts due, as described herein.
10. All student rooms and common areas are the responsibility of the residents. Damaged or missing items will be replaced at
the expense of the responsible student or students or as delineated in the Student Handbook.
11. The University does not assume responsibility for theft, loss or damage to resident's personal property and the student hereby
releases the University from any liability. Therefore, it is strongly recommended that each individual obtain insurance
coverage for all items of personal property kept at the residence.
12. Xavier is not responsible for the physical safety of the residents and the student releases the University from any liability
therefore unless the injury arises solely from the gross negligence of Xavier. Each resident agrees to abide by all regulations
concerning safety and agrees to do no act that could jeopardize his/her own safety or the safety of the other residents.
13. Reservations accepted after the formal spring housing reservation period are provisional unless otherwise designated by the
Senior Director of Student Affairs, or designee, in writing. The University honors provisional reservations only when there is
space available.
14. This Agreement is for the time period when the Office of Residence Life designates the “Halls/Apartments Open” (typically
August and January) through “Halls/Apartments Closed” (typically December and May). If the student requires housing
prior to or after these times, they must apply for permission to do so, which may be granted or denied in the University’s sole
discretion. Granted requests will include a charge for the additional time periods. Students and their families should plan
accordingly as requests for “convenience” will not be granted.
15. This Housing Agreement does not entitle the students to the use of his/her room in the residence halls during the major
university vacation period (winter break). The University is also not obligated to provide food service during the break
periods. In cases of extenuating circumstances, and only upon written approval of the Senior Director of Student Affairs, or
designee, the University may provide, at a charge, some housing for students unable to leave campus during break periods.
16. The Senior Director of Student Affairs, or designee, reserves the right to change any student’s housing assignment: a) to
make the most effective use of facilities (including consolidations of vacancies); b) when it is deemed advisable for the
welfare and benefit of any student; or c) when repairs and maintenance are required to correct a condition that is dangerous to
the health and/or safety of the resident or residents of the room/suite/apartment/building. Students with vacancies in their
rooms should be prepared to accept a new roommate, move to another room with a vacancy or expect to pay an additional
charge to buyout the remaining occupancy space as determined by the University for the reduced occupancy.
17. Students who withdraw during any semester, or for the upcoming semester, are required to notify the Office of Residence
Life or they will continue to be charged housing/campus dining fees. Additionally, if students continue to occupy the
residence either by remaining there personally or leaving personal belongings they will be charged for continued occupancy.
The residence is considered officially vacated when all belongings are removed, the student has checked out of the room with
a residence life staff member and has returned any keys.
18. Students must review the Student Handbook which may be found through the Xavier home page. Every student is held
responsible for knowledge of and compliance with the regulations and information contained in the Student Handbook. The
Student Handbook and the rules contained therein shall serve as part of this Housing Agreement except to the extent they are
inconsistent with the terms hereof, in which case the terms hereof shall govern. In addition, student represents he/she has
been advised of the processes used by the University in determining alleged violations of this Agreement and student agrees
to abide by those processes.
19. While a resident, each student agrees to remain enrolled as a full-time student in good academic standing at the University.
Student agrees to behave with proper regard and mutual respect for other students, residents, guests, resident assistants and
other University personnel, residence hall/apartment neighbors and their respective property. Student agrees not to engage in
conduct prohibited by the Student Handbook or other University policies. Any student who breaches any duties under this
Agreement agrees that, in addition to immediate termination of this Agreement, the student may be subject to one or more of
the following sanctions: written warning; probation; work or service requirement; restitution; fine; forfeiture of room fee,
room deposit and security deposit; suspension or dismissal from the residence hall/apartment; prohibition from other
University housing; referral for conduct under the Code of Student Conduct contained in the Student Handbook; referral for
legal action; and such other action as the University deems appropriate.
20. The Senior Director of Student Affairs, or designee, may accept or reject the reservation of any applicant. Rejected
reservation requests indicate the University will NOT offer on-campus housing to the student.
21. By accepting this Housing Agreement the student acknowledges that the University may send mass or individual e-mail
messages to his/her Xavier e-mail account and agrees that email is an acceptable method of receiving all communications
related to this agreement or the student’s housing. Students are required to check their Xavier e-mail account on a regular
basis in order to receive all information from the University.
22. The University reserves the right with notice, to modify this Housing Agreement in order to bring it into compliance with
applicable laws and regulations, and upon notice to the student, such modifications shall be binding to the same extent as all
provisions hereof.

I acknowledge that I have read and understand, and I hereby agree to be bound by this document entitled "2015-2016 and
2016-2017 Xavier University On-Campus Housing Agreement and Provisions for Occupancy". I agree to pay the 2015-2016
and 2016-2017 rates as established by the Board of Trustees of Xavier University for the type of room to which I am
assigned and the board plan which I selected. I understand this Housing Agreement is binding for both semesters of
both the listed academic years. A signature of parent or legal guardian is required if student is under eighteen years of age.
