Dear Zach:
Laclede Energy Resources, Inc. (Shipper) and Northern Natural Gas Company (Northern) agi'ee that for the request
for throughput service forms and the corresponding service agreements or amendments entered into pursuant to
Northern's Rate Schedules TEX, LFT and SMS with terms of one month or less (Service Agreement), the documents
will be deemed executed and the Service Agreement will be binding without execution by Shipper i f (a) Shipper
nominates on the Service Agreement, or (b) Shipper has not notified Northern in writing within two (2) business days
of the date of the Service Agreement that it declines the Service Agreement.
Please select one of the following options for Service Agreements and amendments to Service Agreements with terms
of one month or less:

THE FULLEST EXTENT PERMITTED BY LAW, EACH OF THE PARTIES HERETO WAIVES ANY
RIGHT IT MAY HAVE TO A TRIAL BY JURY WITH RESPECT TO LITIGATION DIRECTLY OR
INDIRECTLY ARISING OUT OF, UNDER OR IN CONNECTION WITH, THIS AGREEMENT OR ANY
SERVICE AGREEMENT BETWEEN THE PARTIES WITH A TERM OF ONE MONTH OR LESS. EACH
PARTY FURTHER WAIVES ANY RIGHT TO CONSOLIDATE ANY ACTION IN WHICH A JURY TRIAL
HAS BEEN WAIVED WITH ANY OTHER ACTION IN WHICH A JURY TRIAL CANNOT BE OR HAS
NOT BEEN WAIVED.

This Agreement shall be effective until terminated by either party upon thirty (30) days written notice to the other
party.
