AMITYVILLE - Terming the
secret pay raises for Nassau
County officials "backroom
manipulation that does no one any
good," Region One President,
Danny Donohue, last week called
for a halt to the practice of County
managers giving themselves fat
raises, some as much as 50% increase in salary over one year —
while county employees are
restricted by the Taylor Law to
bargaining and accepting pay increases of much less.
The secret pay raises granted to
several top county officials were
passed by the Nassau County Board
of Supervisors several weeks after
the 1981 budget went into effect on
Jan. 1.
The Nassau County Controller
received a 10 percent increase of
$5,000 bringing his annual salary up
to $55,000. One of his deputies
received a 9.4 increase bringing his
salary to $25,000, which represents
an increase of 57.6 percent since
1980. Other officials received
raises which increased their
salaries between 23 to 30 percent
over 1980 levels.
The more than 20 management
officials who received the raises
were part of "Ordinance No. 1"
passed by the board unanimously
on Jan. 5 which also approved the
already negotiated CSEA salary
raises for county workers. The
CSEA negotiated pay raises of 7.5
percent were reached at a lastminute settlement under the threat
of an imposed contract which

Donohue. "We're going into
negotiations for the new contract
now and we would be considered insane if we asked for a 50 percent increase for our members. What is
additionally unfair, is that there is
no productivity justification for
these management raises and they
come after the government in

two years' back pay to a secretary f r o m a Long
Island school district. T h e union contends she
w a s illegally fired f r o m her job — not just once,
but t w i c e .
Diana McLaughlin, a s e c r e t a r y at the North
Bellmore Union F r e e School District,
was
a w a r d e d b a c k p a y a n d " a l l o t h e r b e n e f i t s of h e r
e m p l o y m e n t " for the period b e t w e e n February
1978, w h e n s h e w a s o r i g i n a l l y f i r e d f r o m h e r
p o s i t i o n , a n d A u g u s t 1980, r e s u l t i n g f r o m a n
a c t i o n b r o u g h t b y t h e C S E A in t h e N a s s a u
County S u p r e m e Court.
M r s . M c L a u g h l i n w a s s u s p e n d e d a t t h e e n d of
s c h o o l in J u l y 1, 1977 a n d l a t e r f i r e d f o r a l l e g e d
i n c o m p e t e n c e a h e r a h e a r i n g held by the s c h o o l
b o a r d in F e b r u a r y , 1978. T h e C S E A b r o u g h t a n
a r t i c l e 78 p r o c e e d i n g t o r e v i e w h e r d i s c h a r g e ,
CSEA attorney Richard Gaba said, b e c a u s e the
s a m e official w h o had a l l e g e d l y told Mrs.
M c L a u g h l i n to r e s i g n or be fired w a s the h e a r i n g
officer at her case.
" W e f e l t t h a t it w a s a p r e j u d i c i a l h e a r i n g a n d
that the hearing o f f i c e r should h a v e disqualified
h i m s e l f , " said Mr. Gaba.
The Appellate Division agreed with the CSEA
and the c a s e w a s returned to the school district
for a n e w hearing. Mrs. M c L a u g h l i n w a s f i r e d
again after a hearing last August The CSEA has
a p p e a l e d that decision, Mr. G a b a said. At that
t i m e , the union a l s o s t a r t e d p r o c e e d i n g s to g e t
Mrs. McLaughlin's back pay. The North
B e l l m o r e School District c o n t e n d e d that by refiring Mrs. M c L a u g h l i n , t h e y did not h a v e to p a y
her back wages. While the N a s s a u S u p r e m e
Court agreed with the C S E A position and
ordered the school district to pay Mrs.
M c L a u g h l i n h e r b a c k p a y , t h e s c h o o l h a d 30 d a y s
to f i l e an appeal.
" W e just hope the school district and other
g o v e r n m e n t u n i t s in N a s s a u g e t t h e m e s s a g e t h a t
w e s t a n d by our e m p l o y e e s , s a i d N i c h o l a s Abb a t i e l l o , p r e s i d e n t of L o c a l 830. " N o m a t t e r h o w

employee work force, m a y provide
either support for the City's c l a i m or
c o n c r e t e r e c o m m e n d a t i o n s on h o w to
avoid the predicted tax hike and
workforce cuts," Campbell said.
T h e union s p o k e s m a n noted that
such e c o n o m i c a n a l y s i s had r e c e n t l y
helped a county s e r v e d by the Capital
R e g i o n to avoid a s i m i l a r fiscal crisis.
" B u d g e t s and budget p r o c e s s e s do not
allow for h u m a n error. Often, due to
time f r a m e pressures, deadlines, etc.,
a c r i s i s situation c a n de'velop d u e to
an unnoticed budget m i s t a k e , " he explained.
"A no c o s t line by line, i t e m by i t e m
a n a l y s i s of t h e p r o p o s e d b u d g e t b y a n
interested third p a r t y s u c h a s C S E A ,
m a y p r o v i d e t h e C i t y of C o h o e s w i t h
t h e m e a n s of r e s o l v i n g i t s p r o b l e m s .
This effort, however,
requires
cooperation
and
communication,
rather than confrontation," he said.
The union s p o k e s m a n concluded,
" C S E A i s a s k i n g t h e C i t y of C o h o e s
not to take a n y a c t i o n on the proposed
City budget until the t i m e c o n s u m i n g
analysis procedure can be completed.

AFFILIATION has the
future looking bright
for union membership
Late in the afternoon of January 22, 1981, in a
moment of historical significance, CSEA
President William L. McGowan and AFSCME
International President Jerry Wurf signed
documents linking the two unions in a permanent
affiliation. That same day CSEA delegates had
overwhelmingly approved the affiliation,
duplicating results of a vote a week earlier by
CSEA's Board of Directors. In its 71st year of existence, the Civil Service Employees Association
had taken a dramatic turn in its history.
Nearly three years earlier, in April, 1978,
CSEA agreed to an experimental, 3-year temporary affiliation with AFSCME and the AFLCIO. CSEA's impact was immediate, pushing

With C S E A / A F S C M E unity, public e m p l o y e e
and making the giant public worker union, for a
time, the largest labor union of any kind in the
AFL-CIO. As Local 1000, CSEA immediately
became the largest local within AFSCME;
elected two international vice presidents to
AFSCME's convention last summer in California.
Throughout the experimental period of affiliation, the two unions worked in concert in a
broad range of areas on behalf of public workers
throughout New York State. Among them were
successful joint campaigns in legislative lobbying in Albany and Washington, political action,
membership training, research, and commercial
advertising. While CSEA is free to conduct its
own programs and projects and is guaranteed a
high degree of independence from the parent un-

ion, coordinated programs are expected to increase and expand under permanent affiliation
on behalf of the membership of both unions.
The many successful joint ventures, the
overwhelming votes in support of permanent affiliation, and the generally positive comments of
htindreds of rank and file members at meetings
throughout the state proved the success of the
experiment itself, and is the source of the high
level of expectation for the future.
In the coming week. The Public Sector will
highlight AFSCME from several points of view
to inform and educate the membership about the
people and the potential of this largest of all
public employee unions, of which CSEA is a major part.
'This is a proud moment

C S E A / A F S C M E h a s a l m o s t 400,000 m e m b e r s ,

the nation, A F S C M E has m o r e than one million
m e m b e r s . Within the AFL-CIO, only one national
union is l a r g e r than w e are.
Y e a r s ago, the m o s t powerful unions w e r e
t h o s e in m a s s p r o d u c t i o n i n d u s t r i e s o r t h e
building trades — unions representing steel
workers, auto workers, g a r m e n t workers, and
construction c r a f t s m e n . E v e n a m o n g public
employees, specialized "crafts" — teachers,
police o f f i c e r s , or f i r e f i g h t e r s — o f t e n had m o r e
p o w e r than other public e m p l o y e e s .

permanent affiliation with A F S C M E and the AFLCIO i s t h e m o s t o b v i o u s c h a n g e , b u t t h e r e h a v e
been m a n y other changes over the past several
y e a r s that a r e m a k i n g C S E A a b e t t e r union.
CSEA has joined the organized labor m o v e m e n t
in A m e r i c a p e r m a n e n t l y . W e a r e L o c a l 1000,
A F S C M E , AFL-CIO and w e will be a better union
f o r it. B u t t h i s a f f i l i a t i o n i s n o t t h e b e g i n n i n g of t h e
e n d f o r a l l o u r p r o b l e m s . R a t h e r , it i s t h e e n d of t h e
b e g i n n i n g of o u r e f f o r t s t o b e c o m e a b e t t e r u n i o n
for our m e m b e r s .
The C S E A / A F S C M E affiliation is the m o s t imp o r t a n t s t e p w e h a v e t a k e n in o u r e v o l u t i o n f r o m
t h e C S E A of t h e p a s t i n t o t h e b o n a f i d e p u b l i c
e m p l o y e e union that C S E A is today. That is w h y I
o r i g i n a l l y p r o p o s e d o u r " t e m p o r a r y " a f f i l i a t i o n in
1978 a n d v i g o r o u s l y f o u g h t f o r o u r n e w , " p e r m a n e n t " relationship.
W e s t i l l h a v e a l o n g r o a d a h e a d of u s in m a k i n g
o u r u n i o n r e a c h i t s full p o t e n t i a l , but w e h a v e c o m e
a l o n g w a y in j u s t t h e p a s t s e v e r a l y e a r s . A f f i l i a t i o n

Capitol to talk to a legislator. F o u r m o n t h s a g o , the
P r e s i d e n t of t h e U n i t e d S t a t e s , t h e G o v e r n o r of
N e w York, a United States Senator from N e w York,
t h e S p e a k e r of t h e S t a t e A s s e m b l y a n d t h e M a j o r i t y
L e a d e r of t h e S t a t e S e n a t e , c a m e t o o u r D e l e g a t e ' s
M e e t i n g to a d d r e s s CSEA.
W i t h t h e a d v e n t of p o l i t i c a l a c t i o n , w e h a v e w o n
t h e f i r s t r e a l r e f o r m of t h e T a y l o r L a w in a d e c a d e ,
r e p e a l of t h e o n e p r o b a t i o n a r y p e r i o d f o r s t r i k e r s .
A n o t h e r v i c t o r y , a g e n c y s h o p , i s e n d i n g t h e e r a of
the " f r e e loader" w h o willingly a c c e p t s union
b e n e f i t s but r e f u s e s t o p a y h i s f a i r s h a r e of u n i o n
d u e s . O c c u p a t i o n a l s a f e t y is no l o n g e r a d r e a m for
p u b l i c e m p l o y e e s in N e w Y o r k S t a t e . T h a n k s t o
C S E A political action, the d r e a m is now reality.
O u r u n i o n i s m a k i n g d r a m a t i c p r o g r e s s in o t h e r
fronts a s well. F o r far too long, our m e m b e r s
r e c e i v e d b e n e f i t s a d m i n i s t e r e d by their e m p l o y e r s ,
but p r o v i d e d by C S E A n e g o t i a t i o n s . T h e m e m b e r s
e n j o y e d t h e b e n e f i t s , b u t e a s i l y l o s t s i g h t of t h e r o l e
C S E A p l a y e d in w i n n i n g t h e m .
T w o years ago, the CSEA E m p l o y e e Benefit Fund
w a s c r e a t e d . M o r e t h a n 100,000 s t a t e e m p l o y e e s
r e p r e s e n t e d by C S E A n o w r e c e i v e d e n t a l a n d
prescription drug i n s u r a n c e provided d i r e c t l y by
CSEA's E m p l o y e e Benefit Fund using p a y m e n t s
provided by the s t a t e under C S E A ' s c o n t r a c t s .
O u r B e n e f i t F u n d p r o v i d e s b e t t e r d e n t a l ins u r a n c e than state e m p l o y e e s e v e r had before and
popular n e w prescription drug i n s u r a n c e , all at no
c o s t to the e m p l o y e e s . L o c a l g o v e r n m e n t s a r e
b e g i n n i n g to join the B e n e f i t F u n d a s C S E A
n e g o t i a t e s participation for its m e m b e r s into contracts with local g o v e r n m e n t e m p l o y e r s .
The
B e n e f i t F u n d i s j u s t a beginning, but it o f f e r s g r e a t
p r o m i s e for our union's e f f o r t s to protect the people
that w e represent.

WHITE PLAINS A new, three-year contract has been
o v e r w h e l m i n g l y r a t i f i e d b y c i t y w o r k e r s . T h e v o t e w a s 318 in f a v o r a n d
29 o p p o s e d , a c c o r d i n g t o U n i t P r e s i d e n t J o s e p h R o c h e .
The w a g e package provides s e v e n percent the first year, eight-anda - h a l f p e r c e n t t h e n e x t y e a r , a n d a c o s t of l i v i n g i n c r e a s e of b e t w e e n
s i x a n d n i n e p e r c e n t in t h e f i n a l y e a r , d e p e n d i n g o n t h e r a t e of inflation.
E m p l o y e e s h i r e d p r i o r t o O c t . 4, 1978, w i l l c o n t i n u e t o r e c e i v e inc r e m e n t s , the s y s t e m by which they a d v a n c e on a salary scale, while
t h o s e h i r e d a f t e r t h a t d a y w i l l p a r t i c i p a t e in a n e w m e r i t i n c r e a s e p l a n .
Merit i n c r e a s e s will be granted annually according to procedures
n o t y e t f i n a l i z e d b y b o t h p a r t i e s . O n e - h a l f p e r c e n t of t h e b a r g a i n i n g unit's total gross compensation e a c h year, however, will be targeted for
the increases.

hours, and

Health Act) Law provides a m e c h a n i s m
t h r o u g h t h e S t a t e D e p a r t m e n t of L a b o r
for e m p l o y e e s or the union to report
possible s a f e t y and health violations.
T h e l a w p r o v i d e s m e c h a n i s m s f o r ins p e c t i o n s of t h e a l l e g e d v i o l a t i o n s a n d
for having the violations corrected.
The Toxic Substances, or the Right to
K n o w L a w g i v e s public e m p l o y e e s t h e
r i g h t t o k n o w t h e d a n g e r of b e i n g e x p o s e d to c h e m i c a l s in t h e i r w o r k environment and provides e m p l o y e e s with
a m e c h a n i s m to legally refuse to work
when m a n a g e m e n t fails to c o m p l y with
the law.
CSEA COLLECTIVE BARGAINING SPECIALIST Nels Carlson,
at the Region I safety workshop, conducts the discussion of the
OSHA Law for public employees in New York State. Steve
Fantazzo of AFSCME led the discussion on the Toxic Substances
Law.
