Albert, exhaustively reviewed tJie questions a t issue. At the outset, h e noted th a t under the doctrine of Acosta v. Lang, th e petitioner was entitled to credit for an answer th a t is better or a t least as good as th e offi­ cial answer. Question 13 of w hich review was sought required th e petitioner to select one of four possible answers based upon th e postulate th a t the plain tiff in a m alpractice suit m ade one of th e defen d an t doctors h is m edical expert. In addition, th e Fund has decided not to fill two positions w hich now are vacant, th a t of building m an­ ager and assistant director of personnel. The reasons for the reduction in personnel reportedly has been attributed by Fund officials to the recent increase in salaries and retoractive retirem ent benefits which were negotiated for State employees last M arch by the CSEA. “These reasons are not founded on facts and are com pletely un­ acceptable,” W enzl said, “since fund officials consider the pre.sent economic situation to be not o f an emergency nature and admit that the Fund was n ot experiencing any pi'oblem In staying within the statutory 25 percent of In­ come allowed for administrative expenses.” Jacobs further warned that, although the Fund managem ent has given assurances that no fur­ ther action o f this type Is con­ templated, “a dangerous preced­ en t has been set, thereby threat- hard for this, and it is a major accomplishm ent,” Flaumenbauta declared.
