a k i n g advantage of em ployees eligible for retirem ent
as a m eans of econom y Is a cynical way to operate a
governm ent agency, but th a t Is exactly w hat has happened
In the S tate Insurance Fund.
Five em ployees w ith long years of dedicated service have
been notified they are being dism issed. The supposed ground
is a need to cut back on personnel but th e -*ive choices in
volved m ake it obvious th a t th e aim is to save m oney by
rem oving positions w here persons Involved do have retire
m en t incom e and w on’t necessarily be destitute and th en n ot
refilling thes jobs un til absolutely necessary.
This trifling w ith the lives o f em ployees is intolerable
and the Civil Sei*vice Em ployees Assn. h as asked rightly
th a t Governor R ockefeller veto the dism issal orders. Cer
tainly, the right to work an d th e very dignity o f th ese
public servants carries a higher priority th a n any tem porary

WHILE THE S ta te D epartm ent o f Civil Service does
n ot m ake Judicial review of its exam in atio n s easy, in reality
It should welcom e It. Judicial review Is an effective way of
educating th e C om m ission to d efects in Its fram ing of
civil service exam inations. An exam ple o f th e educative value
to th e Com mission of th e court proceeding is the recent
case of M atter o f Sies (New York Law Journal, May 28, 1968,
page 20).
JUSTICE DANIEL G. Albert, exhaustively reviewed tJie
questions a t issue. At the outset, h e noted th a t under the
doctrine of Acosta v. Lang, th e petitioner was entitled to credit
for an answer th a t is better or a t least as good as th e offi
cial answer. Question 13 of w hich review was sought required
th e petitioner to select one of four possible answers based
upon th e postulate th a t the plain tiff in a m alpractice suit
m ade one of th e defen d an t doctors h is m edical expert. The
petitioner’s choice of answ er read as follows:
B.
T he p la m tiff’s action is proper. A plaintiff in a
m alpractice action has the righ t to call as a w itness a
defen d an t doctor, th a t is, a d efen d an t physician m ay be
required to testify to facts w ith in h is knowledge—what
he actually saw and did.
T he official answer read as follows:
D. T he plain tiff’s action is proper. It has long rec
ognized th a t a party, including physicians, in a civil suit
m ay be called as an expert w itness by his adversary and
questioned as freely and fully as any other qualified w it
ness as to m atters relevant to th e issues in dispute.
JUSTICE ALBERT recognized th a t th e question was
based upon th e celebrated recent case o f M cDerm ott v. M a n
h a tta n Eye Hospital 15 N.Y.2d 20. T he official answer “D
correctly stated the r u l e of the M cDerm ott case w i t h r e s p e c t
to m edical m alpractice actions. As held by Judge Stanley H
Fuld (now C hief Judge) w riting for th e unanim ous Court of
Appeals, plaintiff m ay exam ine th e d efendant physician “with
regard to th e standard of skill and care ordinarily e x e r c i s e d
by physicians in th e com m unity under like c i r c u m s t a n c e !
and w i t h regard to w hether his conduct conform ed t h e r e t o ,
even though su ch questions call for th e expression of
expert opinion.”
JUSTICE ALBERT n oted th a t answ er “D ” erred 1
sta tin g th a t th e rule was “long recognize.” The M c D e r n i o t i
case was decided as recently as November 25, 1964 am
established a new doctrine. Furtherm ore, as o b s e r v e d b:
Justice Albert, there is no reason to assum e th at tlii
doctrine is as broad as answ er “D ” states in extending it
any civil suit instead of lim itin g th e rule to m edical malj
practice actions.
FOR THE reasons stated, Justice Albert found th at QU^s

If you refuse to drive o Volkswagen becau se it
Isn’t fancy enough, that's for you to decide.
But if you refuse to drive a Volkswagen becau se

W e call this new option the automatic stick shift.
And In true Volkswagen fashion, a bug with an
automatic stick shift will deliver up to 25 miles on a
gallon o f gas, use very little oil, and nary a drop o f
w ater or antifreeze.
But just b ecause w e ’ve made it ea sy to drive,
d o e sn ’t mean w e ’re about to make it any prettier/
O r any bigger, o r any fancier. So w e Imagine som e l
p e o p le will still refuse to drive Volkswagens . j

T he m anagem ent o f the Fund
informed Jacobs th at the Jobs will
be abolished, efefctlve July 17.
The action affects three doctors
in th e m edical departm ent and
two associate attorneys in the
legal department, Jacobs said. In
addition, th e Fund has decided
not to fill two positions w hich now
are vacant, th a t of building m an
ager and assistant director of
personnel.
The reasons for the reduction
in personnel reportedly has been
attributed by Fund officials to the
recent increase in salaries and
retoractive
retirem ent
benefits
which were negotiated for State
employees last M arch by the
CSEA.
“These reasons are not founded
on facts and are com pletely un
acceptable,” W enzl said, “since
fund officials consider the pre.sent
economic situation to be not o f an
emergency nature and admit that
the Fund was n ot experiencing
any pi'oblem In staying within
the statutory 25 percent of In
come allowed for administrative
expenses.”
Jacobs further warned that,
although the Fund managem ent
has given assurances that no fur
ther action o f this type Is con
templated, “a dangerous preced
en t has been set, thereby threat-
hard for this, and it is a major
accomplishm ent,”
Flaumenbauta
declared.
Flaumenbaum
complimented
Nassau County E xecutive Eugene

vice-chairm an o f the Board of
Supervisors, for assuring bi-par
tisan support of the measure
Nassau had been quick to adopi
the l/8 0 th retirem ent plan aft«r
its initial approval by the LeRisture last year, but th e plan then
was retroactive only to 1980. Ths
new legislation covers service back
to 1938.
Also in Nassau County, the Towq
of Hempstead was expected to
adopt the retroactive retirement
plan either June 25 or July 9. U
would cover 2,100 additional em.
ployees.
