C ALL CO LLECT, Schultz declared th a t the PE rb decision “because It arbitrarily divides the university faculty into two groups, ia neither In the in terests of the instructional staffa nor the university community.” Schultz noted th a t the board, on April 25, 1966, had adopted a resolution stating th a t It “has not been and Is not opposed to the principle of collective bargaining for its instructional staff.” The PERB tw o-unit ruling, he asserted, “would not only be det rim ental to long-range collective bargaining relationships In the university, it would be Inconsistent with recent attem pts, in industry and private employment, to unify ra th e r th a n fragm ent groups of employees who negotiate with a common employer.” Schultz pointed out th at, If al lowed to stand, the PERB decision could lead to two separate and competing faculty organizations on each of the 16 campuses of the City University. “It would be a n obstacle to orderly collective bargaining,” he said. The members of the board’t Committee on Collective Bargain ing other th a n Schultz, an atto r ney, are George D. Brown, an architect, and Dr. Frederick H. B urkhardt, president of the Amer ican Council of Learned Societies. Board chairm an, Porter R. Chand ler, also an attorney, is an ex officio member of the committee. The committee retained Morris Lasker as its counsel in the PERB proceedings. The PERB decision grew out of a petition filed last November by the Legislative Conference of the City University of New Yorlc, a faculty organization which re quested State certification as "the exclusive- negotiating representa tive for all members of the in structional staff of the Board of H igher Education.” Subsequently the United Federation of College Teachers, an affiliate of the American Federation of Teachers, APL-CIO, Intervened with PERB with a similar claim for exclusive bargaining rights.; Hearings on the case were con ducted in February, and March. A total of 9,005 Instructional staff members are emplqyed,by CUNY, according to a listing of faculty members filed with PERB by the Board of H igher Education. The PERB decision was written by Paul E. Klein, director of rep resentation. T he appeal will go to the full three-m em ber PERB board. or Use Zip-Codes your m a i l . w r ite Professional Recruitment Division Nam e___________________________________________________________________ (2 1 2 ) 5 6 6 -2 9 9 0 Home A ddress. New York polls are now wonder ing w h at m ig ht h ap pen to H um ph rey if he h a d chosen to enter the prim ary fights. And they are looking to th e D istrict of Colum bia prim ary a« a guide, since the K ennedy slate r a n f a r ahead of th e H um phrey delegates. T h e reasoning continues, th e re fore, th a t these trium p hs make It clear th a t if tiie people have the power to choose th e Democratic nominee, th e K ennedy personality is m ore appealing th a n those of his rivals. Clearly, this Is w hat R F K m ust have had in m ind when he stressed In his original a n nouncem ent th a t he would seek th e nom ination—and repeated oftlm es since—th a t he-w ishes n o th ing on a silver p la tte r b u t would go to th e people and fig h t for the D em ocratic P residential candid acy. No politician can ignore his constituencies — no m a tte r how pow erful or secure he m ay be— an d the K ennedy personality can win w ith th e people. In retrospect, political analysts are looking a t th e n atu re of the In d ia n a an d D.C. cam paigns more th a n a t th e vote totals. His them e in cam paigning has been th a t th e g reat rift In the LEGAL th e arm -tw isting, backroom deal ing type, b u t in th e sm all town* and on th e city squares across the land. country Is n o t between rich and poor, b u t between different ele m ents of those In lower-lncome groups w ith the greatest tension of all between the Negroes In the ghettos and th e ir working-class white neighbors — especially the eth nic minorities. Apparently the K enendy them e struck home be cause it was precisely In th e Negro w ards and th e very w hite sections In w hich George W allace did so well in during 1964 th a t he won handily. In this m a n n er he apparently n ot only overcame the common slander an d inside-fighting of a political n atu re , but achieved som ething even more profound. The people seemed to have voted for K ennedy because they sensed he understood th eir problems— and th a t he really cares. At least t h a t’s w hat K ennedy Insiders are now saying in th eir reports, which Indicate th a t the people believe he will do som ething about the prob lems of the “poor and oppressed” w hether they are In the New York ghetto or the hills of eastern K en tucky. T he m oral derived from these facts appears to be plain: If the greatest problem of this country Is th e tension and lawlessness which springs from hostility and suspicion, th en R F K has the per sonality to gain th e tru st of the people, and w ith this political magic could appeal to win th e votes of all th e people and conse quently heal the n a tio n ’s wounds. $2.50 per hour CALL MR. lANKS 765-3747 F O R R E L IE F S P R IN G O F P O L IC E E N T R A N C E P O L L E N MANHATTAN: Mondays a t 1:15, 5:30 or 7:30 P.M. S tate Legislature naade available to e it h e r correct or provide these clgns is n o t being put to work fast enough. WORSE STILL, the m ost flag r a n t offenders are private high way contractors, certainly not the civil servants in highway d ep art m en ts or traffic commissions. FOR EXAMPLE, some of the tem porary signs erected by the contractors Improving the Long Islan d Expressway are so o u t rageously dangerous a t night, It would make sense to park an am bulance n ear each such a sign. IMAGINE A sign — the green ©nes especially—so totally reflectorized th a t a t n ig h t it blinds you! A pparently no one told the con trac to rs’ vice - presidents - In charge-of-signs th a t only the let ter* and the direction arrows •hould be printed in luminescent paint. T he rest of the sign area should not, under any circum stances, reflect any light. WHAT MAKES us equally m ad Is th a t so m any motorists as o u t raged as we are about these signs, unjustly blame "those civil service workers.” In a previous column on the highway “numbers gam e” we com plained about precisely the same thing. T he culprits, th en as now, were th e private contractors, who are seemingly unanswerable to anyone or anything—n o t even to the simple rules of common sense. ON THE government front, we are plea£ed to report some prog ress. True, we w ant things to happen quickly. But we also know there are problems, not the least of which Is money—an overhead sign totally spanning one of the new highways costing a t least $7,500, sometimes more. T h e Board acted on final am endm ents to the plan a t a m eeting here la st week. T he basic plan h ad been subm itted to the Legislature several weeks ago. U n der it, a teacher would receive half-pay retirem en t afte r 25 years of service and would be able to retire afte r 30 years of sei-vice or a t age 55. Also Included in th e plan is a unique supplem entary pension concept which would achieve im m ediate parity of benefits between veteran teachers approaching re tirem en t and fu tu re retirees, by Increasing th e pension of teachers retiring during th e next eight years. H arold N. Langlitz, executive director of the system, explained th e supplem ental ad ju stm en t as "a n effort on th e B oard’s p a rt to provide members retiring during the next few years with a re tire m en t allowance geared to the ree d s of cu rren t living costs." Basic benefits of th e new plan would be retroactive to 1959 for all present members of the system. For service prior to 1959, benefits would be calculated u n der the present dual-contributory plan. D eath benefit, vesting, and dis ability retirem ent features of the present p lan also are improved u n der th e proposal subm itted to the Legislature. A new d eath benefit feature would give beneficiaries of m em bers who die before they are elig ible to retire a m axim um of four years’ salary a fte r 24 years of A tenative school construction program for 1969-70 calling for a record expenditure of $385.45 mil lion in capital budget funds was m ade public la st week by Super inten dent of Schools Dr. B ernard E. Donovan. I t provides, among other things, for expansion of Board of E ducation plans for edu cation parks and comprehensive high schools. Of the $385.45 mUlion $292.45 is for the construction of 56 new projects; $83 million Is for sites, plans, modernizations, pre-kinder garten centers, playgrounds, port able classrooms and other Items, and $10 million for the completion of projects now under construc tion. Dr. Donovan said the program is broader in scope th a n the con struction program s of recent years because of deep cuts in school building funds this year and other factors. He said this year’s budget was about $75 million below the $167 million average of the last five years when his proposed building program was prepared. However, about $30 million h as since been restored to this year's construction program through action by the City Council overriding reductions ordered by Mayor Lindsay.
