NORTH PENN SCHOOL DISTRICT Administrative Regulations 3731 BUSINESS AND NONINSTRUCTIONAL OPERATIONS New Construction Work Classifications and Required Action The school district will comply with the various advertising and bidding requirements of Sections 731 and 751 of the school code. (1) PDE approval is required for any work involving construction, structural change, work which may affect safety or health, and work which requires the approval of another state agency such as Labor and Industry or the Department of Environmental Resources. Ordinary repairs, such as those listed on the chart, do not require PDE approval if the entire cost of labor and material for such work is less than $15,000. (2) Work may occur without advertising or soliciting bids if the value of labor and material is under $4,000. (3) Work with a value between $4,000 and $10,000 may be contracted without advertising. In such cases, the district must still prepare plans and specifications and must solicit bids from at least three responsible bidders. (4) Work with a value of more than $10,000 must be advertised, except in emergency situations. In such cases, plans and specifications must also be prepared. (5) Work performed by district maintenance staff is limited to labor and material costs that are less than $5,000 per project. For routine maintenance work such as care, cleaning, servicing and refinishing of surfaces, equipment, and property, there is no dollar limit. PDE approval is required for emergency work. The normal process is to call PDE to gain verbal approval to proceed. PDE can waive the requirements for advertising. The school district must still develop plans and specifications and, for work of a value over $4,000, must solicit bids from at least three responsible bidders.
