Advertiser/Sponsor – means the individual or entity listed on the front page of the agreement. 3. Advertising Rate – The Advertiser/Sponsor will select an option from the sponsorship program. The rate will be determined by the sponsor’s program selection in the agreement. 4. Advertising Space – means the space reserved for the advertisement. 5. Prices – Sponsorship program costs as stated. All amounts are payable to North Penn School District. 6. Right to refuse unacceptable advertising – The District reserves the right to refuse any advertisement that violates North Penn School District Policy 2603. The District may request changes to advertisement it deems unacceptable. 7. Responsibility of Copy – The Advertiser/Sponsor agrees to indemnify and save harmless the District and its representatives from any liability, loss and expense of any nature arising out of the display of any banner. 8. Start Date – means the first date the Advertisement appears on/in the advertising space (when applicable). 9. Term Guarantee – The District guarantees that the advertising space specified on this agreement will be available for the length of time stipulated herein, according to North Penn School District Policy 2603. 10. Renewal of advertisement – After entering into this agreement, the Advertiser/Sponsor may request a renewal of advertisement (when applicable). A renewal of the advertisement space will constitute a termination of this agreement and a commencement of a new agreement at the rates and on the terms in effect at the time of the renewal. The Advertiser/Sponsor may not request a downgrading of advertising space during the tenure of the agreement. Any requested change must be received in writing. 11. The Advertiser/Sponsor is responsible to send payment with a signed agreement to the North Penn School District at the time of acceptance, afterward the advertisement will be displayed as noted. 12. School board Approval – All Advertising Agreements are subject to final approval by the Board of School Directors of the North Penn School District. Required Advertiser Signature The individual signing below represents and warrants that he/she is authorized to sign this Agreement on behalf of the Advertiser and to bind the Advertiser to the provisions of this Agreement (which include District Policy 2603 incorporated herein by reference as set forth above).
