This document has been prepared and agreed within the framework of CEPT. During the past year there has been a situation in which the bringing into use of frequencies to a satellite network has resulted in some problems. This arose as a result of a satellite being tested for a few days at one orbital position and then moved to another orbital position. The testing at the first position was then used to indicate compliance with the date limits of the RR for the bringing into use of frequencies and thus avoid the consequential lose of protection for frequencies and the network concerned. While the term ”date of bringing into use” is not defined in the RR, the closest phrase that exists in the RR is in No. S13.13 which relates to a review by the BR and this provision uses the term “regular operation in accordance with the notified characteristics” is used. Moreover, in at least one administration, the testing for a short period of time does not comply with the national requirements to bring the frequencies into service by a certain date limit. This issue is to be considered under Res. [COM5/17] Minneapolis 98 [and is also raised in the report of the Director BR (Doc. [xxx] para. [xxx] to WRC-2000.] 2. One question that has been raised is whether there should be some flexibility. However, it is to be noted that the Radio Regulations (1998 version) clearly indicate that the procedures for the API, coordination and notification of Satellite networks should not start before 5 years in advance of the planned “in-service date” (No. S9.1). In addition, these Regulations provide for the extension of this “in-service date” by up to two years under certain circumstances such as launch problems and satellite design problems (Nos S11.44C to S11.44I). The Radio Regulations seem to provide sufficient flexibility to deal with problems that may arise in the implementation of satellite networks so that planned satellite can be brought into use within either the original 5 year period or the 7 year extended period as provided for in the RR. If too much flexibility were provided in the Regulations then the intent of these changes would be lost. 3. It is proposed to modify App. S4 Annex 2A, item A2 (the explanation of the date of bringing into use) as follows as well as similar changes to Annexes of App. S30/S30A/S30B: MOD 626082413 a) The date (actual or foreseen, as appropriate) of bringing the frequency assignment (new or modified) into use. . The date of bringing into use is the date the frequency has been brought into regular 31/05/16 2 operation to provide the published Radiocommunication service with the technical parameters within the ranges of the technical characteristics notified to the Bureau. Whenever the assignment is changed in any of its basic characteristics (except in the case of a change in item A.1 a), the date to be given shall be that of the latest change (actual or foreseen, as appropriate).
