Terms and Conditions: 1. The promoter of this Competition is University College London of Gower Street, London WC1E 6BT (“UCL”). 2. The Competition information [http://www.ucl.ac.uk/african-studies/african-voices] form part of these Terms and Conditions. By submitting an entry to the Competition you are agreeing to be bound by these Terms and Conditions (including, without limitation, the Competition Rules). 3. The Competition is free to enter. 4. The Competition is open to amateur, but not professional photographers. 5. The competition will start on September 1st 2015 Entries must be submitted by 11.59:59pm (GMT) on Tuesday 1st December 2015 (“Closing Time”). All entries received after the Closing Time are automatically disqualified. 6. To enter, send a .jpeg image (not more than 2MB,) to AfricanVoices@ucl.ac.uk . If your image is selected for exhibition, we will contact you for a higher resolution image, using the email address you provide with the Competition entry. You should also provide: Your name, email address and university affiliation. Your acceptance of the Term and Conditions of the competition. A short text document describing the photograph. What is the story of the image? Who or what is in the picture? If the image is of an identifiable person they must give consent for their image to be used (download a consent form here).What is the story of the image? Word limit: 100 words in Swahili, French or English. Images without the above information will not be considered. 7. All entrants must be able to supply a high resolution image suitable for printing in exhibitions should the image be required. 8. Entries will be judged between the 1st December 2015 and the 31st December 2015. 9. Winners will be notified by email on or by 4th January 2016, using the email address provided with their Competition entry. The decision of the judges is final and no correspondence or discussion will be entered into. 10. A list of names of the judges can be viewed at [http://www.ucl.ac.uk/african-studies/africanvoices] from the Closing Time for a period of 30 days. 11. UCL will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 60 of days of being notified of being a winner via email by UCL, UCL reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Time for the Competition. UCL does not accept any responsibility if you are not able to take up the prize. 12. Each entrant can submit up to three images. The images can be entered in different categories or all images can be entered into a single category. Judging will be based on the individual images and not on series of images. 13. UCL will not accept: a. responsibility for Competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or b. proof of transmission as proof of receipt of entry to the Competition. 14. We reserve the right, at our sole discretion, to disqualify and remove any entry that does not comply with the following requirements, even after the entry is submitted. You warrant and represent, in respect of each entry submitted by you (“Entry”), as follows: a. You are the sole owner and author of each Entry; b. You have the right to make your Entry available to the Competition; c. In respect of each Entry with any identifiable human subject in the image, you have obtained the consent from the subject in question to the use of their image (consent forms available here). Where the third party image is of a person under 18 years of age, you have obtained parental or guardian consent. In the event of a complaint being made by a subject in a photograph that their consent was not given, UCL will endeavour to remove the image from display as quickly as possible. Responsibility for gaining consent rests with you. You will produce evidence of any required consents at UCL’s request; d. Each Entry is an original work and does not contain any infringing, threatening, false, misleading, abusive, harassing, libellous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content; e. There are no conflicting agreements in place that restrict usage of any of the Entries; f. Each Entry does not contain any material that could constitute or encourage conduct which would be considered a criminal offence, give rise to civil liability, or otherwise violate any law; g. Each Entry does not infringe upon the copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or violate any person’s rights of privacy or publicity, and your Entry does not include: i. trademarks owned by third parties where this might be considered unfair use; ii. copyrighted materials owned by third parties (including movie dialogue or musical compositions); iii. names, likenesses, voices or other characteristics identifying celebrities or other public figures, living or dead; iv. commercial content that promotes any product or service other than that of UCL; or v. screen credits. 15. You agree to fully indemnify UCL in respect of all royalties, fees and any other monies owing to any person by reason of your breaching any of the foregoing. 16. You confirm that each person depicted in the Entry has granted permission to be portrayed as shown. Any costumes, props or other materials used must be rented or borrowed with the permission of the owner, and all other relevant permissions must have been obtained. (Consent forms available) 17. In entering the Competition, you confirm that you are eligible to do so and eligible to claim any prize you may win if successful.. To be eligible you must be a student or staff member at University College London or a student or staff member at a University on the African continent. To be eligible you must have access to the internet and have a personal e-mail address. If you are a staff member your employer’s consent is not required by UCL for you to enter the competition. 18. If you are under 18, you must have written parental or legal guardian consent to participate in the Competition and (if successful) to claim your prize. 19. If we do not receive a valid signed parental or legal guardian consent form for any winner under the age of 18 within 30 days of the contestant being declared a winner we will be entitled to reverse the winning selection and select an alternative winner from among the remaining contestants. 20. We recognise that you, the author of the image, retain full ownership of the copyright in each Entry you submit. 21. You agree that UCL may, but is not required to, make your Entry available in relation to and use and display your Entry for the following purposes and you hereby grant to UCL a nonexclusive, worldwide, irrevocable, sub-licensable licence, for a period of five years from 30 November 2015, to use, display, publish, transmit, copy, edit, alter, store, re-format and sublicence the Competition Entry for such purposes: a. judging the Competition b. displaying the winning entries and runners up at public exhibitions promoting UCL c. inclusion within UCL’s websites d. inclusion within any materials promoting the Competition and / or any exhibition organised by UCL, in the promotion of UCL e. sub-licencing the Entries to the press for reproduction in connection with the Competition and any exhibition 22. UCL shall use reasonable endeavours to ensure that any entry used by UCL shall carry a credit line. Any failure to provide such credit line shall not be deemed to be a breach by UCL, as long as UCL uses its reasonable endeavours to rectify such failure within a reasonable period from the date of notice of such failure. 23. You acknowledge that it is your responsibility, where possible or appropriate, to protect any Entry against image misuse by any third party. UCL will also use its reasonable endeavours to protect any Entry against image misuse by a third party. 24. You agree to participate in Competition related publicity and for UCL to use your name, image and town or country of residence for the purposes of advertising, promotion and publicity without additional compensation and (if you are a winner of a prize) for the purposes of announcing the winner. 25. There are no cash alternatives available for the prize winner. The prizes will be posted or couriered to the winners. The competition organisers will bear the costs of postage. There will be five prizes only: An overall winner, a tablet computer to the value of £250 One Best in Category (Global Health) photographic or similar equipment to the value of £100 One Best in Category (Intercultural Interaction) photographic or similar equipment to the value of £100 One Best in Category (Sustainable Cities) photographic or similar equipment to the value of £100 One Best in Category (Human Wellbeing) photographic or similar equipment to the value of £100 26. Winners will be announced online. UCL will send the name and county of the winners to anyone who writes within one month after the Closing Time of the Competition requesting details of the winners and who encloses a self-addressed envelope to the address set out in condition 1.1. 27. Insofar as is permitted by law, UCL, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of UCL, its agents or distributors or that of their employees. Your statutory rights are not affected. 28. If there is any reason to believe that there has been a breach of these Terms and Conditions, UCL may, at its sole discretion, reserve the right to exclude you from participating in the Competition. 29. UCL reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so. 30. These Terms and Conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
