Dear Mayor Hussa:
On behalf of the Highlands Water Protection and Planning Council (Highlands Council), I am pleased to
advise you that Denville Township’s Petition for Plan Conformance is herewith deemed Administratively
Complete. This determination includes issuance of waivers from submission requirements with respect to the
specific items listed below. Please be advised that within 10 days of the date of this letter the Highlands
Council will post the complete Petition on the Highlands Council website at:
www.highlands.state.nj.us/njhighlands/planconformance.

As currently submitted, Denville Township’s Petition for Plan Conformance involves solely the Preservation
Area, which encompasses a very small area of land (approximately 7 acres) located within the immediate
vicinity and floodplain of Beaver Brook, a Category One (C-1) stream. It is unlikely that this area could be
developed due to existing NJDEP stormwater management and Flood Hazard Area Control Act regulations.
In keeping with these circumstances, the following submittal requirements have been waived. The full list of
normally required items may be found in the Instructions document provided for the Highlands Council Plan
Conformance Grant Program (Module 7).

a. Module 6: Highlands Land Use Ordinance – Track Changes Version
3. List of Current Municipal Planning and Regulatory Documents (Item #8)
4. Please note that the following submittal items remain discretionary: Additional Supplemental
Materials (Item #10), RMP Updates (Item #11) and Map Adjustments (Item #12). Items #4 and #5
from the Instructions document are not applicable to Denville Township.
Please be advised that a finding of Administrative Completeness does not preclude the Highlands Council
from requesting additional information, should it prove necessary during the process of substantive review, to
clarify, complete, correct, or modify a Petition in the interest of ultimately achieving Plan Conformance.
We understand that Denville Township rescinded the Petition for Plan Conformance for the Township’s
Planning Area. The documents submitted by the Township would substantially satisfy the requirements for
Plan Conformance for the Planning Area, however. Please be aware that we would be happy to meet with the
