National Emission Standards for Hazardous Air Pollutants for Area Sources:
Industrial, Commercial, and Institutional Boilers, 40 CFR 63 Subpart JJJJJJ (GACT 6J)
Dear Owner/Operator:
Your facility has been identified by Mecklenburg County Air Quality (“MCAQ”) from permitted air
pollution source and registered boiler databases as possibly being subject to the new federal regulation 40
CFR Part 63, Subpart JJJJJJ – “National Emission Standards for Hazardous Air Pollutants for Area
Sources: Industrial, Commercial, and Institutional Boilers” (“Subpart 6J”). Please read the enclosed
information, complete and return the enclosed Subpart 6J Initial Notification Form by September 17,
2011, as required by the regulation.
Applicability
On February 21, 2011, the US Environmental Protection Agency (“EPA”) promulgated Subpart 6J. The
rule affects boilers that burn coal, oil, or biomass materials located at minor or area sources that emit
hazardous air pollutant(s) (“HAP”). Existing facilities subject to this regulation are required to:
 submit an initial notification no later than September 17, 2011; and
 comply with certain emission limits, work practice standards, emission reduction measures, and
management practices listed in the regulation as soon as March 21, 2012.
A HAP area source means any stationary source that emits or has the controlled potential to emit, in the
aggregate, less than 10 tons per year of any single HAP or less than 25 tons per year of any combination
of HAPs.

Notification is required as well if you determine Subpart 6J does not apply to your facility. Complete
pertinent sections of the form, sign the certification statement indicating that the rule does not apply and
return the form.
It is very important that you understand this environmental regulation and comply with all requirements.
Failure to comply with 40 CFR 63 Subpart 6J can result in enforcement actions by MCAQ. If you have
