(TTC Board of Directors approves and publishes IPR Policy.) • Operation Procedures specify detailed procedures regarding IPR Statements and their maintenance, including IPRs owned by non-members. Geneva, October 9, 2012 8 GSC16bis-IPR-09 Submission of IPR Statements in TTC • DB for IPR Statements available at TTC Web • For TTC Standards 155 (1988 – Oct. 2012) • For TTC Technical Specifications 30 (2001 – Oct. 2012) • (Note) Here, “IPR” stands for Industrial Property Right. 9 Geneva, October 9, 2012 GSC16bis-IPR-09 Outline of the revision of operation procedures in Dec. 2007 • Almost all changes are editorial improvements. • Reviewed the structure and order of chapters. – Basically maintained, however enhanced the nonmember's chapters for clarification. • Enhanced descriptions: – clarification of subject (member or non-member) – adoption of detailed explanation or expression. 10 Geneva, October 9, 2012 GSC16bis-IPR-09 Outline of the revision of Provision of IPR Committee in May. 2009 • Stipulated capacity and power of IPR committee • Stipulated qualification of committee membership and special committee membership • Stipulated eligibility, right of vote, quorum and election system 11 Geneva, October 9, 2012 GSC16bis-IPR-09 Alignment with ITU-T patent guidelines • Discussions on enhancements to TTC IPR guidelines to incorporate recent enhancements made in ITU-T – Patent statements could be submitted with different options per patent claim – TTC has completed draft enhancements and had been waiting for the formal decision in ITU-T/ITU-R/ISO/IEC (Ready now!) • Different interpretations when no patent information (which is desired but not required) submitted associated with the ITUT/ITU-R/ISO/IEC common patent statement – All essential patents owned by the patent holder for the Rec. will be negotiated based on RAND, etc. – Apart from one or more essential patents to be negotiated based on RAND, etc., patent holder reserves the right to differently declare in subsequent statements regarding other patents in the future – TTC has submitted a contribution to the ITU-T IPR Adhoc. 12 Geneva, October 9, 2012 ITU-T’s Software Copyright Guidelines GSC16bis-IPR-09 • TTC submitted a contribution to assure that SDOs can distribute software contained in Recommendations to their members (in item b of Annex B). • The contribution was accepted with a slight modification. 13 Geneva, October 9, 2012 GSC16bis-IPR-09 Handling of copyright in TTC • Handling of copyright revised in Feb. 2012. • Clarified the handling of copyright for the documents received from TTC members as well as third parties outside TTC. • Clarified definition of terms such as “TTC members” and “programs” 14 Geneva, October 9, 2012 GSC16bis-IPR-09 APT IPR Policy • TTC has contributed to APT in developing its first IPR policy. • APT IPR policy has been aligned with that of ITU-T. • NTT, a member of TTC, volunteered to provide an editor for further alignment in the future. 15 Geneva, October 9, 2012 GSC16bis-IPR-09 oneM2M • TTC has become a type 1 member of the oneM2M. • TTC IPR Committee has reviewed its IPR policy and made comments in terms of alignment with IPR policies of ITU-T and TTC. • TTC IPR Committee will continuously monitor the progress of the forum, in particular, of its IPR policy. 16 Geneva, October 9, 2012 GSC16bis-IPR-09 Further Study Items • Study on possible introduction of Software Copyright Guidelines and Trademark Guidelines. • Study on complex IPR cases and possible revisions to the Policy and the Operation Procedures. • Contribution to the study on Standardization and IP strategy. • Discuss and promote TTC members’ needs. ・・・License of Right, Restriction for execution of declared patent rights 17 Geneva, October 9, 2012 GSC16bis-IPR-09 TTC’s IPR policy, guidelines, etc. are shown in the following website http://www.ttc.or.jp/e/intro/rules/ru6/index.html Thank you !
