Symczyk on the issue of whether Rule 68 Offers of Judgment can be used to "pick off" the named plaintiff in order to obtain dismissal of a class action as moot under the Fair Labor Standards Act. We'll present a first look at the oral argument and discuss the legal, tactical and practical issues surrounding the use of Rule 68 to defend class actions.
