בס''ד הסכם לימודים הסכם זה (להלן" :ההסכם") ,כולל המסמכים והמדיניות הכלולים והמוזכרים בהסכם זה ,יקבע את הקשר בין החתום מטה (להלן" :התלמיד") לבין ( Michigan Jewish Instituteלהלן )"MJI" :לתקופת הלימודים של התלמיד בתוכנית להלן. שנת הלימודים תשע"ו – שכר לימוד ועמלות הטבלה להלן מראה את גובה שכר הלימוד לתוכניות השונות המתקיימות בשנת הלימודים תשע"ו .את שכר הלימוד יש לשלם במלואו בתחילת כל סמסטר, למעט מקרים של הסכם תשלומים חלופי מיוחד שאושר בכתב ע"י .MJIניתן לשלם באמצעות המחאה לפקודת MJIאו בכרטיס אשראי (ויזה ,מאסטרקארד, או אמריקן אקספרס) MJI .שומרת לעצמה הזכות לשנות את שכר הלימוד לסמסטרים הבאים ללא הודעה מוקדמת. תעריף שכר לימוד לפי תוכנית לימודים יש לסמן כאן את התוכנית שבחרת תוכנית תואר ראשון במדעים שימושיים (בכל המגמות) , 1בהיקף של פחות מ 9-נ"ז לסמסטר לימודים בינלאומיים במסגרת ( BASבכל המגמות) ,לשנה א' וב': לתושבי ארה"ב ואזרחי ארה"ב שאינם תושבי ארה"ב לימודים בינלאומיים במסגרת ( BASבכל המגמות) ,מהשנה השלישית ואילך :לתושבי ארה"ב ואזרחי ארה"ב שאינם תושבי ארה"ב קבוצת BASמיוחדת מס' 1 ) – (BASSC1כל הלומדים בהיקף של פחות מ 9-נ"ז בסמסטר א' או ב' של שנת הסיום שלהם יחויבו בשכר לימוד לפי מספר נ"ז .תלמידים בקבוצה זו פטורים מדמי סיום לימודים ומתשלום על מבחנים מסויימים. הערה :התלמידים אינם פטורים מדמי התוכנית החדשה .ברם ,תלמידים שעוברים לתוכנית שונה במהלך הסמסטר לאחר תקופת השינויים בהרשמה לקורסים ,יחויבו בשכר לימוד ועמלות התוכנית החדשה רק בתחילת הסמסטר הבא. סמסטרים מקבילים של \MJIלימודים בינלאומיים .בסמסטרים מקבילים ,תלמידי MJIלומדים במוסד הלימודים שלהם בארץ ובו-זמנית ב .MJI-במתכונת הרגילה, תלמידים בסמסטרים מקבילים רשומים לארבעה קורסים :שני קורסים פרונטאליים במוסד הלימודים שלהם בארץ ,ושני קורסים מקוונים ב .MJI-תוכנית התעודה בלימודי הלכה (קבוצה מס' )3גם פועלת במתכונת זו. מדיניות החזר שכר לימוד מדיניות החזר שכר הלימוד חלה במידה שווה על כל תלמיד ללא קשר לאופן או מקור תשלומי שכר הלימוד שלו .הערה: חישוב ההחזר הכספי של מענק הלימודים לפי סעיף ד' לחוק השכלה גבוהה של ארה"ב שונה מהחישוב של ההחזר הכספי של .MJIמדיניות ההחזר של סעיף ד' קובעת את הסכום שרשאי המוסד לשמור .מדיניות ההחזר של MJIקובעת את גובה שכר הלימוד ועמלות שהתלמיד חייב ל .MJI-לפרטים נוספים אודות מדיניות החזר כספי המענק לפי סעיף ד' לחוק השכלה גבוהה של ארה"ב ,עיין בקטלוג האקדמי ומדריך לתלמיד של .MJI מדיניות החזר שכר לימוד בגין הפסקת לימודים: מדיניות זו חלה רק על מקרים של הפסקת לימודים מוחלטת מכל הקורסים בסמסטר מסוים .לאחר היום הראשון ללימודים, תלמידים בני 18שנה ומעלה או ההורים\אפוטרופוסים של קטינים (תלמידים בני 17ומטה) מתבקשים להגיש טופס הפסקת לימודים בכתב .את הטופס ניתן להגיש באופן אישי ,באמצעות דואר רשום ,או בדוא"ל לכתובת .Registrar@mji.eduללא הודעה בכתב ,היעדרות לא מוסברת בת ארבע שבועות ברצף מכל הקורסים תיחשב להודעה על הפסקת לימודים מאותו סמסטר ב .MJI-תלמידים הזכאים למלגה הנעדרים מהלימודים למשך שבועיים ( 14יום) ברצף (ללא הסבר מוקדם ל)MJI- מעמידים בספק את זכאותם למענק לימודים לפי סעיף ד' בחוק להשכלה גבוהה של ארה"ב .במקרה של צורך בהחזר שכר לימוד, ייקבע ההחזר לפי הנוכחות שנקלטה במערכת תוך 45יום מהתאריך בו קובעת MJIשהתלמיד הפסיק את לימודיו. מדיניות החזר שכר לימוד בגין היעדרויות תלמידים המשתתפים בקורס ומפסיקים להשתתף ללא הודעה בכתב על הפסקת לימודים יונשרו מינהלית ( .)WUתלמידים אשר לומדים בלימודים מקוונים בלבד במהלך הלימודים ב MJI-ואשר נעדרים לתקופה של 14יום ברציפות יונשרו מ MJI-באופן רטרואקטיבי מהתאריך האחרון של השתתפותם בקורס .נהלי הנוכחות החלים על כל שאר התלמידים הם כדלהלן :כעבור ארבע שבועות רצופים ללא נוכחות בקורס ,ייקבע החזר שכר הלימוד לפי הנוכחות שנקלטה במערכת תוך 45יום מהתאריך בו קובעת MJIשהתלמיד הפסיק את לימודיו. מדיניות החזר שכר לימוד בגין נשירה מקורס בקורסים הנמשכים 15שבועות MJI :מאפשרת לתלמידים להוסיף או להסיר את הקורס ללא קנס למשך 10ימים מתחילת הקורס ,שזה טווח זמן הקרוי "תקופת השינויים בהרשמה לקורסים" .בקורסים המרוכזים :תקופת השינויים בהרשמה לקורסים נמשכת 7ימים ,בה ניתן לנשור מהקורס ללא קנס .תקופת השינויים בהרשמה לקורסים מתחילה עם פתיחת הקורס .לתלמיד הרשום לקורסים שמתחילים בתאריכים שונים בתוך אותו סמסטר יהיו כמה תקופות שינויים שונות בתוך אותו סמסטר .תלמידים הנושרים מקורס בתוך תקופת השינויים לא יחויבו בשכר לימוד או עמלות לימודים בינלאומיים בגין אותו קורס .באם תלמיד מפסיק את לימודיו לאחר שהיה נוכח בקורס ולאחר תקופת השינויים ,תחול מדיניות החזר שכר לימוד בגין הפסקת לימודים. הערות נוספות בעניין החזרים כספיים: .1בתוכניות עם שכר לימוד קבוע ,כגון לימודים בינלאומיים ,קבוצה מס' 2ללימודי הלכה וקבוצה מיוחדת מס' 1 לתוכנית ,BASלא קיימים דמי הרשמה ורישום .אי לכך ,אין החזר של דמי רישום והרשמה לתלמידים המפסיקים את לימודיהם בתוכניות אלו. 160204 1800Y בס''ד .2לשאר התוכניות שקיימים בהן דמי רישום והרשמה ,מדיניות ההחזרים היא כדלהלן: א .אין החזר של דמי ההרשמה ( ,)$50ללא יוצא מן הכלל. ב .אין החזר של דמי הרישום ( $50 הרשומים. התקופות המצוינות בטבלה מתחילות לאחר תקופת השינויים הרלוונטית. הודעה לתלמידים חדשים וחוזרים: .1אין לחתום על הסכם זה קודם קריאתו ,או אם נמחקו בו פרטים. .2זכותכם לעיין ולהדפיס עותק מדויק של הסכם זה וכל דף גילוי נאות שנחתם על ידכם בפורטל התלמיד של ,MJIשכתובתו .https://portal.mji.edu/student/login.aspתדפיס של החוזה התקף והחתום יסופק לכם לפי בקשתכם. .3הסכם זה והקטלוג האקדמי של MJIמהווים את כל ההסכם כולו בעניין ההתחייבות הכספית כין התלמיד ל.MJI- .4למרות הסיוע שמגישה MJIבהשמת בוגריה ,אין MJIמתחייבת למצוא לבוגריה מקומות עבודה לאחר סיום תוכנית הלימודים .תואר או תעודה מ MJI-עשויים להיות כפופים לאישור גופים ממשלתיים או רגולטורים לצורך הכרה במדינות שמחוץ לארה"ב MJI .אינה מבטיחה כי אף תעודה או תואר המוענק ע"י MJIיוכר או יאושר על ידי אף ממשלה מחוץ לארה"ב. MJI .5שומרת לעצמה הזכות לשנות את מועדי תחילת התוכנית ,וכן את מערכת הקורסים המוצעת ,אם הרישום לקורסים ייחשב מועט מדי. MJI .6שומרת לעצמה הזכות להפסיק את לימודיו והשתתפותו של תלמיד בכל אחת מהתוכניות של MJIבגין רמת התקדמות לימודית בלתי מספקת ,אי תשלום שכר לימוד ,או הפרת כללי ההתנהגות של MJIאו כל מוסכמות אחרות. MJI .7אינה מתחייבת שנקודות הזכות המוכרות על ידי MJIיוכרו על ידי כל מכללה ,אוניברסיטה או מוסד אחר .כל החלטה בעניין התאמה והקבלה של נקודות זכות המוענקות על ידי MJIשמורה\לשיפוט המוסד המקבל בלבד. .8תלמידי התוכנית ללימודים בינלאומיים הנושרים מהקורסים המקבילים לקורסי MJIבמוסד הלימודים שלהם בארץ (להלן: המוסד המארח) במהלך הסמסטר יונשרו לגמרי מתוכנית הלימודים הבינלאומיים וכל קורסי MJIהמקוונים אליהם נרשמו. התלמיד מאשר כי: א .הריני לאשר שיש לי גישה מלאה לקטלוג האקדמי של MJIבאתר www.mji.eduתחת לשונית ,Academicsאשר מכיל מידע אודות התוכניות המוצעות ע"י ,MJIוהחומרים הנדרשים להשתתפות בהן .כמו כן מפרט הקטלוג את הדרישות והליכי יישוב הסכסוכים העולים מהתקשרות זו בין MJIלתלמיד באמצעות בוררות מחייבת .הריני נותן בזה את הסכמתי לשימוש בהליכי יישוב סכסוכים אלו בלבד והריני מוותר במפורש על כל זכות לתבוע פיצוי בעתיד בכל סכסוך ביני לבין ,MJI 160204 1800Y בס''ד בערכאות ,אף בתביעות ייצוגיות או בוררות קולקטיבית MJI .שומרת לעצמה את הזכות לשנות את הכללים ,התקנות, הנהלים ,והמידע המפורט בקטלוג האקדמי ,לרבות מדיניות ונהלים הקשורים לרישום ושימור תלמידים ,הלו"ז האקדמי ,תוכן הקורסים ,תוכנית הלימודים ,הצע הקורסים ,הענקת נקודות זכות ,תעודות ותארים ,עמלות ושכר הלימוד של ,MJIועוד, באם תמצא לנכון לעשות כן לפי שיקול דעתה הבלעדי וללא הודעה מראש. ב .הריני לאשר שקראתי בעיון הסכם לימודים זה ושהוסבר לי מה גובה שכר הלימוד והעמלות בתוכנית אליה אני נרשם .יתכן שתהיינה הוצאות נוספות כגון ספרים ,חומרי לימוד ,דמי מבחנים חיצוניים ,והוצאות נוספות לצורך סיום לימודים. ג .מובן לי שיתכן שהסיוע הכספי אליו יתכן שאהיה זכאי לא יכסה את כל הוצאות שכר הלימוד וההשתתפות בתוכניות .MJI לכן ,כל יתרת החובות הם באחריותי הבלעדית. ד .מובן לי שהנני זכאי לעיין ולהדפיס עותק מדויק של הסכם זה וכל דף גילוי נאות שנחתם על ידכם בפורטל התלמיד של ,MJI שכתובתו .https://portal.mji.edu/student/login.aspמובן לי שהנני רשאי לבקש תדפיס של החוזה התקף והחתום. ה .מובן לי ש MJI-רשאית להפסיק את לימודיי באם לא אעמוד בדרישות הנוכחות ,הלימודים ,והתשלומים ,או בשל הפרת כללי ההתנהגות המפורטים בקטלוג של .MJIכל עוד הנני תלמיד של ,MJIמובן לי שעלי לשמור על רמת התקדמות לימודית מספקת ,כמפורט בקטלוג של ,MJIושעלי לסגור כל חוב כספי שיש לי כלפי MJIבמלואו. ו .מובן לי ש MJI-לא מתחייבת למצוא לבוגריה מקומות עבודה לאחר סיום תוכנית הלימודים או תואר .כמו כן מובן לי שתואר או תעודה מ MJI-עשויים להיות כפופים לאישור גופים ממשלתיים או רגולטורים לצורך הכרה במדינות שמחוץ לארה"ב, וש MJI-אינה מבטיחה כי אף תעודה או תואר המוענק ע"י MJIיוכר או יאושר על ידי אף ממשלה מחוץ לארה"ב ז .חתימתי על מסמך זה ,בין אם ידנית בין אם דיגיטלית ,מביעה את הסכמתי להצטרף לרשימת התפוצה של MJIלצורך קבלת חומר פרסומי מ .MJI-בהסכמתי זו ,הריני לאשר ל MJI-לשלוח לי מודעות ופרסומים על תוכניות לימוד ,הזדמנויות ואירועים באמצעות דואר אלקטרוני והודעות .SMS לחילופין: סימון Vליד סעיף זה מביע את רצוני שלא לקבל הודעות מ MJI-ולא להצטרף לרשימת התפוצה של MJIלצורך פרסומים. אין ברצוני לקבל חומר פרסומי מ MJI-בנוגע לתוכניות לימוד ,הזדמנויות ואירועים באמצעות דואר אלקטרוני והודעות .SMS MJIתמשיך לתקשר איתי ישירות באמצעות דואר אלקטרוני בנושאים אחרים ,כגון מטלות הלימוד בקורסים אליהם נרשמתי ,הרקורד האקדמי שלי ,ציונים ,מלגות ,וכו' ,ולשלוח אלי מידע נוסף שאינו פרסומי ,כתלמיד של .MJI שונות אם חלק כלשהו מתנאי שימוש אלה ימצא בלתי חוקי ,בטל ,או בלתי אכיף ,ייחשב חלק זה נפרד להסכם ולא ישפיע על התוקף והאכיפות של יתר הוראותיו. תחום שיפוט הסכם זה יחול ויפורש בהתאם לחוקי מדינת מישיגן אשר בארה"ב מבלי להתחשב בסתירה בעקרונות החוק של אותה מדינה. הסכמה לחוזה אני החתום מטה מאשר כי קראתי והבנתי את הסכם זה וכל תנאיו (א' עד ז') כדלעיל .כמו כן מובן לי ומקובל עלי שהסכם זה מחליף כל הסכמים בדיבור או בכתב ולא ניתן לשנותו אלא באישור בכתב של התלמיד ושל .MJIבנוסף ,מובן לי שאם אפר הסכם זה אהיה חייב בכל תשלומי גביה או התביעה ע"י עורך דין אשר ייגרמו ל.MJI- בחתימתי למטה הריני לאשר כי קראתי והבנתי הסכם זה על כל פרטיו ואני מכיר בהתחייבותי על פי חוק בנוגע לחוזה זה. בסימון התיבה ליד שם התוכנית בטבלה הראשונה לעיל ובחתימתי למטה ,הריני מסכים לכל תנאי ההסכם המפורטים לעיל. אי -הסכמתך לתנאי חוזה זה עלולה לפגוע בקבלתך ללימודים ב .MJI-צור קשר עם MJIבאחד המספרים הבאים עם כל שאלה בנוגע להסכם זה: ארה"ב ,1-248-414-6900 :שלוחה .100ישראל 02-547-8000 :שלוחה 700 האמור בהסכם זה מיועד לגברים ונשים ומנוסח בלשון זכר מטעמי נוחות בלבד. 160204 1800Y בס''ד ENROLLMENT AGREEMENT This enrollment agreement (“Agreement”), including the documents and policies incorporated by reference in this Agreement shall govern the relationship between the undersigned (“Student”) and Michigan Jewish Institute (“MJI”) for the student’s period of enrollment in the designated program below. 2015 - 2016 - Tuition & Fees Listed below is the schedule of tuition and fees in effect for the 2015-2016 academic year. Tuition must be paid in full at the start of each new semester, unless alternate arrangements have been made, in writing with MJI. Payment can be made via check or money order (payable to MJI) or by credit card (Visa, MasterCard or American Express). Tuition and fees are subject to change without notice by action of the Michigan Jewish Institute. Typically full-time collateral students take four courses: two courses onsite from their host school and two online courses through MJI. This format is also applied to the Talmudic Law Certificate (Cohort #3). REFUND POLICY The refund policy applies equally to all students regardless of the form or source of their tuition funds. NOTE: the Return of Title IV funds and Institutional refund policies are two different calculations. The Return of Title IV funds policy dictates the amount of Title IV funds that may be retained. The Institutional refund policies dictate the amount of the student’s tuition and fees obligation to the school. Please refer to the Return of Title IV Policy in the MJI Academic Catalog and Student Handbook for more information. REFUND POLICY REGARDING NOTICE OF TOTAL WITHDRAWAL This refund policy only applies in a case of total withdrawal from enrollment during a specific semester. After the first day of class, students 18+ years old or the parents or legal guardians of minors (students 17 or younger) are asked to submit written notice of cancellation or withdrawal in person, by registered or certified mail or by email (Registrar@mji.edu). In lieu of written notice, an unexplained absence of four consecutive weeks from all classes constitutes constructive notice of complete withdrawal from the semester at MJI. Students receiving financial assistance should understand that after missing only two consecutive weeks of classes (14 days) the Title IV assistance they may be receiving could be jeopardized. Refunds, if appropriate, will be based on recorded attendance, and will be made within forty-five days of the date MJI determines the student has completely withdrawn. REFUND POLICY REGARDING NON-ATTENDANCE If a student attends a class but then stops participating and does not submit a written Notice of Withdrawal, the student will be Administratively Withdrawn (WU). Students who are learning exclusively online for any term in which they are enrolled at MJI who do not attend at least once in any 14 consecutive day period will be dropped from the course and administratively withdrawn from MJI retroactive to the last date of recorded attendance. The following attendance policies apply to all other students. After four consecutive weeks of non-attendance, refunds, if appropriate, will be based on recorded attendance, and will be made within forty-five days of the date MJI determines the student has completely withdrawn. REFUND POLICY REGARDING ADDING/DROPPING CLASSES For 15-week courses: MJI allows students to drop courses within the 10 day Add/Drop period without penalty. For condensed courses: MJI allows students to drop courses within the 7 day Add/Drop period without penalty. The Add/Drop periods start the day the course begins. If courses start on different days, students will have different Add/Drop periods within the same semester. Students who drop courses during the Add/Drop period will not be charged tuition or International Studies fees. If a student attends a class but later drops all courses after the Add/Drop period the Total Withdrawal refund policy will apply. A degree or certificate from MJI may be subject to the approval of appropriate governmental and regulatory authorities for recognition in countries outside of the United States. MJI does not guarantee that any certificate or degree conferred by MJI will be recognized or approved by any foreign government. 5. The school reserves the right to reschedule the program start date or change the course offerings when the number of students scheduled to participate is deemed too small by MJI. 6.
